年,香港約有6萬宗因工受傷的個案,雖然大部份個案的傷者都能盡早康復及復工,但仍有

部份個案的康復過程格外緩慢而導致較長的康復期。過往的經驗告訴我們,工傷康復的患者多數為骨科病人,

如果在康服過程中,缺乏骨科工傷康復理念,那患者在治療過程中有可能會錯失康復介入時機,無法恢復最好的生理功能,甚至因為長期殘障無法繼續工作,融入社會時出現種種困難。

在香港,工傷個案主要是接受公營醫療系統中由不同醫療保健提供者提供的治療。由於多個專業對工傷病人介入,轉介醫生和醫療保健專業人員之間的協調和溝通欠佳亦是常見的,未能使工傷患者得到最大益處,這情況會導致處理工傷個案時欠缺效率及效果不佳。

就著以上的問題,香港中文大學矯形外科及創傷學系透過香港保險業聯會的一項研究贊助開展了“MORE”先導計劃,即 ,系統地為患者進行工傷康復治療。

改進後的模式骨科工傷康復理念

? 設立一個有系統、標準化及綜合的平台,讓不同的

醫療保健持份者包括轉介醫生、不同的醫療專業人員及個案經理溝通

? 應用“早期轉介、早期康復介入”的理念

? 提高工傷患者恢復最大的生活自理能力及生活質素? 促進工傷患者盡早返回適合自己的工作崗位,及盡

快融入社區

“MORE”計劃是各利益持份者的合作協調,以開發一個跨服務界別的新服務提供模式為目標,通過及時溝通和適當的醫療保健管理,為工傷僱員、僱主及保險公司各方的需要提供及時、有效、高效率、方便、綜合、以及能協調各方的服務,目的是為了實現工傷僱員能快速及安全地恢復工作。這計劃自2011年至今,大約有160位由於工作導致下背部疼痛的工傷個案被納入計劃。

研究計劃中亦發現,55歲或以上的工傷患者也佔了整體近兩成,這反映了香港勞動人口老化的現象。另一方面,大部份僱主因忽視工傷康復的重要性,而導致最終變成勞資糾紛。早期介入和早期復工的過程可減低工傷僱員對其僱主和保險公司尋求醫療或法律行動的機會。儘管“MORE”計劃已經有一些臨床數據支持,反映該計劃具有正面的效益,但這仍屬初步的臨床研究,還需要增加病例數目,才能得到更完整的研究結果。“MORE”計劃亦可作為職業安全健康局在工傷預防和教育上的一個重要指標。

“MORE”計劃的運作模式能讓受傷的僱員可及時接受有效及適時的工傷康復計劃,增加盡早復工的機會,確實是一個值得參考的復康模式,在醫院及社會資源運用等各方面都可節省不少、有正面影響。希望藉着“MORE”計劃的研究和發展,能進一步推動香港工傷康復的發展,期望未來香港能有一所可以讓大衆使用的公共工傷康復醫療中心。

括來說,骨科工傷康復是一個全面的方法,利用協調、溝通和協作等基本概念,提供早期診

斷,及時的個案管理和適時有效的康復治療,通過有系統的康復程序讓工傷僱員康復。MORE計劃為工傷患者的職業康復計劃在香港建立了一個參考模式。由於骨科醫生對患者的疾病比較熟悉,特別是骨科康復醫生,對疾病的流程有全面的認知,以骨科醫生作為骨科工傷康復中主要協調者,能讓多個專業的配合更順暢,令患者獲益更多。

此外,“MORE”計劃驗證了在現有的公共系統內設置一個統合案例管理的好處。從研究數據顯示,相對於沒有參與計劃的患者(對照組),參與“MORE”計劃的患者(研究組)均能較快復工、較早獲得判傷轉介和縮短病假時間。首先,研究組平均能於受傷後約6個月便能復工,但對照組的平均復工時間則為約13個月,可見對照組比研究組需多出一倍時間才能復工。同時,相比對照組的平均工傷病假日數為460天,研究組只需178天,反映研究組所需的病假相對亦較少,這無疑對僱員、僱主及醫院各方面也能有正面影響。再者,研究數據亦反映出研究組普遍能較快獲得判傷轉介,相比對照組的平均轉介需時為約12個月,研究組卻平均於受傷後6個月便已獲得轉介至醫療判傷委員會,這無疑有助加快判傷速度。

究結果顯示,“MORE”計劃能增加工傷患者復工機會和令患者的復工時間提早,另外也減少

了拖延治療所導致的二次殘障。工傷康復需要不同持份者之間的協調,溝通和協作,僱主是其中一個重要的持份者。“MORE”計劃中,個案經理充當“橋樑”,加強各持份者之間–醫生、醫療保健服務提供者、保險公司,僱主及工傷僱員的溝通。個案經理並且能協助輔導工傷僱員和促進他們提早復工;聯絡保險公司、僱主及工傷僱員,解決僱主和工傷僱員之間溝通的障礙。早期復工對不同的持份者均有益處。僱主給予工傷僱員的病假支出能夠減少、以及改善生產力,工傷僱員亦能儘快重投正常生活、減少工傷引致的社會負擔,醫院方面亦可因僱員的提早康復而縮短其他病人輪候診症的時間,改善醫院服務。

The Current Practice:

In Hong Kong, work injury cases receive treatment mainly from the public health care system, by different health care providers. Lacking coordination and communication among the referring doctors and the healthcare professionals are common. The work-injured workers cannot gain the maximum benefit, and the situation usually leads to ineffective management and poor outcomes of work-injured cases.

Solving this problem, the Department of

Orthopaedics and Traumatology of The Chinese

University of Hong Kong has developed a “Multidisciplinary Orthopaedics Rehabilitation Empowerment (“MORE”) Program” to provide a systematic rehabilitation management for work-injured workers through a donation from The Hong Kong Federation of Insurers.

? To set up a systematic, standardized and integrated platform for communication between various health care stakeholders including referring doctors, different health care providers, and case mangers

Apply the concept of “Early Referral, Early Work Rehabilitation Intervention”

Promote early RTW and reintegrate the injured workers soonest into community

“MORE” Program is a collaboration program between various stakeholders, with the vision of developing a new service delivery model spanning service boundary to provide a prompt, effective, efficient, facilitated, integrated, and coordinated care to the needs of injured workers, employers, and insurers by means of timely communication

and appropriate healthcare management. The aim

is to achieve a quick and safe return to work of the injured workers. The program has been started since 2011 and around 160 work-injured cases

associated with low back musculoskeletal injuries are recruited for the program.

E

ach year, there are around sixty thousand work injuries cases in Hong Kong. Despite

many injurers can recover and return to work early, there are cases with exceptional slow progress and require much longer term rehabilitation for recovery. Past experience tells us that many of the work injuries are orthopaedics conditions. If in the process of work rehabilitation, an injured worker was inappropriately managed, it will greatly affect the rehabilitation outcomes and lead to delay in recovery and long-term disability. The injured workers may even have difficulty in coping with their living in the community.

Framework of MORE Program

T he study shows that the MORE program increases the RTW opportunity, shortens the time required for the RTW, and decreases the impact of medical postponement. Work rehabilitation requires coordination, communication and collaboration among different stakeholders. Employer is one of the important stakeholders. Case manager acts as a “bridge”

to enhance the effective communication among all the stakeholders – doctors, healthcare service providers, insurers, employers, and the injured workers; helps to counsel the injured workers and facilitate the process of RTW, liaisons between the insurers, employers and the injured workers; and tackles the problem of communication barriers between employers and injured workers. Early RTW benefits different stakeholders. For employers, they will benefit from the reduced sick leave payments to injured workers and improved productivity. For injured workers, RTW facilitates injured workers early reintegration into the community, reduces the social burden on workplace injury, and shortens the waiting time to other patients for receiving treatment and improves the service of the hospital.

I n conclusion, orthopaedics work rehabilitation

is a holistic approach, utilizing the basic concepts of coordination, communication and collaboration, to provide early diagnosis, prompt case management, timely and effective rehabilitation. Injured workers recover through a protocol of systematic rehabilitation procedures. The MORE program has formulated a model for the occupational rehabilitation for injured workers

in Hong Kong. Orthopedic rehabilitation doctors, who are familiar with the medical treatments, are the key persons for coordinating the program in order to facilitate the rehabilitation process. In addition, the MORE program examined the benefits of implementing an integrated case management approach within an existing public system. The findings indicate that the participants in the case management group (study group) had higher chance of RTW with shorter sick leaves and shorter time lag for case settlement than those receiving conventional care (control group). The study group returns to work in 6 months after injury while control group needs 13 months. The time needed for resuming duty of control group is in a double than study group. The sick leave duration of study group is 178 days while control group is 460 days. The study group requires shorter period of sick leave which caused positive effect to employer, employee and hospital. For case settlement, the MORE Program speeds up the process of case settlement from the evidence that control group needs 12 months to be referred to medical assessment board (MAB) after injury on average, and the study group needs 6 months only.

The proportion of injured workers aged 55 or above in the study is 20% of the total participants that reflects the actual problem of aging workforce in Hong Kong. Many employers neglect the importance of work rehabilitation that may lead to employment disputes. The process of early intervention and early RTW will reduce the chance of injured workers pursuing medico-legal actions against their employers and insurance companies.

Significant outcomes and benefits reflect the positive effectiveness of MORE program, though the program is still at the preliminary stage. Enlarging the sample size of the study helps to develop a more comprehensive result. Based on the above findings, MORE program can be an important indicator for the Occupational Safety and Health Council to utilize on work injuries prevention and education. Hopefully, MORE program can be served as a rehabilitation model in Hong Kong to injured workers for an effective, timely work rehabilitation program and early RTW in the future, as the program leads to substantial savings in terms of hospital and social resources. The development of work rehabilitation in Hong Kong can be further promoted and developed through the implementation of MORE program. Establishing a statutory public work rehabilitation medical centre in Hong Kong seems to be the final goal of work rehabilitation in the future.

F rom 16 to 19 October 2013, OCI attended the

20th Annual Conference and committee meetings of the IAIS in Taipei. The theme of the conference was “Building Sustainable Insurance Supervision in a Changing World”. The focus of discussions were how insurance supervisors and the industry could collaborate to put forward initiatives and constructive ideas to maintain financial stability as well as the means to achieve sustainable supervision. There were active exchanges of views among regulators and observers on global systemically important insurers, development of a common framework for the supervision of internationally active insurance groups and consumer protection.

十三屆粵、港、澳、深四地保險監管聯席會議於2013年11月28日在廣州市南沙區舉

The 13th Joint Meeting of the Insurance Regulators of

Guangdong, Hong Kong, Macao and Shenzhen

T

he 13th Joint Meeting of the Insurance Regulators of Guangdong, Hong Kong, Macao and Shenzhen was held in Nansha on 28 November 2013. During the meeting, the four regulators exchanged views on the latest market developments in the four places and discussed how developments in Nansha, Qianhai and Hengqin could facilitate cooperation among regulators and give fresh impetus to the insurance industries. Besides, regulators also exchanged views on the initiative and the opportunities brought about by the Guangdong-Hong Kong-Macao Free Trade Zone, which is proposed by Guangdong to the Central People’s Government.

投資相連壽險計劃(“投連壽險”) –修訂的退保說明文件

2014年1月1日起,保險公司需要採用新修訂的假設淨投資回報率於製作投連壽險退保

Revised Benefit Illustration for Investment-linked Assurance Schemes (“ILAS”)

W

ith effect from 1 January 2014, insurers selling ILAS policies are required to illustrate projected surrender value and death benefit with revised assumed net rates of investment return. The interest rates will be changed from two scenarios of maximum assumed rates of 9% and 5% per annum (excluding fund management charges) to three scenarios of maximum assumed rates of 9%, 6% and 3% per annum (excluding fund management charges).

有關對專屬自保保險公司的稅務寬減

吸引更多企業在香港成立專屬自保保險公司,政府在2013-14年度財政預算案中建議

把專屬自保保險公司離岸風險的保險及再保險業務的利得稅率寬減一半(即法團一般利得稅稅率16.5%減 至8.25%)。為此,《2013年稅務(修訂)(第3號)條例草案》於2014年3月19日制定,稅務寬減會由2013/14課稅年度起生效。

Tax Concession for Captives

T

o attract more enterprises to form captive insurers in Hong Kong, it was proposed in the 2013-14 Budget to reduce the profits tax rate on the business of insurance and reinsurance of offshore risks of captive insurers by 50% (i.e. to reduce from the normal corporation tax rate of 16.5% to 8.25%). In this regard, the Inland Revenue (Amendment) (No. 3) Bill 2013 was enacted on 19 March 2014. The tax concession takes retrospective effect from the 2013/14 year of assessment onwards.

Market Performance of the Hong Kong Insurance Industry in the in 2013

otal gross premiums of the Hong Kong insurance industry in 2013 amounted to $290.7 billion, representing an increase of 13.9% over 2012.

The total amount of revenue premiums of long term in-force business was $248.6 billion in 2013, increasing by 15.2% over 2012.

Revenue premiums of Individual Life and Annuity (Non-Linked) business and Individual Life and Annuity (Linked) business increased by 18.4% to $173.3 billion and by 9.5% to $54.7 billion respectively. Contributions of Retirement Scheme business grew by 2.3% to $17.1 billion.

New office premiums (excluding Retirement Scheme business) of long term business for 2013 increased by 18.9% to $92.6 billion compared with 2012. Both Individual Life and Annuity (Non-Linked) and Individual Life and Annuity (Linked) business recorded premium growth, with the former increased by 21.0% to $73.0 billion and the latter increased by 11.7% to $19.1 billion in terms of new office premiums.

In respect of policies issued to Mainland visitors, new office premiums amounted to $14.9 billion, representing 16.1% of the total new office premiums ($92.3 billion) for individual business in 2013.In 2013, gross and net premiums of general insurance business recorded a growth of 7.1% to $42.1 billion and 8% to $29.2 billion respectively compared with 2012. Overall underwriting profit also recorded an increase from $2.2 billion in 2012 to $3 billion in 2013.

On direct business, gross and net premiums increased by 7.4% to $31.2 billion and 7.6% to $23 billion respectively in 2013 compared with 2012, mainly driven by General Liability business (comprising Employees’ Compensation business) and Accident & Health business (comprising Medical business). The former recorded gross and net premiums of $9.6 billion and $7.4 billion respectively, while the latter recorded $10.3 billion and $8.4 billion respectively.

個人人壽及年金(非投資相連)業務和個人人壽及年金(投資相連)業務的保費收入分別上升18.4%至1,733億元及9.5%至547億元。退休計劃業務的供款錄得2.3%的增長至171億元。

2013年長期業務(不包括退休計劃業務)的新造保單保費與2012年比較,上升18.9%至926億元。個人人壽及年金(非投資相連)和個人人壽及年金(投資相連)兩類業務皆錄得保費增長,前者的新造保單保費上升21.0%至730億元,而後者則錄得11.7%的增幅至191億元。

至於向內地訪客所發出的保單,其新造保單保費錄得149億元,佔2013年個人業務的總新造保單保費(923億元)的16.1%。

在2013年,一般保險業務的毛保費與2012年比較,增長7.1%至421億元,而淨保費增長8%至292億元。整體承保利潤亦由2012年的22億元增加至2013年的30億元。

在直接業務方面,2013年與2012年比較,毛保費及淨保費分別增加7.4%至312億元及7.6%至230億元。增長主要由一般法律責任業務(包括僱員補償業務)和意外及健康業務(包括醫療業務) 所帶動,前者的毛保費及淨保費分別為96億元及74億元,後者分別為103億元及84億元。

The underwriting profit of direct business increased to $2.2 billion in 2013 from $1.6 billion in 2012. The underwriting performance of General Liability business showed a turnaround from a loss of $132 million to a profit of $125 million. The underwriting profit of Property Damage business and Accident & Health business also increased from $429 million to $562 million and from $675 million to $709 million respectively.

On reinsurance inward business, gross and net premiums increased from $10.3 billion to $11 billion and from $5.7 billion to $6.2 billion respectively in 2013 compared with 2012, primarily attributable to the premium growth for Property Damage, General Liability and Motor Vehicle businesses. Such premium growth also drove the underwriting profit up from $590 million to $820 million.

在分入再保險業務方面,2013年與2012年比較,毛保費及淨保費分別由103億元升至110億元及由57億元升至62億元,主要由於財產損壞業務、一般法律責任業務及汽車業務的增長所帶動。有關保費增長亦令承保利潤由5億9,000萬元上升至8億2,000萬元。
