THE collapse of the international budget airline, Air Australia, which left 4000 passengers stranded as far afield as Hawaii, is set to result in unsecured creditors losing tens of millions of dollars. Hundreds of creditors - including passengers, airports and refuellers - are unlikely to recover the money owed to them

because the airline's assets are minimal. Air Australia's airport terminal and fleet of five Airbus A330 aircraft and one A320 are all leased.

As well as stranding 4000 passengers in Australia and throughout the Asia Pacific, the budget airline's collapse has put 300 employees out of work. Air Australia had sold about 100,000 tickets for flights which have yet to be taken, leaving those who paid with anything but credit cards out of pocket.

Air Australia was grounded yesterday after a fuel supplier in Phuket, Thailand, refused to extend credit. It led to Air Australia's chief executive and owner, Michael James, placing it in the hands of voluntary administrators at 1.30am yesterday.

The administrator, Mark Korda of KordaMentha, said his best estimate was that between $10 million and $20 million was owed on about 100,000 tickets, while millions of dollars more was likely to be owed to unsecured creditors, which would include airports, caterers, parts suppliers and governments.

Mr Korda said it was ''quite possible'' more was owed in repayments for leases on Air Australia's aircraft.

But he emphasised the vast majority of tickets would have been paid for with credit cards, which meant those passengers were likely to receive refunds from their banks.

The administrator is still assessing what assets Air Australia owns but Mr Korda pointed out that airlines ''were not usually asset-rich''. As part of its work, KordaMentha will be investigating whether Air Australia was trading while insolvent. The airline continued to sell tickets up until 1.30am yesterday.

A spokesman for the Australian Securities and Investments Commission said he could not comment on specific instances but emphasised ''trading while insolvent is a serious breach of the law and it is something that ASIC would take action on if it was shown to have occurred''.

The collapse of yet another Australian airline has highlighted the need for tighter consumer protection laws. Intending Air Australia passengers who booked by means other than credit cards, and did not have a travel insurance policy covering them, are unlikely to get their money back.

Airlines are not subject to the same rigours as travel agents, which have to pay an annual fee to the Travel Compensation Fund. It is

used to cover consumers in the event of a travel agency going belly up.

Air Australia flew international routes to Bali, Phuket and Honolulu, while its domestic network covered Melbourne, Brisbane, Perth, Port Hedland and Derby

IN AN industry known for big names, big costs and big egos, Michael James was a no-name with big dreams.

But they finally came crashing down for the young Kiwi-born businessman in the early hours yesterday when his baby, Air Australia, collapsed owing tens of millions of dollars, stranding

4000 passengers as far afield as Thailand and Hawaii and putting 300 employees out of work.

Mr James, 34, is an aviation buff. His first stop after leaving school was Ansett, where he worked for seven years, including a stint behind the check-in counter. But it was in the field of aircraft brokerage that he began to build his charter business into a

full-fledged airline.

Three years ago the company he founded, Strategic Aviation, bought the assets of formula one racing identity Paul Stoddart's failed business-class airline Ozjet, for what Mr James later described as a ''minimal amount''.

Within a year, Strategic went from having no aircraft to a fleet of seven planes, including Airbus A330s and A320s (some of which flew charters for holidaymakers in Europe).

Strategic earned its money in charter operations for government departments, flying Australian troops and military cargo to the Middle East and moving immigration detainees around the country. But the loss of a $30 million contract with the Department of Defence in 2010 amid an Australian Federal Police investigation forced the airline to try its hand at becoming a commercial carrier. The federal police later dropped its investigation into whether criminal offences occurred in the awarding of a Defence tender to Strategic Aviation in 2005.

The airline quickly expanded its commercial passenger network, keeping its hand in flying immigration detainees and servicing the fly-in, fly-out market for resource companies.

But the foray into commercial flying brought much higher risks than reliable government contracts.

Rebadged as Air Australia last September, the carrier struggled to find its niche as a ''boutique carrier'' in Australia and the

Asia-Pacific.

The company's most recent financial accounts show the commercial airline was cash-flow positive in 2010 only because it received a loan of more than $6 million from the charter business. When asked about his airline's financial health early last year, Mr James said it would be profitable in the year ahead ''without a doubt''.

But the faces of passengers stuck in Phuket last night told a different story.

''They kept telling us the flight was delayed because of small technical difficulties but we smelt a rat,'' Bill Tehan from Melbourne said. ''We were all shattered.''

Spanish airline Spanair collapsed suddenly over the weekend due to a lack of funding, shutting down 220 flights and leaving passengers stranded across Europe and Africa.

Spanair, Spain's fourth-largest airline, collapsed suddenly over the weekend, leaving over 30,000 passengers stranded across Europe and Africa, BBC News reported.

As of Monday, at least 37,000 passengers' flights had been affected by Spanair's decision to ground all operations late Friday, a Spanair spokesman said, AFP reported.

"Spanair is permanently in contact with the Spanish aeronautical authorities participating in the Barcelona airport crisis committee where continually evaluates the contingency plan for the cessation of the airline′s operations," said a statement on the company's website. "Spanair apologizes to all our customer affected by this situation."

The airline's chairman Ferran Soriano said that Spanair, which is based in the Catalonia region and subsidized by the Catalan government, had failed to attract investment and the regional government decided to stop providing funds, the UK Press Association reported. The airline was in takeover talks with Qatar airlines, according to the BBC.

Spain's government began legal proceedings against the airline on Friday, which could lead to Spanair being fined 9 million euro

(nearly $12 million) for two "serious infringements" of aviation security legislation, development minister Ana Pastor said.

"The ministry will not cease until those who failed to fulfill the norms and trampled on the rights of citizens take full responsibility," Pastor told a news conference, RTE reported.

Spanair filed for voluntary bankruptcy Monday, AFP reported. The airline declared liabilities of more than 300 million euros ($393 million), the High Court of Catalonia said in a statement.

Low-cost airlines such as Ryanair and Easyjet had challenged the legality of the government subsidies Spanair was receiving to the European Commission, BBC News reported.

Ryanair said on Monday that it was looking at opportunities in Spain.

"We certainly see it as an opportunity to expand our base," it said, according to BBC news.

Spanair, whose hub was Barcelona airport, employed around 2,000 people and used the services of about 1,200 ground staff, UKPA reported. The collapse could lead to the loss of 4,000 jobs.

In August 2008, Spanair was responsible for a crash that killed 154 people, according to AFP. It was considered to be Spain's worst aviation disaster in 25 years. Only 18 people survived after a jet crashed shortly after take-off as it tried to leave Madrid for the Canary Islands.

Airlines seek investment to stop Spanair collapse from triggering a trend of failed airlines.

BRUSSELS, Belgium – The sudden collapse of Spanair over the weekend left over 20,000 passengers stranded around Europe and North Africa.

Now industry insiders are wondering if the Spa nish airline’s demise could be the first of many, as cash-strapped European governments can no longer afford to keep failing carriers flying.

“As the economic noose tightens around European airlines, the industry’s ranks look set to thin this year,” the a viation intelligence provider CAPA wrote on its website Tuesday. “Governments are now reluctant or unable to prop up their ailing national airlines as the debt crisis forces unpopular austerity programs right across the economy.”

Spanair filed for voluntary bankruptcy on Monday, declaring debt of 474 million euros. That followed Friday’s collapse, when all flights were halted after talks with Qatar Airlines on the purchase of a 49 percent stake in Spain’s third-largest carrier broke down and the regional government in Catalonia refused to support the airline with more funds.

Catalonia is a major shareholder in Spanair and had invested 140 million euros in the airline. However, the regional government is itself heavily in debt, and is facing austerity measures as part of Spain’s efforts to cut public spending.

The Spanair collapse has highlighted the plight of airlines across the continent, with governments from Portugal to Poland seeking private investors to save troubled carriers.

The Hungarian airline Malev appealed to its government for help on Monday after acknowledging that its finances had become unviable, but the government in Budapest is facing one of Europe’s most acute budget crunches and previous subsidies to the airline were declared illegal by the European Union.

The government in Warsaw is hoping to complete the privatization of the loss-making LOT Polish Airlines by the middle of this year, with Turkish Airlines among the frontrunners to buy.

Portugal aims to start the privatization of TAP Air Portugal this year while the Irish government is mulling the sale of its 25 percent stake in Aer Lingus. The Czech Prime Minister Peter Necas last month said privatization is the only way to save the CSA airline.

The Hungarian national airline Malev has folded after its financial

situation became unsustainable.

"At 0500 GMT... after 66 years of almost continuous operation Malev will no longer take off," it said.

It came after the European Commission ordered Malev to repay various forms of state aid received from 2007 to 2010.

The sums involved amounted to 38 billion forints (130m euros; $171m; £108m), a sum equal to its entire 2010 revenue. "Despite its best interests the owner can no longer provide financial resources for the operation of the airline in the wake of the condemning decision of the European Commission," an airline statement said.

The European Consumer Organisation, which "defends the interests of all Europe's consumers", said the news came after Spanair's collapse in the very same week.

"This development is yet more incontrovertible proof that the current update of European legislation on air travel must incorporate a mandatory guarantee against airline bankruptcies," it said.

'Inherited skeletons'

The carrier employs 2,600 people and is responsible for close to half of all air traffic at Budapest Liszt Ferenc airport.

Part of the Oneworld airline alliance, which also includes American Airlines and British Airways, Malev has a leased fleet of 22 passenger aircraft.

In 2010 it posted a loss of 24.6bn forints, although an improved 2011 figure had been predicted.

Chief executive Lorant Limburger said the immediate reason for the collapse was the demand for upfront payments by its suppliers. Prime Minister Viktor Orban said on state radio that two Malev planes were still overseas, one in Tel Aviv, the other in the Irish Republic.

The premier said those planes were not allowed to take off because of Malev's debts.

He told radio station MR1-Kossuth that Malev may possibly be relaunched "if we manage to get rid of the inherited skeletons".

On Thursday, Hungary's government appointed a receiver to the airline to try to protect it from creditors' claims.
