The ICC Uniform rules for collections were first published by the

ICC in 1956. Revised versions were issued in 1967 and 1978. This present revision was adopted by the Council of the ICC in June 1995. It is issued with the title "ICC Uniform Rules for Collections" as ICC Publication No 522.

A GENERAL PROVISIONS AND DEFINITIONS ARTICLE 1

Application of URC 522

a The Uniform Rules for Collections, 1995 Revision, ICC Publication No 522,shall apply to all collections as defined in ARTICLE 2 where such rules are incorporated into the text of the ‘collection instruction' referred to in ARTZCLE 4 and are binding on all parties thereto unless otherwise expressly agreed or contrary to the

provisions of a national, state or local law and/or regulation which cannot be departed from.

b Banks shall have no obligation to handle either a collection or any collection instruction or subsequent related instructions.

c If a bank elects, for any reason, not to handle a collection or any relate

d instructions received by it, it must advis

e the party from whom it received the collection or the instructions by telecommunication or, i

f that is not possible, by other expeditious means, without delay.

ARTICLE 2

Definition of Collection

For the purposes of these ARTICLEs:

a‘Collection' means the handling by banks of documents as defined in Sub-ARTICLE 2 b in accordance with instructions received, in order to :

1. obtain payment and/or acceptance

or

2. deliver documents against payment and/or

against acceptance.

or

3. deliver documents on other terms and conditions.

b "Documents' means financial documents and/or commercial documents:

1. ‘Financial documents' means bills of exchange, promissory notes, cheques, orb other similar instruments used for obtaining the payment of money.

2. ‘Commercial documents'means invoices, transport documents, documents of title or other similar documents, or any other documents whatsoever, not being financial documents.

c‘Clean Collection' means collection of financial documents not accompanied by commercial documents

d‘Documentary collection'means collection of: 1. Financial documents accompanied by commercial documents.

2. Commercial documents not accompanied by financial documents.

ARTICLE 3

Parties to a Collection

a For the purposes of these ARTICLEs the ‘parties thereto' are:

1.the ‘principal" who is the party entrusting (委托)the handling of a collection to a bank;

2.the ‘remitting bank'which is the bank to which the principal has entrusted the handling of a collection;

3.the ‘collecting bank' which is any bank, other than the remitting bank, involved in processing the collection;

4.the ‘presenting bank’which is the collecting bank making presentation to the drawee.

b The ‘drawee’is the one to whom presentation is to be made in accordance with the collection instruction.

FORM AND STRUCTURE OF COLLECTIONS ARTICLE 4

Collection Instruction

a 1. All documents sent for collection must be accompanied by a collection instruction indicating that the collection is subject to URC 522 and giving complete and precise instructions. Banks are only permitted to act upon the instructions given in such collection instruction, and in accordance with these Rules.

2. Banks will not examine documents in order to obtain instructions.

3. Unless otherwise authorised in the collection instruction, banks will disregard

any instructions from any party/bank other than the party/bank from whom they received the collection.

b A collection instruction should contain the following items of information as appropriate.

1. Details of the bank from which the collection was received including full name,postal and SWIFT addresses, telex, facsimile(=FAX) numbers

and reference.

2. Details of the principal including full name, postal address, and if applicable telex, telephone and facsimile numbers.

3. Details of the drawee including full name, postal address, or the domicile at which presentation is to be made and if applicable telex, telephone and facsimile numbers.

4. Details of the presenting bank, if any, including full name, postal address, and if applicable telex, telephone and facsimile numbers.

5. Amount(s) and currency(ies) to be collected

6. List of documents enclosed and the numerical count of each document.

7. a Terms and conditions upon which payment and or acceptance is to be obtained.

b Terms of delivery of documents against :

1) payment and/or acceptance

2) others terms and conditions

It is the responsibility of the party preparing the collection instruction to ensure that the

terms for the delivery of documents are clearly and unambiguously stated,

otherwise banks will not be responsible for any consequences arising therefrom.

8. Charges to be collected, indicating whether they may be waived or not.

9. Interest to be collected, if applicable, indicating whether it may be waived or not, including:

a. rate of interest

b. interest period

c. basis of calculation (for example 360 or 365 days in a year) as applicable

10. Method of payment and form of payment advice.

11. Instructions in case of non-payment, non-acceptance and/or non-compliance with other instructions.

2. The collecting bank will not be liable or responsible for any ensuing(接着发生的) delay as a result of an incomplete/incorrect address being provided.

C FORM OF PRESENTATION

ARTICLE 5

Presentation

a For the purposes of these ARTICLEs, presentation is the procedure whereby the presenting bank makes the documents available to the drawee as instructed.

b The collection instruction should state the exact period of time within which any action is to be taken by the drawee.

Expressions such as 'first', 'prompt', 'immediate', and the like should not be used in connection with presentation or with reference

to any period of time within which documents have to be taken up or for any other action that is to be taken by the drawee. If such terms are used banks will disregard them.

f the party from whom they received the collection unless otherwise instructed, and to make any necessary endorsements or place any rubber stamps or other identifyin

g effect to the instructions of the principal, the remitting bank will utilise the bank nominated by the principal as the collecting bank. In the absence of suc

h nomination, the remitting bank will utilize any bank of its own, or

another bank's choice in the country of payment or acceptance or in the country where other terms and conditions have to be complied with.

e The documents and collection instruction may be sent directly by the remitting bank to the collecting bank or through another bank as intermediary.

g bank does not nominate a specific presenting bank, the collecting bank may utilize(=utilise) a presenting of its choice.

ARTICLE 6 :

Sight/Acceptance

In the case of documents payable at sight the presenting bank must make presentation for payment without delay. In the case of documents payable at a tenor other than sight the presenting bank must, where acceptance is called for,make presentation for acceptance without delay, and where payment is called for,make presentation for payment not later than the appropriate maturity date.

ARTICLE 7

Release of Commercial Documents

Documents Against Acceptance (D/A) vs. Documents

Against Payment (D/P)

a Collections should not contain bills of exchange payable at a future date with instructions that commercial documents are to be delivered against payment.

b If a collection contains a bill of exchange payable at a future date, the collection instruction should state whether the commercial documents are to be released tothe drawee against acceptance (D/A) or against payment (D/P)

In the absence of such statement commercial documents will be released only against payment and the collecting bank will not be responsible for any consequences arising out of any delay in the delivery of documents.

C If a collection contains a bill of exchange payable at a future date and the collection instruction indicates that commercial documents are to be released against payment, documents will be released only against such payment and the collecting bank will not be responsible for any consequences arising out of any delay in the

delivery of documents.

ARTICLE 8

Creation of Documents

Where the remitting bank instructs either the collecting bank or the drawee is to create documents (bills of exchange, promissory notes, trust receipts, letters of undertaking or other documents) that were not included in the collection, the form and wording of such documents shall be provided by the remitting bank, otherwise the collecting bank shall be not be liable or responsible for the form and wording of any such documents provided by the collecting bank and/or the drawee.

D LIABILITIES AND RESPONSIBILITIES ARTICLE9

Good faith and Reasonable care

Banks will act in good faith and exercise reasonable care

ARTICLE 10

Documents vs. Goods/Services/Performances

a Goods should be despatched directly to the address of a bank or consigned to or

to the order of a bank without prior agreement on the part of that bank.

Nevertheless, in the event that goods are despatched directly to the address of a bank or consigned to or to the order of a bank for release to a drawee against payment or acceptance or upon other terms and conditions without prior agreement on the part of that bank, such bank shall have no obligation to take delivery of the goods, which remain at the risk and responsibility of the party despatching the goods.

b Banks have no obligation to take any action in respect of the goods to which a documentary collection relates, including storage and insurance of the goods even when specifi

c instructions are given to do so. Banks will only take such action if,when, an

e extent that they agree to do so in each case. Notwithstanding the provisions o

f Sub-ARTICLE 1 c this rule

applies even in the absence of any specific advice to this effect by the collecting bank.

c Nevertheless, in the case that banks take action for the protection of the goods,whether instructe

d or not, they assum

e no liability or responsibility with regard to the fate and/or conditions o

f the goods and/or for any acts and/or omissions on the part of any third parties entrusted with the custody and/or protection of the goods.

However, the collecting bank must advise without delay the bank from which the collection instruction was received of any such action taken.

d Any charges and/or expenses incurred by banks in connection with any action taken to protect th

e goods will be for the account o

f the party from whom they received the collection.

e 1. Notwithstanding the provisions o

f Sub-ARTICLE 10 a. where the goods are consigned to or to the order of the collectin

g bank and the drawee has honoured the collection by payment,

acceptance or other terms and conditions and the collecting bank arranges for the release of the goods, remitting bank shall be deemed to have authorised the collecting bank to do so.

2. Where a collecting bank on the instructions of the remitting bank or in terms of Sub-ARTICLE 10 e (1.) above arranges for the release of the goods, the remitting bank shall indemnify such collecting bank for all damages and expenses incurred.

ARTICLE 11

Disclaimer For Acts of an Instructed Party

a Banks utilising the services of another bank or other banks for the purpose of giving effect to the instructions of the principal, do so for the account and at the risk of such principal.

b Banks assume no liability or responsibility should the instructions they transmit not be carried out, even if they have themselves taken the initiative in the choice of such other bank(s).

c A party instructing another party to perform

services shall be bound by and liable to indemnify the instructed party against all obligations and responsibilities imposed by foreign laws and usages.

ARTICEE 12

Disclaimer on Documents Received

a Banks must determine that the documents received appear to be as listed in the collection instruction and must advise by telecommunication or, if that is not possible, by other expeditious means, without delay, the party from whom the collection instruction was received of any documents missing, or found to be other than listed.

Banks have no further obligation in this respect.

b If the documents do not appear to be listed, the remitting bank shall be precluded from disputing the type and number of documents received by the collecting bank.

12 a and 12 b above, banks will present documents

as received without further examination.

ARTICLE 13

Disclaimer on Effectiveness of Documents Banks assume no liability or responsibility for the form, sufficiency, accuracy, genuineness, falsification or legal effect of any documents(s), or for the general and/or particular conditions stipulated in the document(s) or superimposed thereon; nor do they assume any liability or responsibility for the description quantity;weight , quality, conditions, packing, delivery, value or existence of the goods represented by any document(s), or for the good faith or acts and/or omissions, solvency, performance or standing of the consignors, the carriers, the forwarders, the consignees or the insurers of the goods, or any other person whomsoever.

ARTICLE 14

Disclaimer on Delays, Loss in Transit and Translation

a Banks assume no liability or responsibility for the consequences arising out of delay and/or loss in transit of any message(s), letter(s) or document(s), or for delay,mutilation or other error(s) arising in transmission of any telecommunication or for error(s) in translation and or interpretation of technical terms.

b Banks will not be aliable or responsible for any delays resulting from the need to obtain clarification of any instructions received. ARTICLE 15

Force Majeure

Banks assume no liability or responsibility for consequences arising out of the interruption of their business by Acts of God, riots, civil commotions, insurrections,wars, or any other causes beyond their control or by strikes or lockouts.

E PAYMENT

ARTICLE I6

Payment Without Delay

a Amounts collected (less charges and/or disbursements and/or expenses where applicable) must be made available without delay to the party from whom the collection instruction was received in accordance with the terms and conditions of the collection instruction.

b Notwithstanding the provisions of Sub-ARTICLEs

1 c and unless otherwise agreed, the collecting bank will effect payment of the amount collected in favour of the remitting bank only. ARTICLE 17

Payment in Local Currency

In the case of documents payable in the currency of the country of payment (local currency), the presenting bank must, unless otherwise instructed in the collection instruction release the documents to the drawee against payment in local currency only if such currency is immediately available for disposal in the manner specified in the collection instruction. ARTICLE 18

Payment in Foreign Currency

In the case of documents payable in the currency other than that of the country of payment (foreign currency), the presenting bank must, unless otherwise instructed in the collection instruction, release the documents to the drawee against payment in the designated foreign currency only if such foreign currency can immediately be remitted in accordance with the instructions given in the collection instruction.

ARTICLE I9

Partial Payments

a In respect of clear collections, partial payments may be accepted if and to the extent to which and on the conditions on which partial payments are authorized by the law in force in the place of payment. The financial document(s) will be released to the drawee only when full payment thereof has been received.

b In respect of documentary collections, partial payments will only be accepted if specifically authorised in the collection instruction.

中国古代格斗兵器:矛、枪和戈等 篇一:中国古代兵器 我花了一天时间编辑的一些关于古代兵器的知识! 叉的起源很早,六千多年前的陕西半坡村遗址中,就曾发现过原始的骨制鱼叉,用来扎取鱼类。不过,居住在森林旁的猎户们,为了猎杀大型野兽如勐虎、花豹等,需要保持安全距离,所以使用三股长叉,一般称作「虎叉」。 《水浒传》说道解珍、解宝两兄弟,收了知府的捕虎文状,要捉山上大虫,于是「拿了钢叉,两个径奔登州山上」。可见「钢叉」是捉虎的利器。有时为了便于远掷以确保安全,又改成了投掷用的飞叉。 「叉」后来发成兵器,种类很多,大致可按长短分,或以叉股分;历代都不是主要兵器,而与钩、镰、钯等杂兵器并论。宋代有叉竿,长二丈,用来叉飞梯与登城。南宋宗泽的偏将张纯善使飞叉,能在二十步外取人性命,并且教出很多使飞叉的士卒。明代又有丈余长的「马叉」,茅元仪的《武备志》说:「上可叉人,下可叉马。」是步兵所用的长兵. 国剧《金钱豹》里,有飞叉的特技,叉头分成三股,股与叉柄连接处,套上钢片两片,随着演员舞动、抛掷时,铮铮作响,增强了惊险与娱乐的效果。这些其实都是从民国初年江湖杂耍卖艺者学来的身段。

另有一说: 叉之由来,较各种兵器为后,宋元以前,初不见用诸战阵,或谓汉时蛮人,皆以此为利器;又谓叉为古时猎兽之器。如上说,则叉实创自南蛮;如后说,则叉创于猎户;孰是孰非,亦未能断定,始自何时,亦无从稽考,姑置不论。 至飞叉之法,宋代以前,迄无所闻,相传创之者为宗泽偏将张纯。纯为花县人水镜明月老乡也^_^!)力猛侞虎,善使飞叉,能于二十步外取人,发无不中;时行伍中从而习者,颇不乏人。据此说,则叉始于南宋,以法之创始而推诸叉,即谓为叉亦创于是时,亦无不可;惟其法初甚简单,不过抡、盘、飞、掷、打击、抢接诸法而巳;其后代有增减,然皆从以上各法中变化而出;即今日所传之飞叉法,虽分路甚多,皆跳不出此六法,但就此六法杂乱而复叠行之耳。惟习此者,以南人为多,北派武术中习此者甚少;岂发源之处,视为不足贵乎?抑以南渡之后,其法流南方,北方反不得其真传乎? “干戈”是我国古代最常见的对兵器的总称,它们分别代表两种武器。早在甲骨文和金文中,就已经出现了“干”和“戈”两字。随着文字的演变,“干戈”已成为战争和斗争的代名词,如我们所熟悉的“大动干戈”和“化干戈为玉帛”等。可见干和戈这两种兵器在我国已有着相当久远的历史了。 干,据说是一种分叉的木干,用来抵御野兽和敌人的进犯,是人类最早的防御武器,也是打猎用的猎具。

最新中国古代格斗兵器:矛、枪和戈等 篇一:中国古代兵器 我花了一天时间编辑的一些关于古代兵器的知识! 义的起源很早,六千多年前的陕西半坡村遗址中,就曾发现过原始的骨制鱼义, 用来扎取鱼类。不过,居住在森林旁的猎户们,为了猎杀大型野兽如劭虎、花豹等,需要保持安全距离,所以使用三股长义,一般称作「虎义」。 《水浒传》说道解珍、解宝两兄弟,收了知府的捕虎文状,要捉山上大虫,于是「拿了钢叉,两个径奔登州山上」。可见「钢叉」是捉虎的利器。有时为了便于远掷以确保安全,又改成了投掷用的飞义。 「义」后来发成兵器,种类很多,大致可按长短分,或以义股分;历代都不是主要兵器,而与钩、镰、耙等杂兵器并论。宋代有义竿,长二丈,用来义飞梯与登城。南宋宗泽的偏将张纯善使飞叉,能在二十步外取人性命,并且教出很多使飞义的士卒。明代又有丈余长的「马义」,茅元仪的《武备志》说:「上可义人,下可义马。」是步兵所用的长兵. 国剧《金钱豹》里,有飞义的特技,义头分成三股,股与叉柄连接处,套上钢片两片,随着演员舞动、抛掷时,铮铮作响,增强了惊险与娱乐的效果。这些其实都是从民国初年江湖杂耍卖艺者学来的身段。 另有、飞、掷、打击、抢接诸法而巳;其后代有增减,然皆从以上各法中变化而出;即今日所传之飞义法,虽分路其多,皆跳不出此六法,但就此六法杂乱而复叠行之耳。惟习此者,以南人为多,北派武术中习此者甚少;岂发源之处,视为不足贵乎?抑以南渡之后,其法流南方,北方反不得其真传乎? “干戈”是我国古代最常见的对兵器的总称,它们分别代表两种武器。早在甲骨文和金文中,就已经出现了“干”和“戈”两字。随着文字的演变,“干戈” 已成为战争和斗争的代名词,如我们所熟悉的“大动干戈”和“化干戈为玉帛” 等。可见干和戈这两种兵器在我国已有着相当久远的历史了。 干,据说是一种分义的木干,用来抵御野兽和敌人的进犯,是人类最早的防御武器,也是打猎用的猎具。 戈,最初是一种在木杆上绑上石刀用以打击猛兽的猎具。后来被青铜材质的戈头所

釋燕兵器銘文中的"斫" (首發) 張崇禮 復旦大學出土文獻與古文字研究中心 燕昭王時代的戈戟類兵器中,有一種董珊先生稱之為"內三面有刃"的類型,在內的位置上有銘文"郾王職乍巨鋸",或"郾王職乍鋸"。i其中的"",原字形一般作。于省吾先生釋為"扞",ii黃茂琳先生釋為"",iii李學勤先生釋為"",iv黃盛璋先生釋為"改",v何琳儀先生以""為""之古文,讀為"捶",訓為"擊",vi董珊先生認為"'乇'當讀為'徒',指步兵。" 我們認為何琳儀先生對""字意義的考釋頗具啓發性,節引如下: "燕兵銘'',應據《說文》古文讀'捶',音若'朵'。""''的語根是'度'(乇)或'打'。""''、'度'、'打'均一音之轉。'捶',本訓'以杖擊也',與'度'音義相涵,顯然亦屬一音之轉。" 雖然我們並不同意何先生讀""為"捶"的意見,但他把此字訓為"擊"vii並指出和"度"之間的密切聯繫,還是非常正確的。"乇",端母鐸部;"度",定母鐸部。二者古音十分接近。從傳世典籍通假關係來看,"宅"和"度"相通用。如《尚書·堯典》:"宅西曰昧谷。"《周禮·天官·縫人》鄭注引"宅"作"度"。《尚書·舜典》:"五流有宅。"《史記·五帝本紀》作"五流有度。"其例甚多,不贅舉。viii從戰國文字來看,中山王大鼎"考宅唯刑"的"宅"讀為"度";郾王職壺"乇幾卅"的"乇",董珊、陳劍先生亦讀為"度"。ix楚系文字中二者相通的例子也很多,如上博六《天子建州》簡7、8的"恥乇"讀為"恥度",上博七《凡物流形》簡3的"五乇"讀為"五度"。從字形上看,"度"本亦从攵。 綜上所述,我們覺得把""釋為"度"或"剫",問題應該不大。"斫"、"度"音、義皆近,故""可讀為"斫"。《說文》:"斫,擊也。" "鋸",《商周青銅器銘文選》編寫組認為:"此字古音入魚部見紐,與戟為鐸部見紐音讀相近,應是戟的方音。"x李家浩先生為之申說,認為"戟"或作"鋸","是完全有可能的"。xi 董珊先生說:"據此來看,'乇鋸(戟)'應該是有矛刺相配的。"又說:"我們認爲這些'巨乇矛'或'乇矛'原來是跟'巨乇鋸'或'乇鋸'一起組裝成戟,然後才使用的。"我們認為這些都是非常好的意見,只是"巨乇矛"、" 乇矛"的""也應讀為"斫"。 最後談一下對董珊先生讀""為"徒"的看法。我們覺得董先生的意見可能存在兩個問題,一是"徒"字習見,二是"巨徒鋸"似乎不合語法。如果把"徒"釋為"步兵",就是名詞,這個名詞可以理解為是表領屬。漢語偏正結構的定語順序一般是表領屬的名詞在前,形容詞在後。比如說"大刀"、"長矛","步兵的長矛"、"騎兵的大刀"等。象"巨徒鋸"這樣的語序,即使是古代漢語,有可能和現代漢語語序不同,也明顯比較彆扭。而把""讀為"斫",則沒有這方面的問題,"巨斫戟"和現代漢語如"大砍刀"等之類的語序正合。 另外,董先生把中山王鉞銘文"以敬(儆)乇眾"和左軍戈"乇僕"的"乇"都讀為"徒",也似有可商。我們覺得,這兩例有可能讀為"度"。"以儆度眾"是用來警戒規範民眾的意思。"度僕"可能是軍隊中的度支之官。《礼记·王制》:"五穀皆入,然後制國用。"郑玄注:"制國用,如今度支經用。"董珊先生說:"我們知道,先秦戰爭中有專門負責軍需的一類人,稱為'僕'。"負責軍需的人稱為"度僕",是有可能的。當然,這兩例是否一定如此讀,我們自己也不敢十分肯定,這裡提出來,僅供大家參考。 附記:本文寫作過程中曾向程少軒先生請教,並蒙程先生提供資料,謹致謝忱。

2009年2月5日放大缩小默认 中国古代的蒸煮器——甗 箅 甗① 刘晓华本报记者李寒歌 中国首届花馍艺术节即将在咸阳举办,这是一件十分有意义的事情。中国的饮食文化源远流长,单就蒸花馍的器物来讲,目前在咸阳所能见到的最早实物,是一件距今3000多

年的商代末期的青铜甗。 在我们咸阳市文物保护中心的库房内,存放着一件泾阳县高家堡村戈氏家族墓地出土的先周时期的青铜甗。该甗为连体,即上部的甑和下部的鬲被浇铸在一起,敞口三袋足,甑鬲相连处向内束收。口沿上对称有两麻花状半环立耳,外壁饰有夔龙纹及饕餮纹等纹饰,内壁一耳下有明显戈形族徽标记,中有多孔甑箅,甑箅与甗体通过两结环相连,可自由张开,这样向鬲内注水就很容易,而且能很方便地看出水位的高低。该甗甑大鬲小,上阔下窄,看似不稳定,似乎容易倾倒,实则不然。经研究后才发现,上部甑壁薄而轻,下部鬲壁厚而重,应为分开浇铸而后接,这样重心低不易倾倒,下部鬲小装水少,加之袋足本身受火面积就大,水更容易被烧开,上部甑大则装的要蒸的东西多,这样的器形蒸东西又多又快,既节约了能源又节约了时间,十分符合我们国家现行的节能减排政策。可见我们的祖先是多么的聪明,3000多年前就拥有了如此的智慧。 高家堡墓群为商末周初的戈氏家族墓地,位于泾阳县兴隆乡高家堡村,是1991年当地一位村民在整修自家猪舍时被发现的,后经陕西省考古研究所调查钻探发掘,共发现商末至西周早期墓葬6座,出土器物有铭文者26件,其中有戈形族徽者8件,全国各地有明确出土地点的戈族器也总共才30多件,可见泾阳是当时戈族的主要聚集地之一。 甗在古代是专门用来蒸煮的一种炊器,平民用的多为陶制,而且器形较小,只有拥有一定权力和地位的族长和族内主要首领才能使用如此大器形的铜制甗。而且该甗工艺复杂,外壁精工细做的纹饰自不待言,而上部的甑、下部的鬲、中间的甑箅都为分做而成,最后统一浇铸,这在当时是最先进的铸铜工艺之一,可见古戈国的社会发展水平和科技水平在当时都是十分先进的。古人在用甗蒸东西时应当是加盖的,但当时的盖多用竹皮编制,无法保存至今,该甗内壁保存有完好的大片席纹,应当是盖子腐朽后残留的痕迹。 我们相信通过举办花馍艺术节这种形式,能够把我国久远的饮食文化特别是蒸煮文化艺
