建设工程银行保函敞口担保业务风险初探 赵学奎 摘要：国际工程担保市场上有低保额无条件保函模式和高保额有条件担保书模式两种不同的担保模式，银行保函多属无条件、不可撤销、见索即付保函，习惯上称为独立保函。担保公司对银行独立保函提供敞口担保存在风险，应注意风险防范。 主题词：工程担保银行保函敞口担保风险防范 2006年以来，合肥市大力实施“大环境、大建设、大发展”战略，取得了辉煌的业绩。其中，“大建设”方面，2006、2007年两年，共安排新建和扩建道路207条、桥梁90座，市政建设投资224亿元。“三大推进”激活了担保市场需求，其中我公司1－9月新批担保金额近14亿元，出保额达10.59亿元，比2006年全年增加4.09亿元，增长62％。“三大推进”也催生了一些担保新品种，今年以来，我公司先后为数家施工企业提供建设工程银行保函敞口担保，担保额超过1300万元。笔者结合业务实践，对工程担保概况、银行保函敞口担保业务的风险及防范进行初步探讨，以就教于大家。 一、工程担保概述 工程担保，是指在工程建设活动中，由保证人向合同一方当事人（受益人）提供的，保证合同另一方当事人（被保证人）履行合同义务的担保行为，在被保证人不履行合同义务时，由保证人代为履行或承担代偿责任。主要品种有：投标保证、履约保证、业主支付保证、付款保证、预付款保证、完工保证、分保保证、供货保证、维修保证、预留金保证等。
