为进一步推动汉语国际推广事业的发展,满足非英语语种汉语教师培养计划的需要,甲乙丙三方在平等、自愿的基础上,就甲方派遣乙方接受葡语培训、丙方为乙方提供保证担保等事宜,达成如下协议:

第一条甲方接受乙方的申请,同意派遣乙方赴澳门接受葡萄牙语培训;期限为 1学年,自 2012年8 月日起至 2013年 5 月日止。

第二条乙方同意在甲方指定的澳门理工学院参加葡萄牙语培训,遵守甲方制定的培训计划。

第三条经费及支付方式

甲方向乙方提供澳门培训期间的生活津贴、赴澳门及任务结束返回内地的机票费及保险费等费用(以甲方实际向乙方支付的金额为准);住宿费由甲方直接支付给澳门理工学院、在派出期间由澳门理工学院为乙方购买人身意外伤害保险一份,其他费用由甲方自行或委托第三方向乙方发放。

第四条培训期满后的安排

(一)在培训期满后的五年内,经甲方对乙方审核合格,有权随时派遣乙方赴甲方指定国家从事期限为一年的国外汉语教学服务。

(二)培训期满后,乙方仍回原单位任职。在甲方需要派遣乙方赴国外从事汉语教学服务时,乙方应无条件服从甲方安排。

第五条甲方权利义务

(一)向乙方提供相关咨询。为乙方办理赴澳门手续提供帮助和方便,相应赴澳门手续费由乙方自行承担。

(二)委托澳门理工学院管理乙方在外期间的学习事务,依法维护乙方正当权益。

第六条乙方权利义务

(一)乙方应自行协调与原单位的工作关系,不得因此影响派出及派出任务完毕后为甲方提供汉语教学服务。

(二)保证向甲方提交的所有文件、材料的真实性和合法性。

(三)保证抵达目的后十日内凭有关材料向培训院校报到。未能于十日内及时报到的,应书面告知甲方并说明理由;超过一个月未报到的,甲方不发资助经费,取消其培训资格,乙方及保证人承担相应的违约责任并赔偿甲方因此所受全部损失。

(四)保证完成实践和培训任务,未经甲方同意,不得擅自变更本协议确定的期限培训计划。

(五)服从澳门理工学院的管理,并与甲方保持经常联系,每季度向甲方汇报培训进展情况,填报《培训情况报告表》。

(六)不得从事有损祖国利益和安全的活动,自觉维护祖国荣誉,服从中联办的指导和管理;遵守我国及培训所在地法律;尊重当地人民的风俗习惯。

(七)任务结束时应及时作出书面培训总结;期满返回内地后及时向甲方汇报在外培训情况。

第七条担保

(一)乙方为保证履行其承诺和义务,于本协议签订时向甲方缴纳1(壹)万元的保证金。乙方按期返回内地,经甲方审核合格后,按甲方规定的程序和方式退还乙方保证金。保证金不计算利息。

(二)甲方同意乙方为保证履行本协议约定的义务,确定丙方为乙方的保证人,丙方同意认真协助甲方督促乙方履行协议。

(三)丙方同意承担连带保证责任,担保期间为本协议有效期间期满五年内,担保范围包括乙方在本协议项下应向甲方支付的违约金、赔偿金、甲方为实现债权的费用(包括但不限于诉讼费、仲裁费、律师费、差旅费等)等全部费用。

(四)在本协议规定的担保期间届满前,如丙方因故需要变更,应提前两个月通知甲方,经甲方同意后按甲方规定的程序办理变更手续。

第八条违约责任

(一)乙方有下列情形之一的,甲方有权解除本协议并停发资助费用、不予提供回程机票、保证金不予退还;乙方应返还甲方全部资助费用并向甲方支付全部资助费用的30%的违约金,丙方承担连带责任。

1、未经甲方同意,擅自提前返回内地、擅自变更培训地点及院校、改变国籍的;

2、从事与培训计划无关的活动严重影响学习、表现极为恶劣的;

3、擅自放弃培训任务的;因自身原因无法完成培训任务的;

4、未按规定期限返回内地逾期三个月以上。

(二)乙方未经甲方同意,有下列情形之一的,应承担违约责任,丙方承担连带责任。

1、对因航班延误和意外事故等特殊情况确实不能在规定的日期内返

回内地,逾期未超过一个月者,甲方不追究其违约责任。

2、如未经甲方同意逾期一个月以上(不含)、三个月以内返回内地,

应向甲方支付全部资助费用的20%的违约金,保证金不予退还。

(三)在任务结束返回内地后的五年内拒绝为甲方提供赴国外进行汉语教学服务或提供服务不符合甲方要求的、不服务从甲方派遣安排的,乙方应全部返还甲方支付的资助费并赔偿甲方所受全部损失。

(四)本条规定的违约赔偿款项,甲方有权直接从乙方保证金中扣除,不足部分由乙方补足,乙方须另行缴纳保证金。

第九条甲乙丙三方因履行本协议而发生的纠纷,应当协商解决,协商不成时,任一方可向甲方住所地人民法院提起诉讼。

第十条本协议的履行及解释适用中华人民共和国法律。

第十一条本协议书自协议各方签字盖章之日起生效。

第十二条本协议书一式四份,协议各方各执一份,具有同等法律效力。
