1.1.1 工程项目承发包的概念和内容

1）工程项目承发包的概念

工程项目承发包是一种商业行为，是商品经济发展到一定阶段的产物；是指交易的一方负责为交易的另一方完成某项工作或供应一批货物，并按一定的价格取得相应报酬或价款的一种交易行为。在园林工程项目建设市场中，作为供应者的园林企业对作为需求者的建设单位作出承诺，负责按对方的要求完成某一园林项目工程的全部或其中一部分工作，并按商定的价格取得相应的报酬。在交易过程中，承发包双方之间存在着经济上、法律上的权利、义务与责任的各项关系，依法通过合同予以明确，双方都必须认真按合同规定办事。

承发包方式可分为指定承发包、协议承发包和招标承发包。

指定承发包是指建设单位指定某施工企业完成某项施工任务的一种承包方式。

协议承发包是指建设单位与某施工企业就工程内容及价格进行协商，签订承包合同。

招标承发包是指由三家以上施工企业进行市场竞争，建设单位择优选定施工企业，并与其签订承包合

2）工程项目承发包的内容

工程项目的整个建设过程可以分为：项目建议书、可行性研究、项目设计、材料及设备采购、工程施工和竣工验收等阶段。就总体而言，工程承包的内容就是整个建设过程各个阶段的全部工作。对一个承包单位来说，承包内容可以是建设项目全过程承包；也可以是某一阶段承包。

（1）项目建议书

项目法人按国民经济和社会发展长远规划、行业规划和建设单位所在地区域规划的要求，根据本单位的发展需要，经过调查、预测、分析，编报项目建议书。

项目建议书是向相关部门提出建设某一项目的建议性文件，是对项目投资进行初步估计是对拟建项目的初步设想。它不仅是选择项目的依据，也是可行性研究的依据。

项目建议书根据拟建项目规模报送有关部门审批。重大项目由国家发展与改革委员会报国务院审批；大中型及限额以上项目的项目建议书应先报行业归口主管部门，同时抄送国家发展与改革委员会，还要委托具有相应资质的工程咨询单

位评估后审批；小型和限额以下项目的项目建议书，按项目隶属关系由部门或地方发展与改革委员会审批。

a.建设项目的必要性和依据；
