我国社交网络个人隐私保护研究

摘要

互联网的出现使老子“不出户知天下”的朴素理想、麦克卢汉的“地球村”成为现实，“数字化生存”已成为了当今时代的显著特点。但是随着发展互联网为人类带来益处的同时，它的缺陷、弊病同样也逐渐显现，如电脑病毒、网络犯罪、网络暴力等。近年来网络信息泄露也成为互联网发展中的一道障碍，尤其是社交网络出现后个人信息泄露的状况愈演愈烈。

本文旨在研究社交网络的个人隐私保护，主要从个人、社交网络服务商、政府三个主体，梳理目前社交网络中隐私保护的现状。本文通过问卷调查法，调查我国个人对于社交网络中隐私保护的现状，以了解社交网络用户群体的对于网络中个人隐私保护的认知及保护行为。同时使用内容分析、对比研究等方法，对于社交网络服务提供商对用户隐私保护的行为和公共政策层面相关规定进行研究。

通过研究发现，目前社交网络应用已成为我国人民生活中的重要部分，但是我国网民对于社交网络个人隐私保护认识不足、观念落后，对个人隐私保护中自我控制的意识薄弱，在社交网络收集个人信息时以被动、默认态度为主，自发的个人隐私保护行为比较少。社交网络服务提供商对于用户的个人隐私保护意识淡薄。社交网络服务提供商的用户隐私保护体系不规范，保护措施不完善。信息的收集、使用、分享情况不透明，规避责任倾向明显。公共政策方面，网络相关法律尚少，法律体系不完善；法律法规的更新缓慢，制定滞后；管理方面多依靠法规和指导文件进行；管理机构多倚靠政府力量，但也有存在着机构冗余，职责不明确的情况；行业监管没有发挥作用。因此本文认为，对于社交网络个人隐私保护必须从三个层面、“三管齐下”方能起作用。

Abstract

The emergence of the Internet made Laozi's simple ideals of“going home to know the world”and McLuhan’s“global village”to become a reality.“Digital survival”has become a prominent feature of the current era.However,as the development of the Internet brings benefits to mankind,its defects and disadvantages also gradually emerge, such as computer viruses,cybercrime,and cyber violence.In recent years,the leakage of network information has also become an obstacle in the development of the Internet.In particular,the leakage of personal information after the emergence of social networks has intensified.

This article aims to study the privacy protection of social networks,mainly from the three entities of individuals,social network service providers,and government,to sort out the current status of privacy protection in social networks.In this paper,the questionnaire survey method is used to investigate the status quo of personal privacy protection in Chinese social networks,so as to understand the social network user groups'cognition and protection of personal privacy protection in the network.At the same time,methods such as content analysis and comparative research are used to study the behavior of social network service providers in terms of user privacy protection and related regulations at the public policy level.

Through research,it has been found that the application of social networking has become an important part of people's lives in China.However,the Internet users in China have insufficient understanding of the personal privacy protection of social networks and their concepts are backward.They have weak awareness of self-control in personal privacy protection and collect personal information on social networks.Passive,default attitudes are the main reasons,and spontaneous personal privacy protection is less.Social network service providers have little awareness of users'personal privacy protection.The user privacy protection system of social network service providers is not standardized,and protection measures are not perfect.The collection,use,and sharing of information are not transparent,and there is a clear tendency to avoid responsibility.In terms of public policy, there are still few cyber-related laws and the legal system is not perfect;laws and
