1、承包本项工程所有脚手架搭、拆:包括本工程内外脚手架,外墙双排架,电梯井道架,钢筋工(层高3m以上)操作架、混凝土工操作架,混凝土布料机架,室外电梯架以及本工程所有临边洞口防护架,钢筋加工棚架子及模板封堵粘贴条幅、木工加工棚架子及模板封堵粘贴条幅、材料架、电箱防护棚架子搭设及模板封堵粘贴条幅,施工现场临时设施安全及为满足施工安全要求采取的一切安全防护、防砸架、出、卸料平台的搭拆与升降,室外跑道、灯架、安全通道架的搭拆模板封堵及标语条幅粘贴,脚手架板铺设,架体加固的预埋件,楼内层高3米以上钢筋临时架搭拆,除木工顶板架子外,所有涉及到使用钢管、扣件的全部内容,以及按规范要求挂安全网、密目网、外水平挑网、宣传用条幅等。

2、负责承包范围内的材料计划,提前5天申报甲方,用量必须准确,做到材料节约。

超出用量自行承担材料费用。

3、负责钢管的刷漆,材料进出场配合卸车及装车,竣工后所用材料的拆卸、归类码放及扣件的归还入库。

4、承担安全带、安全帽和施工范围中所用的手头工具等。

第二条、承包价格包含费用:

1、承包范围内的架子承包单价为图纸总说明标注建筑面积元/㎡,(其中外架搭设元/㎡,外架拆除元/㎡,包含闷顶层以上超高部分)。

2、第1条包干费用还包含以下内容及费用:
2.1乙方施工人员的完成承包范围内工作所需额外付出的材料二次搬运、冬雨季施工增加的人工费,还包含工作范围内容及完成合同承包范围内工作所需的辅助用工。

2.2 乙方人员在现场组织施工过程中所发生的工作人员工资、清理费用。

2.3 乙方配合其它分包单位的施工及乙方施工过程中不可避免的工程技术间歇、窝工、工人住宿上下班来回路途用工。

2.4 本合同价还包含了保证施工现场达到甲方的要求,而需由乙方支出的现场文明和环境保护所需的人工费用及施工过程中所有可能会涉及到的费用的总和,维护、政策性文件规定、风险、责任等所有费用及不可预见的因素发生的费用。

第三条、甲方的义务与职责:
甲方负责对乙方承建工程的质量、安全、进度、文明施工等进行全面监督和指导。

如发现乙方无履行工程合同的能力或严重损害了甲方的利益、信誉,甲方有权单方面终止工程施工劳务合同。

另外组织施工队伍接替施工,同时保留追究乙方发经济责任的权力。

1、甲方负责乙方进场的住宿、食堂。

乙方职工必须在甲方食堂内用餐,否则不安排住宿。

2、负责对乙方在施工过程中除自备工具以外的施工工具及中小型机械。

3、负责对乙方施工进行技术、质量、安全、场容、进度的交底。

乙方根据甲方的交底及方案要求进行
施工。

4、做好图纸审核,以及工程竣工的结算。

5、协助乙方抓好施工中的安全、工程质量及工程进度等。

6、协助乙方处理好工伤事故,根据事故发生情况双方分清责任。

第四条、乙方的义务与职责:
1、乙方对本工程项目不得再进行分包,否则甲方有权单方终止合同,并由乙方承担全部违约责任和所
发生工程量20%违约金。

2、乙方进入现场的职工必须以实名制行式7日内与甲方签订职工劳动合同,每人递交身份证复印件及
3张一寸照片。

3、乙方必须按照甲方所制定的作业计划进度施工,合理安排劳动力,工程进度必须达到甲方所计划的
目标,施工人数应满足每日的施工任务,达到甲方所计划的目标,甲方的施工计划一旦下达,乙方必须保证按期完成,乙方应立即组织人员赶工,赶工措施费用有乙方负责。

乙方施工人员必须按照甲方的进度合理安排组织人员,如乙方原因未达到甲方规定的进度要求,甲方将给予延期一定的经济处罚,并采取其它的抢工补救措施。

如乙方施工造成甲方严重质量及进度信誉影响的,又不立即采取措施或措施不力,甲方有权劝其退场,此责任有乙方承担,甲方并有权对其重罚。

4、对甲方的有关安全、文明施工、后勤卫生、环保、消防的各项管理制度严格执行,由乙方造成的责
任及损失由乙方承担。

5、乙方必须在施工中满足工程的一切进度与质量要求,由此造成的责任与损失有乙方负担承包单价的
部分。

6、乙方在承包项目施工中必须严格要求完成好所施工的项目,必须达到甲方要求的结构验收标准,如
由此达不到而造成的损失有乙方负担。

7、乙方自进场施工后必须有始有终,如中途擅自离场,甲方有权扣除乙方工程款项的部分或全部。

8、违章指挥、违章作业、野蛮施工造成的伤亡事故或质量事故。

由此造成的后果有乙方承担。

9、乙方进场职工必须对本合同及承包人的认可,甲方不针对乙方职工付工程款。

10、乙方必须确保足额发放工人工资,如出现拖欠工人工资和工人讨薪、聚众闹事事件,一切后果由乙
方承担,并处以2000—5000元/次的罚款,情节严重者送司法机关处理。

第五条、安全、质量:
1、乙方必须遵守现场甲方的安全生产管理制度,对工人的安全生产负一切责任。

2、乙方进场施工的所有职工进场后必须签订每个人安全协议书。

做到安全责任落实到实处,人人有责。

3、乙方投入到本工程中的全部各类生产工具必须合格,并符合国家、地方政府及甲方的有关规定和安全使用标准。

若因乙方违反操作规程和(或)使用不符合安全标准的各类生产工具造成的一切安全事故均由乙方自行负责。

4、乙方必须服从甲方的统一的安全生产管理工作,认真遵守有总包方及甲方关于安全文明施工方面的各种规章制度、规程及操作要求,乙方自身加强定期负责对自身施工人员(包括生活区的人员)进行安全交底教育,作好施工安全交底及安全监督,严禁偷盗、打架、骗取、哄抢、殴打他人、结伙斗殴、寻畔闹事等行为,如发现有偷盗打架等行为,甲方将给予乙方一定的处罚,视情节轻重必要时送公安机关处理。

乙方在施工中如一旦发生伤亡事故先应立即组织抢救,并及时上报甲方有关负责人。

由于乙方管理不力、工人违章操作或违章指挥等造成的安全罚款或伤亡事故的(包括意外性伤亡事故如打架斗殴、病故、交通意外等),其责任和一切费用均由乙方自行承担,甲方并追究乙方的责任。

6、安全事故处理:在施工期间,甲方对整个项目投团体保险,一但发生安全事故,甲、乙双方应采取有效控制措施,先医疗伤者;医疗费用约定如下(费用以医院正式发票为依据,不含保健药品和非处方用药):两万元(含)以内费用乙方自行承担;两万元(含)以上,甲方协助乙方办理保险赔付,赔付外的款项甲、乙双方各承担一半。

伤者治疗期间的误工费及其它一切支出由乙方承担。

重大伤亡事故甲乙双方根据相关政策和相关责任划分协商解决。

.7、工程质量应达到图纸设计要求及质量验收标准。

乙方应严格执行“三检制”,验收合格后方可进行下道工序。

如验收不合格,除承担开发商、监理罚款外,甲方对乙方还处以最高500元/次罚款,并在限期内整改完毕。

第六条、材料供应:
1、乙方领用材料、机械设备等必须履行书面领、还手续;如发生丢失、损坏和浪费材料,乙方按原价赔偿。

2、乙方使用的材料、机具根据甲方要求码放。

做到活完料尽脚下清,如有不清理现场现象,处以200元/次罚款,从乙方当月借支中扣除。

3、如未经甲方现场负责人的同意,任意切割钢管、木材、随意损坏周转材料,处以500元/次罚款并赔偿材料。

第七条、结算方式:
1、甲方按实际出勤工日30元/人/日支付工人生活费,每月出勤工日满足25天以上按1000元/月/人支付。

乙方人员在施工阶段的伙食费由甲方垫付,从劳务费中扣除。

主体结构封顶验收合格后30 天内支付合同款的85%,剩余15%在整体竣工后/ 天内或年终一次性付清。

2、劳务费发放:乙方在用工时,必须申报用工人员名单,甲方和乙方共同与工人签订用工合同,此用工合同作为甲方支付乙方劳务费的依据。

乙方必须上报乙方工人工资表,每月发放生活费需工人本人签字。

为项目部做零工150元/工。

第八条、合同的生效与终止:
本协议一式两份,甲乙方双各执一份,合同经双方签字盖章后生效,工程完工结算并付清工程款后合同自动失效。

第九条、补充条款:
1、本工程施工面积较小,施工过程中有停歇、窝工等现象,班组在施工过程中自行调配增减人员,停歇、窝工等所产生的一切费用均包含在综合单价中。

2、严格执行工序交接时间,轮到加班或夜班施工的班组,如不执行每次罚款500元并承担影响
后续班组的误工人工费用。

3、在施工过程中严格遵守合同附件中的各项条款。

4、在施工过程中乙方严重或屡次违反项目部管理制度,甲方将对乙方处以最高500元/次的罚款。

5、在施工过程中要积极配合项目部人员的检查验收,如在此过程中出现辱骂项目管理人员的,将对班组处以1000-2000元的罚款,并对工人清除出场。

6、宿舍用电管理要严格按照宿舍管理制度执行,对超出规定用电量的宿舍将以电价的2倍收取费用。
