• International sales contract is drafted to accommodate traders who deal directly with each other. The bargaining sessions cover such items as prices as affected by market forces, risk factors, and terms relating to security of payment. The final agreements represent the private law of a private transaction. In contrast to the usual domestic transaction, performance of international agreement involves greater distances and longer periods of time before the goods are delivered and payment is required. And, as we have seen, international transactions carry the following unique risks: more than one currency, system of governmental regulation, legal system, language, and a set of cultural expectations.
• As far as the contents are concerned, contracts in international trade may fall into a great variety of categories, such as shipping contract, purchasing contract, agency contract, contract for export of labor force, compensation trade contract, etc. In this unit, we will mainly discuss the sales contract.
• 2). A Basis for Implementation of Contract The contract in written form ensures the smooth
implementation of the contract. Inconvenience may otherwise arise. So it is very important to stipulate in the contract the rights and obligations of both sides.
