合同订立原则
平等原则：
根据《中华人民共和国合同法》第三条：“合同当事人的法律地位平等，一方不得将自己的意志强加给另一方”的规定，平等原则是指地位平等的合同当事人，在充分协商达成一致意思表示的前提下订立合同的原则。

任何一方都不得凌驾于另一方之上，不得把自己的意志强加给另一方，更不得以强迫命令、胁迫等手段签订合同。
自愿原则：

二、甲方负责组织与行政管理，乙方负责教学和业务管理, 并为教学质量负主要责任。
三、乙方为甲方举办的学力教育培训班，每期名学生，每
个教学班人数为人，培训期限为年，培训班的英语教学时数不得少于节。
四、乙方承诺：经过大约学时的培训，能使甲方参加培训
的大部分学员在英语听力和口语等方面的能力有明显提高，能够满足全英语教学需要，能够胜任教育国际交流翻译任务。
对于学员反映强烈、课堂教学效果差的教师，经甲方提出，乙方应当予以及时更换。
五、甲乙双方都同意将教学点设在区教师进修学校，寒暑假期间将教学点设在外语外贸大学校本部。
六、甲方同意乙方为甲方学员开设的课程及课时分配计划：听力节、口语节、英语电影视听节、英语新闻视听节（小学节）、语音节、交际
乙方代表： 英语 节、教学法 节、高考英语复试辅导 节（小学教师不参加）。
七、乙方负责组织好平时的测验、中段考、结业考及水平测 试（共三次），对三次水平测试合格者颁发学力证明书（结业证 书），并负责建立接受培训英语教师的学力档案；甲方负责建立全区 英语教师的继续教育档案，并负责把教师培训成绩纳入业务档案管 理。
八、经过甲乙双方协商的培训时间，乙方原则上不得随意改 变，如有变更应当至少提前一星期通知甲方。
九、培训费用按照每人每节课 元计算（包含教材费和散页 讲义费），每月结算一次，由甲方以支票方式支付给乙方；乙方除收 取培训费用外，不再收取其它任何费用。
十、学员培训过程中的交通费、住宿费等由甲方自行解决或 由学员自理。
十一、双方共同努力，积极探索学历教育的可行性，条件成 熟的时候乙方为甲方举办的专科升本科的学历教育班；
十二、操作事宜由 区教师进修学校与出国人员培训部协商 解决。
