ISPS《国际船舶和港口设施保安规则》概述
1、目标和功能要求(1)
• 目标
– 建立一个缔约国政府/政府部门/地方行政机关/航运 业/港口业的保安国际合作框架 – 确立各方在国内和国际层面上在保证海上保安方面 的作用和责任 – 确保及早和有效收集并交流保安信息 – 提供一套用于保安评估的方法，确定对保安等级发 生变化作出反应的计划和程序 – 树立对具备海上保安措施的信心

本经营（管理）人承诺：我们已经按照《港口设施保安规则》要求完成了履约的相关工作。我们对《港口设施保安计划》内容的真实性、准确性负责，并按照批准后的《港口设施保安计划》落实了相关措施，能够在三个保安等级状态下进行保安操作。
鉴于本港口设施符合经修订的《1974年国际海上人命安全公约》第Ⅺ-2章以及《国际船舶和港口设施保安规则》A部分的规定，特此申请颁发《港口设施保安符合证书》，并愿意接受各级交通（港口）管理机关的相应检查。

港口设施保安协议(01)
港口保安协议一、甲方作为取得《港口设施保安符合证书》的港口设施经营人,严格按照《港口设施保安规则》规定履行相关职责。
二、乙方作为为甲方提供服务的港口经营单位，承诺为甲方港口设施保安事项上提供合作并承担相应的责任。
三、经甲乙双方商定，乙方在通过本市已取得交通部《港口设施保安符合证书》的港口设施为船舶提供经营性服务期间，必须信守以下条款：1、在所从事的港口经营服务项目范围内，严格遵守交通部《港口设施保安规则》的规定。
2、配合甲方和港口行政主管部门实施《港口设施保安计划》，并承担与保安计划相关的责任和义务。
3、承诺不以任何方式方法为来往船舶或通过来往船舶为第三方提供《港口设施保安规则》第二十一条所明确的可能直接或间接制造恐怖事件的各种禁运物料。
4、在为甲方或船舶提供经营或便利服务期间，应采取必要的预防和管制措施，确保可能发生保安事件的人员、物资的通道和场所的安全，防止在物料配送或代理、代供期间发生可能的保安事件。
5、保持与港口行政管理部门的接触和配合，服从港口设施保安工作发展需要。
四、乙方为甲方或船舶提供经营性服务活动必须严格遵守《中华人民共和国安全生产法》、《中华人民共和国港口法》、《港口经营管理规定》、《港口危险货物管理规定》、《港口设施保安规则》等法律法规和规章，甲方配合港口行政管理部门对乙方经营活动进行监督。
五、若因乙方原因而引发港口设施保安事件，乙方承担全部责任，甲方在向港口行政管理部门及时汇报后，由港口行政管理部门依照《中华人民共和国安全生产法》、《中华人民共和国港口法》、《中华人民共和国行政处罚法》等相关法律法规对乙方实施相关处罚。
六、本协议自签订之日起生效，有效期为一年，港口行政主管部门作为见证人参与此协议的签订。
本协议一式三份，甲乙双方和港口行政主管部门各执一份。

港口设施保安协议
港口设施保安协议XXXXXXXXXXXXXXXXX（以下简称甲方）XXXXXXXXXXXXXXXXX（以下简称乙方）为共同维护港口设施的安全运行，根据《港口设施保安规则》，现由甲方与乙方签订港口设施保安协议如下：一、甲、乙双方都为取得交通部《港口设施保安符合证书》的港口设施经营人，且双方在地里位置上相邻，都应严格按照《港口设施保安规则》规定履行相关职责。
二、甲、乙方作为经港口管理部门核准的港口经营单位，在开展正常的生产经营活动时遵守以下条款：1、甲、乙双方在鉴定、选择和优化保安措施时应当考虑甲方接受其保安措施的可能性。
2、甲、乙双方码头人员和船舶不准发生威胁对方船舶、港口设施、船港界面和船到船活动安全的任何可疑行为。
3、甲、乙双方都应积极消除可能导致保安事件的薄弱环节，以免发生保安事件后，影响到对方的港口设施安全。
4、甲方或乙方在得到对方求援、协助信息后，有相互协作、紧急联动处置的义务和责任。
5、如一方发生的保安事件可能影响到对方的港口设施时，该方应及时通知对方，使其做好相应得准备。
6、一方在发现对方区域内正在发生保安事件时，应当及时通知对方港口设施保安主管。
7、甲、乙双方港口设施保安主管要进行经常性的沟通，加强各保安等级工作的正常开展。
三、本协议未尽事宜，甲、乙双方协商解决，协商不成，应提交天津仲裁委员会仲裁。
四、甲、乙双方应严格履行合同，若因违反协议约定造成另一方损失的应承担赔偿责任。
五、本协议一式六份，甲乙双方各三份。
自双方签字盖章后生效，有效期为5年。
以上协议，经双方签字（盖章）后生效，甲、乙见证方各执一份。
