摘要

建筑工程施工合同是建筑工程的重要合同。合同的管理也是建筑工程项目管理中的一项重要内容．但目前合同的管理却是建筑工程项目中的一个薄弱环节。虽然《中华人民共和国合同法》和《建设工程施工合同菅理法》已出台,但是在合同签订过程中，工程建设的参与双方缺乏市场经济所必须的法制观念和诚信意识，不正当竞争行为时有发生。承包方和发包方双方合同自律行为较差，加之市场机制又难以发挥应有的作用，从而导致了建筑市场经

济秩序的混乱，因此必须对建筑工程施工合同管理加以规范，促进建筑市场的健康有序的发展。

解析建筑工程施工合同管理中索赔.本文主要阐述了建筑工程索赔是建筑工程管理和建筑经济活动中承发包双方之间经常发生的管理业务。在我国工程施工承包合同履行过程中，普遍存在承包人要求的施工索赔，发包人和监理工程师进行反索赔的现象。施工索赔和反索赔是业主和承包商在工程项目施工过程中正常的业务往来，它的健康开展，对于培养和发展建设市场，促进建筑业的发展，起着非常重要的作用。

Abstract

Construction project contract is building engineering an important contract. T he contract of construction project management is an important content in the adm inistration. But the contract of construction project management is one of the weak link. Although the contract law of the People's Republic and the construction proj ect contract the jian Richard law has already issued, but in the process of contract, the construction of the lack of market economy must participate in both sides of th e concept of legal system and the credit consciousness, unfair competition occur fr equently.
