天津市地震局关于印发《天津市地震应急预案管理办法》的通知正文:----------------------------------------------------------------------------------------------------------------------------------------------------天津市地震局关于印发《天津市地震应急预案管理办法》的通知津震领发〔2018〕1号各区人民政府,各委、局,各有关单位:为健全完善地震应急预案体系,强化地震应急预案管理,保障地震应急工作顺利开展,依据有关法律法规,结合本市地震应急预案建设和应急处置工作实际情况,特制定了《天津市地震应急预案管理办法》,并经市领导同意。
现予以印发,请遵照执行。
2018年7月16日天津市地震应急预案管理办法第一章总则第一条为加强和规范本市地震应急预案管理,建立健全地震应急预案体系,保障地震应急工作顺利开展,根据《中华人民共和国突发事件应对法》《中华人民共和国防震减灾法》《天津市防震减灾条例》《突发事件应急预案管理办法》(国办发〔2013〕101号)《天津市突发事件应急预案管理办法》(津政办发〔2014〕54号)和《天津市地震应急预案》(津政办发〔2014〕22号),结合本市实际,制定本办法。
第二条本办法所称地震应急预案是指各级人民政府及其有关部门、基层组织、企事业单位,社会团体等在预防为主,防抗救相结合的防震减灾工作方针指导下,为依法、迅速、科学、有序应对地震突发事件,最大程度减少人民生命财产损失而预先制定的工作方案。
第三条地震应急预案的编制、审批、发布、备案、宣传、培训、演练、修订等工作,适用本办法。
第四条本市地震应急预案建设和管理遵循“统一领导,分类制定、分级负责、动态管理”的原则。
第二章地震应急预案分类第五条本市地震应急预案按照制定主体划分,主要包括政府地震应急预案、地震应急专项保障预案(计划)、部门地震应急预案、基层组织地震应急预案、单位地震应急预案和重大活动地震应急预案6类。

近几年来,我市地震监测预报、震灾预防、紧急救援三大工作体系建设取得重要进展,防震减灾能力总体上得到逐步提高,对预防和减轻地震灾害起到了有力保障作用。
据预测,未来一个时期我国地震形势仍然十分复杂、严峻,人民群众生命财产安全和经济社会发展依然面临着地震灾害的潜在威胁。
目前,我市防震减灾工作与面临的地震形势和经济社会发展需要之间仍存在一定差距。
主要表现在:地震监测预报工作体系还存在薄弱环节,城乡之间的震灾预防能力还不平衡,区县地震工作机构尚不健全,与经济社会发展水平和防震减灾需求相适应的投入机制尚不完善,这些问题都亟待解决,必须引起高度重视。
我市当前和今后一个时期防震减灾工作的指导思想是:以“三个代表”重要思想为指导,认真贯彻落实科学发展观,把人民生命安全放在首位。
坚持防震减灾同经济建设一起抓,实行预防为主、防御与救助相结合的方针。
切实加强地震监测预报、震灾预防、紧急救援三大工作体系建设,进一步完善地震灾害管理机制。
依靠科技、法制和全社会力量,不断提高全社会的综合防震减灾能力,为人民群众的生命财产安全和全面建设小康社会的伟大事业提供可靠的保障。
我市防震减灾工作的奋斗目标是:到2020年,力争对发生在本市及邻区的中等强度以上地震作出有减灾实效的短临预测,一般工民建达到抗御本地区基本烈度的能力,生命线工程、大型公共设施和重要建筑达到国家规定的抗震设防要求,地震预警和应急救援做到及时有效,使我市防震减灾综合能力率先达到中等发达国家水平。

天津市地震局
一、将第八条第一项修改为:“公路及铁路上长度大于五百米的多孔桥梁或者跨度大于一百米的单孔桥梁”。
修订说明:原文中“干线”的提法没有统一标准,容易在实践中产生歧义。
二、将第八条第五项修改为:“八十米以上的高层建筑物、构筑物”。
修订说明:原文中“高层建筑”的内涵不确定,在实践中容易产生歧义。
三、将第九条修改为:“地震安全性评价工作,建设单位必须在项目可行性研究阶段,委托本市或者外地具有建设工程地震安全性评价资质的单位进行。
”
修订说明:根据国务院《地震安全性评价管理条例》(国务院令第323号)的规定,地震安全性评价应在项目可行性研究阶段进行。
四、增加一条作为第十条:“第十条市地震工作主管部门是本市地震安全性评价和抗震设防要求的主管部门,区县地震工作主管部门负责本行政区域内的地震安全性评价和抗震设防要求的监督管理工作。
市地震安全性评定委员会负责地震安全性评价报告的评审和地震安全性评价工作的技术咨询。
市地震工作主管部门按照国家有关规定对从事地震安全性评价的单位和专业技术人员,进行资质和执业资格管理。
”
修订说明:原《天津市防震减灾条例》对地震安全性评价和抗震设防要求许可事项的实施主体规定不明确。
根据国务院《地震安全性评价管理条例》的有关规定和《行政许可法》的要求,应做出明确规定。
将《天津市建设工程地震安全性评价管理办法》
(市政府令第6号)中的有关规定移植到本《条例》中。

各单位要围绕防灾减灾日主题,加大防震减灾宣传力度,创新宣传模式、把握宣传重点、拓宽宣传渠道、增强宣传时效,广泛利用各类媒体开展防震减灾宣传活动,紧盯重点领域组织防震减灾科普宣传“六进”,面向重点人群精准开展科普宣传,切实增强公众地震灾害风险防范意识和素养。
要深化自然灾害风险普查成果应用,推动风险治理向事前预防转变。
要加强地震灾害应对准备,提高地震灾害处置保障能力和水平。

2011)Article 1 in order to prevent and mitigate earthquake disasters, protecting people's lives and property safety, and promote the sustainable development of economy and society, according to the "People's Republic of China earthquake disaster prevention law" and relevant laws and regulations, combined with the actual situation of the city, the enactment of this ordinance.Article second this Municipality shall apply to the activities of earthquake prevention and disaster reduction within the administrative area of this municipality.The third municipal, district and County People's governments shall strengthen the leadership of earthquake prevention and disaster reduction in their administrative areas, and improve the work system of earthquake prevention and disaster reduction in accordance with the policy of combining prevention with rescue.The people's Government of the city and district and county shall work of earthquake prevention and disaster reduction into the The competent administrative department for earthquake work of the municipality shall regularly check the operation of the strong vibration monitoring facilities and give technical guidance and services.The construction, operation and management of eleventh seismic monitoring networks and strong vibration monitoring facilities shall comply with the relevant laws, regulations and relevant standards.In the process of detecting, transmitting, analyzing, processing, storing and submitting seismic monitoring information, the units concerned shall ensure the quality and safety of the seismic monitoring information.The competent administrative departments of seismic work in the twelfth cities shall establish and perfect a platform for information sharing of earthquake monitoring and provide services to society.The competent administrative departments for seismic work in the districts and counties, the special administrative units for earthquake monitoring networks and strong motion monitoring facilities shall submit the earthquake monitoring information to the competent department of Municipal Seismological Work in a timely manner, and implement information sharing.Thirteenth city administrative departments should strengthen the work of earthquake monitoring area earthquake prediction, earthquake observation technology research area, the area of earthquake monitoring planning and construction scheme, improve the ability to predict earthquake activity monitoring.After the occurrence of an earthquake in the sea area, the competent administrative department for earthquake work of the municipality shall timely notify the maritime administrative department and the maritime administration organ.Article fourteenth no unit or individual may seize, destroy,dismantle or move seismic monitoring facilities without permission, and shall not endanger the environment for earthquake observation.The competent department for seismic work and city districts and counties shall, in conjunction with the public security planning, Guotufangguan departments, set up protection signs in the vicinity of the earthquake monitoring facilities, indicating the earthquake monitoring facilities and the seismic observation environment protection requirements.Fifteenth new construction, expansion or reconstruction projects shall avoid causing damage to the facilities for earthquake monitoring and the environment for earthquake observation.Construction of state key projects,Do not avoid the impact of the earthquake monitoring facilities and the seismic observation environment, the construction unit shall, in accordance with the earthquake the city and district and county administrative department requires additional anti-jamming facilities; An earthquake safety evaluation unit shall undertake the assessment of seismic safety within the scope of its qualification approval, and be responsible for the quality evaluation of the seismic safety of the construction project.The competent administrative departments for seismic work shall strengthen the qualification management of the units and their employees in accordance with the law.The competent administrative department for seismic work of the twenty-third municipal authorities shall be responsible for approving the earthquake safety assessment report of the construction project according to law and determining the seismic fortification requirements.An earthquake safety assessment report approved by the competent department of seismological work under the State Council shall, in accordance with the law, be submitted to the competent administrative department for earthquake work at the same time.Twenty-fourth without the need for seismic safety evaluation of construction projects shall be in accordance with theseismic zoning map or seismic Microzonation map to determine the requirements of seismic fortification; construction of schools, hospitals and other crowded places, the local housing construction should be based on the requirements of seismic fortification on at least a seismic improvement.The seismic fortification requirements of the twenty-fifth construction projects shall be included in the basic construction procedures.City and district, county development and reform, planning, construction and transportation, water project examination and approval department, shall be the anti-seismic requirements as a prerequisite for the project review; on no seismic fortification requirements or seismic fortification requirements do not comply with the relevant provisions, shall not be approved.The twenty-sixth construction project has been completed, did not take the aseismatic fortification measures or seismic fortification measures fail to meet the requirements of seismic fortification, should carry out seismic performance appraisal in accordance with relevant state regulations, and take the necessary measures of reinforcement.City Guotufangguan departments shall, jointly with the municipal construction and transportation department, the administrative department for seismic work and other relevant departments of the administrative districts of the city have been built without taking the aseismic measures of building inspection.The people's Government of the twenty-seventh city and district and county should strengthen the management and guidance of rural infrastructure, public facilities and farmers from the building seismic fortification, to promote the development of rural residential earthquake safety project support policies to guide the farmers to take scientific measures in seismic building, organize relevant departments to formulate rural residential earthquake safety project planning and construction rural residential building seismic fortification standards, strengthen rural construction craftsmen training, improve the ability of seismic fortification of rural building.Construction of infrastructure and public facilities in towns and villages shall be planned, designed and constructed in accordance with the requirements for seismic fortification and seismic design.The people's Government of the twenty-eighth city and district and county shall formulate emergency shelter construction planning; traffic organization planning, construction, city gardens, earthquake and other departments, according to the emergency shelter planning of the city, the city square, greenbelt, parks and other open areas or other places selectors with national standard, set up emergency evacuation routes and construction earthquake emergency shelters, and improve traffic, water supply, power supply, sewage and other supporting infrastructure.The location of an earthquake emergency shelter shall be announced to the public. A clear indication sign shall beprovided for the place of refuge and its surroundings.Not included in the planning of emergency shelters, but with the ability to withstand earthquake risks, schools, playgrounds and public stadiums (pavilions) can be used as temporary earthquake emergency shelters.The management units of twenty-ninth earthquake emergency shelters shall, in accordance with the relevant regulations of the state, maintain and manage the places, facilities and materials so as to keep the emergency evacuation passages unblocked.The competent departments of seismological work in cities, districts and counties shall, in conjunction with relevant departments, give technical guidance and regular inspections on the construction, maintenance and management of earthquake emergency shelters.The people's Government of the thirtieth city and district and county and the relevant departments shall be equipped with emergency equipment and supplies necessary, establish and perfect the supervision, material storage, allocation, distribution system and emergency reserve database, and formulate the corresponding security system and emergency call scheme.The thirty-first municipal, district and County People's governments and their relevant departments shall strengthen the construction of the earthquake emergency communication system, improve the emergency communication guaranteemechanism, and ensure the smooth communication of earthquake emergency work.The people's Government of the thirty-second city and district and county shall strengthen the construction of earthquake emergency command center, emergency command platform, improve the technology of acquiring seismic disaster information system, earthquake emergency basic data system, establish the update mechanism of earthquake emergency basic data, provide support for the earthquake relief command decision.The people's Government of the thirty-third city and district and county shall strengthen the construction of seismic safety demonstration school and community, earthquake disaster mitigation science education base, improve citizen awareness and ability of self-help and mutual aid.Social organizations such as education, science and technology, earthquakes and other social organizations should give technical guidance and support to schools and communities in the activities of earthquake prevention and disaster reduction, science popularization activities, and group testing and prevention activities.The seismic monitoring facilities management unit may open an opening day for public surveillance without affecting seismic monitoring.The school should carry out knowledge of earthquake disaster reduction and earthquake emergency education, at least once a year for earthquake emergency evacuation drills, thecultivation of students' safety awareness and self-help and mutual aid capabilities.Thirty-fourth departments of municipal, district and county seismological work shall, in conjunction with relevant departments, formulate plans for earthquake emergency in their administrative areas, which shall be submitted to the people's governments at the corresponding levels for approval.The people's Government of the city and district, county departments and Township People's Government shall, according to the actual situation of earthquake emergency plan, the relevant laws and regulations and rules, the higher people's government and the relevant departments and the administrative region, formulate department and local earthquake emergency plan.The earthquake emergency plans of the relevant departments of the municipal, district and County People's governments shall be submitted to the competent department for earthquake work at the same level for the record. The earthquake emergency plans of the township and Town People's governments shall be submitted to the competent administrative department for earthquake work in their respective districts and counties for the record.The earthquake emergency plans shall be revised in good time in light of the actual circumstances. Revised earthquake emergency plans should be re filed.Article thirty-fifth the following enterprises andinstitutions shall formulate emergency plans for earthquake and report them to the competent department for earthquake work in their respective districts and counties for the record:(1) the management units of urban infrastructure such as communication, power supply, water supply, gas supply, drainage, etc.;(two) railways, airports, ports, rail transportation and other transportation management units;(three) hospitals, schools, kindergartens, sports venues, shopping malls, hotels and other crowded places management units;(four) or the facilities project of petroleum chemical industry, flammable, toxic, corrosive, radioactive, nuclear facilities, more than three pathogenic microorganisms laboratory may induce serious secondary disasters of the production and business units;(five) financial, radio and television, important integrated information storage centers and other units;(six) archives, museums and key cultural relics protection units at or above the city level;(seven) other units that may have serious consequences or effects due to an earthquake.Other units may draw up emergency plans for earthquakeaccording to their actual needs, and shall be guided by the competent departments of seismological work in the districts and counties where they are located.Thirty-sixth municipal and district and county earthquake relief and command institutions should organize earthquake emergency exercises in a timely manner.The departments and units that formulate earthquake emergency plans shall, at least once a year, organize earthquake emergency drills at their own departments and units.Thirty-seventh after the release of earthquake forecast opinions, the Municipal People's Government may declare that the forecast area in earthquake emergency period. Earthquake emergency period is generally ten days, if necessary, may be extended for ten days.In the earthquake emergency period, city or district, county people's Government shall, in accordance with the earthquake emergency plan, unified deployment and leadership of earthquake emergency work. 天津市地震局、天津市防震减灾规划(二000年十一月二日)21世纪初,是我市实施可持续发展战略,努力建设现代化港口城市和我国北方重要经济中心的关键时期。
但潜在的地震灾害是制约我市全面上水平的一个重要因素,因此,必须继续坚持经济建设同防震减灾一起抓的方针,建立健全地震监测预报、地震灾害预防和地震紧急救援三大工作体系,全面增强我市综合防震减灾能力,促进和保障经济社会快速可持续发展。
为明确21世纪初我市防震减灾工作的指导思想、原则和目标以及主要任务和措施,依据《中华人民共和国防震减灾法》和《天津市城市总体规划》,制定本规划。
一、防震减灾工作的指导思想、基本原则和奋斗目标(一)指导思想坚持经济建设同减灾工作一起抓,实行预防为主、防御与救助相结合,动员社会各方面力量,依靠法制和科技,大力加强地震监测预报特别是短期和临震预报工作,提高城市抗震和应急救助能力,有效减轻地震灾害损失,保护人员生命财产安全,维护社会稳定。
(二)基本原则坚持以监测预报为基础的综合防御,依法开展防震减灾工作;加强各级人民政府对防震减灾工作的组织与领导,广泛动员全社会的力量共同参与,依靠科技进步提高防震减灾能力;建立多元化投入机制,多渠道筹集防震减灾建设资金;坚持经济建设同减灾一起抓,将防震减灾工作纳入国民经济和社会发展计划,统筹规划,突出重点,量力而行,分步实施。

他介绍说,在起草过程中,关于是否进行地震安全性评价以及对哪些建设工程项目进行安全性评价的问题,市人民政府曾经进行了反复研究、协商和论证。
市人民政府法制办公室专门邀请京、津两地建设管理方面和地震方面的专家进行论证,参加论证的专家有中科院和工程院院士。
《防震减灾法》第十七条第三款规定:“重大建设工程和可能发生严重次生灾害的建设工程,必须进行地震安全性评价;并根据地震安全性评价的结果,确定抗震设防要求,进行抗震设防。
”据此,专家们认为,对重大建设工程进行地震安全性评价是完全必要的。
同时,结合天津的具体情况,专家们提出了应当进行地震安全性评价建设工程项目的范围,即草案修改稿第八条规定的有关内容。
根据专家论证的意见,形成专题报告,报请市政府常务会议审议。
根据市政府常务会议的要求,市政府法制办公室又召集市建委主任、市地震局局长当面进行了协调。
根据协调结果,经市长审查同意后,形成了报送市人大常委会审议的草案。
法制委员会与会委员一致认为,根据防震减灾法的要求和专家论证的意见以及反复协调的结果,草案规定对重大建设工程项目进行地震安全性评价是必要的,草案确定的应当进行地震安全性评价的重大建设工程项目范围,是基本可行的。

一、制定《条例(修订草案)》的必要性天津市位于河北平原地震带和张家口——渤海地震带交汇部位,区域内构造断裂数量多、类型复杂。
1996年以来,我市一直被国务院列为“首都圈地震重点监视防御区”范围。
近年来,随着我市经济社会的快速发展,城市人口分XXX基础设施建设更加密集,一旦遭遇破坏性地震,人员伤亡、经济损失、社会影响将十分严重。
为此,2001年7月我市出台了《天津市防震减灾条例》,并于2004年12月对该条例进行了修正,有力地推进和保障了我市防震减灾事业不断发展,对于防御与减轻地震灾害、保护人民生命和财产安全发挥了重要的作用。
2008年底,在总结汶川特大地震的经验教训的基础上,根据我国震情形势和依法加强防震减灾工作需要,国家对《中华人民共和国防震减灾法》(以下简称《防震减灾法》)进行了修订,对原有内容进行了完善,增加了地震灾后过渡性安置和监督管理等内容。
为了全面推进《防震减灾法》在我市的贯彻实施,进一步适应我市发展新形势下防震减灾工作面临的新要求,有必要对原《天津市防震减灾条例》进行较为全面的修订。
二、《条例(修订草案)》规定的主要内容此次修订主要对我市防震减灾现行制度进行了完善、对不适应新形势需要的制度予以修改、对当前防震减灾工作的成功做法加以制度化,并按照《防震减灾法》的修订情况,结合我市实际情况加以细化。
《条例(修订草案)》共43条,主要包括以下内容:(一)关于防震减灾领导体制、工作体制和投入机制。

天津市防震减灾条例(2011年5月20日天津市第十五届人民代表大会常务委员会第24次会议通过2011年5月20日天津市人民代表大会常务委员会公告第28号公布自2011年8月1日起施行)全文第一条为了防御和减轻地震灾害,保护人民生命和财产安全,促进经济社会的可持续发展,根据《中华人民共和国防震减灾法》和有关法律、法规,结合本市实际情况,制定本条例。
第二条在本市行政区域内从事防震减灾活动,适用本条例。
第三条市和区、县人民政府应当按照预防为主、防御与救助相结合的方针,加强对本行政区域内防震减灾工作的领导,健全防震减灾工作体系。
市和区、县人民政府应当将防震减灾工作纳入本级国民经济和社会发展规划,将防震减灾工作经费列入本级财政预算,并保障防震减灾工作的实际需要。
防震减灾工作经费应当用于地震监测预报、地震灾害预防、地震应急救援等工作。
第四条市和区、县地震工作主管部门和发展改革、建设交通、规划、国土房管、财政、民政、教育、卫生、公安、水务、海洋、科技以及其他有关部门,按照职责分工,各负其责,密切配合,共同做好防震减灾工作。
第五条市和区、县人民政府抗震救灾指挥机构负责统一领导、指挥和协调本行政区域的抗震救灾工作,其日常工作由本级地震工作主管部门负责。
第六条各级人民政府应当组织开展防震减灾知识的宣传教育,支持开展地震群测群防活动,增强公民的防震减灾意识,提高全社会的防震、避震、自救互救能力。
每年5月12日所在周,全市集中进行防震减灾宣传教育活动。
鼓励单位和个人配备地震应急物品,掌握自救互救方法,降低灾害造成的损失。
第七条市和区、县地震工作主管部门根据上一级防震减灾规划和本行政区域的实际情况,会同同级有关部门组织编制本行政区域的防震减灾规划,报本级人民政府批准后组织实施,并依法报上一级地震工作主管部门备案。
编制防震减灾规划应当与城乡规划、土地利用总体规划相协调。
市和区、县人民政府应当严格执行防震减灾规划,并逐步建立防震减灾规划实施情况考核机制。
第八条地震监测台网实行统一规划,分级、分类管理。
市地震工作主管部门按照布局合理、资源共享、海域和陆地并重的原则,根据国家地震监测台网规划和本市实际,制定市地震监测台网规划,报市人民政府批准后实施。
市地震监测台网规划应当明确地震监测台网的布局方案、分阶段发展目标以及地震观测环境保护范围、保护要求等内容。
第九条市级地震监测台网,由市地震工作主管部门管理,其建设投资和运行经费,按照国家规定由中央和市财政共同承担。
区、县地震监测台网,由区、县地震工作主管部门管理,业务上受市地震工作主管部门指导,其建设投资和运行经费由区、县财政承担。
第十条核电站、油田、水库大坝、特大桥梁、发射塔、超限高层等重大建设工程的建设单位,应当按照国家规定建设专用地震监测台网或者设置强震动监测设施,其建设投资和运行经费由建设单位承担。
建设专用地震监测台网或者设置强震动监测设施的情况,应当报市地震工作主管部门备案,业务上受市地震工作主管部门指导。
市地震工作主管部门应当定期对强震动监测设施的运行情况进行检查,给予技术指导和服务。
第十一条地震监测台网和强震动监测设施的建设、运行管理,应当遵守法律、法规和有关标准。
有关单位在检测、传递、分析、处理、存贮、报送地震监测信息过程中,应当保证地震监测信息的质量和安全。
第十二条市地震工作主管部门应当建立健全地震监测信息共享平台,为社会提供服务。
区、县地震工作主管部门,专用地震监测台网和强震动监测设施的管理单位,应当将地震监测信息及时报送市地震工作主管部门,实行信息共享。
第十三条市地震工作主管部门应当加强海域地震活动的监测预测工作,开展海域地震观测技术研究,提出海域地震监测规划建设方案,提高海域地震活动监测预测能力。
海域地震发生后,市地震工作主管部门应当及时向海洋主管部门和海事管理机构等通报情况。
第十四条任何单位和个人不得侵占、损毁、拆除或者擅自移动地震监测设施,不得危害地震观测环境。
市和区、县地震工作主管部门应当会同公安、规划、国土房管等有关部门,在地震监测设施附近设立保护标志,标明地震监测设施和地震观测环境保护的要求。
第十五条新建、扩建、改建建设工程,应当避免对地震监测设施和地震观测环境造成危害。
建设国家重点工程,确实无法避免对地震监测设施和地震观测环境造成影响的,建设单位应当按照市和区、县地震工作主管部门的要求增建抗干扰设施;不能增建抗干扰设施的,应当依法新建地震监测设施。
前款规定增建或者新建地震监测设施所需的费用,由建设单位承担。
第十六条本市行政区域内的地震长期、中期、短期和临震预报意见,由市人民政府按照国家规定程序统一发布。
地震灾害发生后,有关震情、灾情和应对措施等信息,由市人民政府授权的人员统一发布。
新闻媒体刊登、播发本市的有关地震消息,应当以市人民政府发布的内容为准。
第十七条市地震工作主管部门应当根据国家地震烈度速报系统建设规划,制定本市地震烈度速报系统建设方案,报市人民政府批准后实施,并保障系统正常运行,为快速判断致灾范围和程度,指挥抗震救灾提供技术支持。
第十八条市人民政府应当组织开展陆地与海域地震活动断层探测和地震危险性评价。
城乡规划、土地利用总体规划、环境保护规划等相关规划,应当依据地震活动断层探测结果和抗震设防要求,充分考虑潜在的地震风险。
第十九条市或者区、县人民政府应当开展地震小区划和震害预测工作,组织制定地震小区划图。
第二十条新建、扩建、改建建设工程,应当达到抗震设防要求。
抗震设防要求应当按照地震动参数区划图、地震小区划图或者经审定的地震安全性评价报告确定。
第二十一条下列建设工程,应当依法进行地震安全性评价:(一)公路、铁路上的长度大于五百米的多孔桥梁或者跨度大于一百米的单孔桥梁,长度大于一千米的隧道;(二)市级广播中心、电视中心、电视发射台以及功率大于二百千瓦的广播发射台,电信和邮政枢纽,卫星通信地球站,应急通信指挥中心;(三)城市快速轨道交通、地下铁路工程,铁路特大型站的候车楼,机场中的候机楼、航管楼、大型机库;(四)单机容量大于三十万千瓦或者规划容量大于八十万千瓦的火力发电厂,总装机容量二十万千瓦的风电工程,五百千伏和二百二十千伏的变电站;(五)八十米以上高层建筑物、构筑物;(六)市级急救中心、中心血站和疾病预防控制中心,六千个座位以上体育馆,三万个座位以上的体育场,一千二百个座位以上的影剧院,建筑面积在二万平方米以上的、人员活动集中的多层大型公共建筑;(七)市级城市供水、供气、供电、交通调度控制中心;(八)生产和贮存易燃易爆、剧毒或者强腐蚀性产品的设施,研究、中试生产和存放剧毒生物制品和天然人工细菌、病菌的较大型建筑;(九)位于地震动参数区划分界线两侧各八公里区域内的大型建设工程;(十)位于复杂工程地质条件区域的新建开发区和占地面积三十万平方米以上的厂矿企业;(十一)法律、法规规定和市人民政府确定的其他建设工程。
第二十二条建设单位应当依法委托具有相应资质的地震安全性评价单位承担地震安全性评价工作。
地震安全性评价单位应当在其资质许可的范围内承揽地震安全性评价业务,并对建设工程地震安全性评价质量负责。
地震工作主管部门应当依法加强对地震安全性评价单位及其从业人员的资质管理。
第二十三条市地震工作主管部门负责依法审定建设工程的地震安全性评价报告,确定抗震设防要求。
依法由国务院地震工作主管部门审定的地震安全性评价报告,建设单位应当将该报告同时抄送市地震工作主管部门。
第二十四条不需要进行地震安全性评价的建设工程,应当按照地震动参数区划图或者地震小区划图确定的抗震设防要求进行抗震设防;学校、医院等人员密集场所的建设工程,应当在当地房屋建筑抗震设防要求的基础上至少提高一档进行抗震设防。
第二十五条建设工程的抗震设防要求应当纳入基本建设程序。
市和区、县发展改革、规划、建设交通、水务等项目审批部门,应当将抗震设防要求作为项目审查的必备条件;对没有抗震设防要求或者抗震设防要求不符合有关规定的,不予审查通过。
第二十六条已经建成的建设工程,未采取抗震设防措施或者抗震设防措施未达到抗震设防要求的,应当按照国家有关规定进行抗震性能鉴定,并采取必要的抗震加固措施。
市国土房管部门应当会同市建设交通部门、市地震工作主管部门和其他有关部门,对本市行政区域内已建成的没有采取抗震设防措施的建筑物进行检查。
第二十七条市和区、县人民政府应当加强对农村基础设施、公共设施和农民自建房抗震设防的管理和指导,制定推进农村民居地震安全工程的扶持政策,引导农民在自建房时采取科学的抗震措施,组织有关部门制定农村民居地震安全工程建设规划和农村民居建筑抗震设防技术标准,加强农村建筑工匠培训,提高农村建筑的抗震设防能力。
建设村镇基础设施、公用设施,应当按照抗震设防要求和抗震设计规范进行规划、设计和施工。
第二十八条市和区、县人民政府应当制定应急避难场所建设规划;组织规划、建设交通、市容园林、地震等部门,根据本市应急避难场所规划,利用城市广场、绿地、公园等空旷区域或者选择符合国家标准的其他场所,设置应急疏散通道和建设地震应急避难场所,并完善相配套的交通、供水、供电、排污等基础设施。
地震应急避难场所的位置应当向社会公布。
避难场所及其周围应当设置明显的指示标识。
未纳入应急避难场所规划但具备抵御地震风险能力的学校操场和公共体育场(馆),可以作为临时地震应急避难场所。
第二十九条地震应急避难场所的管理单位应当按照国家有关规定,对场所、设施、物资等进行维护和管理,保持应急疏散通道畅通。
市和区、县地震工作主管部门应当会同有关部门,对地震应急避难场所的建设、维护和管理给予技术指导,并定期进行检查。
第三十条市和区、县人民政府及其有关部门应当配备必要的应急装备和物资,建立健全物资储备、监管、调拨、紧急配送体系和储备信息库,并制定相应的保障制度和紧急调用方案。
第三十一条市和区、县人民政府及其有关部门应当加强地震应急通信系统建设,健全应急通信保障机制,确保地震应急工作通信畅通。
第三十二条市和区、县人民政府应当加强抗震救灾应急指挥中心建设,完善应急指挥技术平台、地震灾情获取系统、地震应急基础数据系统,建立地震应急基础数据更新机制,为抗震救灾指挥决策提供支撑。
第三十三条市和区、县人民政府应当加强地震安全社区、示范学校和防震减灾科普教育基地建设,提高公民自救互救的意识和能力。
教育、科技、地震等有关部门和科协等社会团体对学校、社区开展的防震减灾科普活动、群测群防活动给予技术指导和支持。
地震监测设施管理单位在不影响地震监测的前提下,可以设立开放日,对公众开放。
学校应当进行防震减灾知识和地震应急知识普及教育,每年至少组织一次地震应急疏散演练,培养学生的安全避险意识和自救互救能力。
第三十四条市和区、县地震工作主管部门会同有关部门制定本行政区域地震应急预案,报同级人民政府批准。
