法治在民主政治建设中的地位和作用
法治在民主政治建设中的地位和作用王晓青1,徐景星2y (1.河北大学政法学院,河北保定071002; 2.保定师范专科学校党委办公室,河北保定071000)摘 要:民主政治已经成为世界政治形式的主流,中国也把发展社会主义民主政治作为全面建设小康社会的目标,并将/依法治国0写进最新修订的宪法。
通过对西方民主政治发展轨迹的考察,认为发展民主政治,必须解决权力与权利的制衡问题,而解决的途径便是法治。
民主与法治的结合是一个渐进的过程,宪法的产生是这一过程发展到一定阶段的产物,标志着民主与法治的全面融合。
中国要发展社会主义民主政治,最重要的是要正确认识宪法的地位与作用,树立宪法至上的观念。
