英国法院体系一、现代英国法院体系的几个特点第一，没有司法部。
英国的法院组织在历史上曾经长期实行二元制，普通法法庭和衡平法法庭自成系统，各自为政。
在他们之上没有一个对两种法院进行统一管理的司法行政部门。
这种现象从16世纪开始。
17世纪初，由于英王和普通法院之间关于管辖权的冲突愈演愈烈，导致了在普通法院和代表国王的衡平法院之间产生了难以调和的矛盾（这种矛盾常被认为是英国革命的前奏之一）。
经过19世纪的司法改革，两种法庭融合为一，但司法系统的中央行政管理机关却没有因此而产生。
直至今日，英国仍没有设立司法部，其司法行政职权在英格兰和威尔士由大法官和内政大臣行使。
第二，从法院组织的上下级关系来看，英国法院可以分为中央法院和地方法院两级。
中央法院包括上议院、最高法院。

第三，英国的最高法院由高等法院、上诉法院和皇家法院三部分组成，它名义上虽为“最高”，但由于上议院的存在，实际上并非最高审级。
一般而言，上议院被视为全国民事刑事案件的最高审级，然而作为欧盟的成员国，欧洲司法法院和欧洲人权法院裁决的效力要高于上议院的裁决和英国立法。
欧洲司法法院（EJC）主要审理涉及商贸问题和社会问题的案子，欧洲人权法院（ECHR）审理的案件主要涉及到可能违反了《欧洲人权公约》的政府行为。
第四，从原则上讲，英国法院受理的诉讼案件分为民事和刑事两种，法院组织和诉讼程序也根据这种区分而有所不同。

内政部在司法行政方面的职权主要体现在法律和秩序的管理，对刑法制度负有总体责任，同时负责警察、监狱和其他惩戒机关。
其内部设有消防和警察司，刑事、缓刑和安置司，广播、社区计划、平等机会、移民和国籍司，监狱司，编制司、财政和综合司等多种机构。
二、律师制度英国的现代律师制度是在经历19世纪司法改革后才最终定型的。
目前所有的律师法都已由《1974年律师法》合而为一，该法是根据从1957年至1974年间与律师有关的法律和其他法律规定制定的。
该法对律师资格的取得，律师执业的权利和义务，对律师的管理等作了明确的规定。
英国律师制度最突出的特点是，根据从业方式和从业范围，将职业律师划分为出庭律师和事务律师两类。
事务律师在一定意义上是辩护律师与当事人之间的纽带。
出庭律师是专门从事高级法院辩护业务的律师。
事务律师和出庭律师两种律师资格所要求的条件不同。
中英司法制度差异
中英司法制度差异英国是联邦制国家，分为四个地区，英格兰、苏格兰、威尔士和北爱尔兰。
这四个地区都有相当的自治权，各自实行不同的司法制度，其中英格兰和威尔士实行同一种司法制度。
英国检察机关英国检察机关历史不长，由于英国奉行当事人主义，对一般刑事案件的起诉不被看做是国家的事情，因此历史上对此类诉讼主要是由警察聘请律师代为起诉，而国家公诉人只负责重罪，如谋杀、叛国等案件的起诉。
由于发现警察在起诉案件中有放纵犯罪的问题，1984年，议会制定了《刑事起诉法》，规定刑事案件统一由检察官负责，1985年正式成立了检察机构（简称cps），建立了现代意义的检察制度，这也是英国刑事司法改革的一项重大措施。
在此后近20年的司法改革中，检察官的权限不断扩大，检察机构不断健全。
英国的检察官都是在律师中选任，所以检察官也称做“出庭律师”或“控方律师”。
英格兰和威尔士地区共分成42个司法区，每个司法区中都设有检察机构，每个检察机构都有一个首席检察官，领导司法区刑事起诉工作。
皇家检察署（类似我国的最高人民检察院）领导42个司法区的检察机构工作。
具体的案件上看：情节比较轻微的案件，按中国通常做法不宜起诉，可以作为治安案件，由警察处理。
在英国这种情况就应当起诉，当然起诉也是由地方法院审理，一般不送进监狱。
案件处理结果大体相同，但程序不一样，这是中英司法制度的一个区别。
