摘要

劳务派遣作为人力资源服务业的重要内容,因其在促进就业机制转换、促进灵活就业、调节劳动力市场配置、降低管理成本等方面的优势契合了社会经济发展的需要,成为我国人力资源服务产业中发展较快的一种用工模式。我国的劳务派遣服务业发展时间短、速度快,即取得了很大成就,也存在诸多问题。本文分析我国劳务派遣用工中的四大问题及我国《劳动合同法》等相关规定的不足,提出完善建议。

本文共分为三个部分:

第一部分主要介绍劳务派遣的概念和特征,以及2012年12月28日第十一届全国人常委会第三十次会议通过的《关于修改<中华人民共和国劳动合同法>的决定》中关于劳务派遣的相关规定。

第二部分提出对劳务派遣用工中的实践问题。详细解读了我国《劳动合同法》及相关法律对被派遣劳动者权益保护的规定,结合我国被派遣劳动者权益保护中存在的问题,指出该法在劳务派遣制度设计上的缺陷。

第三部分针对我国劳务派遣用工中的实践问题进行分析,并提出了完善劳务派遣制度的若干建议。以希望能够进一步完善我国劳务派遣立法的全面性和提高可操作性,从而切实保障被派遣劳动者的合法权益不受非法侵害。

Abstract

Labor dispatch as an important content of human resource service industry, because of its promotion of employment, flexible employment, promoting the transformation mechanism of regulation of market allocation of labor, reduce the management cost advantage to fit the needs of social and economic development, has become the human resource service industry in our country to develop a rapid employment mode. China's labor dispatch service industry development time is short, fast speed, which has made great achievements, there are also many problems. This paper analyses the relevant provisions of the lack of our country labor dispatch in the four major issues and China's "labor contract law" and so on, put forward a sound proposal.

This paper is divided into three parts:

The first part mainly introduces the concept and characteristics of labor dispatching, and in December 28, 2012 eleventh session of the thirtieth meeting of the

Standing Committee on Revising the "the people's Republic of China Labor Contract Law" in accordance with the decision of the relevant provisions on labor dispatch.

The second part puts forward to the practical problems in the labor dispatch. Detailed interpretation of China's "labor contract law" and the relevant provisions of the law on the protection of the rights and interests of the dispatched workers, combined with the existing in our country's labor rights protection problems, and points out that the method dispatch system design flaws in labor.

The third part in view of our country labor dispatch employment in the analysis of practical problems, and puts forward some suggestions to perfect the labor dispatch system. In order to further improve China's overall labor dispatch legislation and improve the maneuverability, and earnestly safeguard the legitimate rights and interests of workers to be dispatched from unlawful infringement.
