美亚财产保险有限公司（以下简称本公司）美亚海外留学生美亚海外留学生团体团体团体意外伤害保险意外伤害保险意外伤害保险(2009年第一版)第一章第一章 基本条款基本条款基本条款第一条第一条 保险合同的构成保险合同的构成保险合同的构成本保险条款、保险单、投保单、批注及其他约定书均为《美亚海外留学生团体意外伤害保险》（以下简称本合同）的构成部分。
本保险合同英文全称为 Group Overseas Student Assist Accident Insurance，简称为GOSA.第二条第二条 投保人对被保险人有保险利益的机关、企业、事业单位和社会团体、或依法具有签订合同资格的其它机构。
其投保的人数必须占约定承保团体人员的75%以上，且投保人数不低于5人。
第三第三条条 年龄的确定与错误的处理被保险人的投保年龄，以法定身份证件登记的周岁年龄为准。
本合同所承保的被保险人的投保年龄以投保单上所载为准。
若被保险人的投保年龄超过三十岁，需递交有效的境外学校入学通知书,由本保险公司特别审核以决定是否承保。
投保人在为被保险人申请投保时，应按被保险人的周岁年龄填写。
若申报的被保险人的年龄不真实，则按照下列规定处理：（1） 如果上述年龄不真实对本合同的保险费造成了影响但根据本合同的约定并不导致该被保险人的被保资格丧失或终止，则应根据真实的年龄进行合理的保险费调整。
（2） 如果上述年龄不真实对本合同的保险费造成了影响且根据本合同的约定导致该被保险人的被保资格丧失或终止，则除本合同另有约定外，本公司将退还该被保险人项下相应的保险费。
第四第四条条 受益人的指定与变更于参加本合同时，被保险人可指定一人或数人为身故保险金受益人。
身故保险金受益人为数人时，被保险人可以确定受益顺序和受益份额，若未确定受益份额，各身故保险金受益人将享有相等的受益权。
受益人故意造成被保险人死亡、伤残、疾病的，或者故意杀害被保险人未遂的，该受益人丧失受益权。
《2010通则》11种术语的基本内容
《2010通则》11种术语的基本内容EXW术语在《2010通则》中，EXW的英文全文为Ex Works ( insert named of delivery )，中文意思是工厂交货(插人指定交货地点)。
其后应注明2010年国际贸易术语解释通则或Incoterms 2010。
这一贸易术语代表了在商品的产地或所在地交货条件。
当卖方在合同约定的交货时间内在其所在地或其他指定地点，如工厂、矿山或仓库等，将合同规定的货物置于买方的处置之下时，完成交货。
此外，卖方要提交商业发票以及合同要求的其他单证。
按照EXW术语成交，有关风险转移、主要责任和费用划分等问题可归纳如下:1.风险转移问题卖方承担将货物交给买方控制之前的风险，买方承担货物交给其控制之后的风险。
也就是说以买方在交货地点控制货物作为风险转移的界限。
2.通关手续问题买方自负风险和费用，取得出口和进口许可证或其他官方批准证件，并且办理货物出口和进口所需的一切海关手续。
卖方根据买方的要求，并由其承担风险和费用的前提下，必须协助买方取得出口许可证或出口相关货物所需的其他官方授权。
3.运输合同和保险合同(1)卖方对于买方无订立运输合同的义务。
同样，买方对卖方也无订立运输合同的义务。
(2)卖方对买方无订立保险合同的义务。
但应买方的要求，并由其承担风险和费用的情况下，卖方必须向买方提供其办理保险所需的信息。
4.主要费用的划分卖方承担交货之前与货物相关的一切费用。
买方承担接受货物后所发生的一切费用，包括将货物从交货地点运往目的地的运输、保险和其他各种费用，以及办理货物出口和进口的一切海关手续所涉及的关税和其他费用。
5.适用的运输方式适用于各种运输方式，包括公路、铁路、江河、海洋、航空运输以及多式联运。
从上述规定来看，按这一贸易术语达成的交易，可以是国内贸易，也可以是国际贸易。
因为卖方一般是在本国的内地完成交货，其所承担的风险、责任和费用也都局限于出口国内，即使是在国际贸易中，卖方也不必过问货物出境、人境及运输、保险等事项，由买方自己安排车辆或其他运输工具到约定的交货地点接运货物，所以，在卖方与买方达成的契约中可不涉及运输和保险的问题。

A statement
Insurance is required on the following commodities:兹有下列物品投保:

保险合同海洋运输货物保险条款（附英文）范本7篇篇1一、保险单本保险单是由投保人与本保险公司订立的，用于保险海洋运输货物的合同。
本保险单详细说明了保险合同的条款和条件，包括保险责任、免除责任、赔偿处理等内容。
投保人在签署本保险单前，应认真阅读并理解其内容和条款，同意按照约定履行其义务。
二、保险责任1. 保险责任：本保险公司同意按照本保险单的约定，对投保人在海洋运输过程中遭受下列损失或损坏的货物承担保险责任：（1）因自然灾害或意外事故导致的货物损失或损坏；（2）因运输工具发生事故或运输工具失踪导致的货物损失或损坏；（3）因盗窃或抢劫导致的货物损失或损坏；（4）因战争、恐怖活动、暴乱或武装叛乱导致的货物损失或损坏。
2. 赔偿限额：本保险公司对每一运输工具的货物损失或损坏的赔偿限额为本保险单约定的最高赔偿限额。
如果货物的损失或损坏超过本保险单约定的最高赔偿限额，本保险公司仅在本保险单约定的最高赔偿限额内承担赔偿责任。
三、免除责任1. 战争险：本保险公司对战争险的免除责任包括但不限于以下情况：（1）战争、军事冲突、恐怖活动、暴乱或武装叛乱导致的货物损失或损坏；（2）货物的损失或损坏是由于违反联合国安理会决议或任何国家政府的规定导致的。
2. 其他免除责任：本保险公司对其他情况的免除责任包括但不限于以下情况：（1）货物的损失或损坏是由于投保人的故意自伤行为导致的；（2）货物的损失或损坏是由于运输工具的舱面货物坠落导致的；（3）货物的损失或损坏是由于运输工具的火灾、爆炸等内部原因导致的。
四、赔偿处理1. 赔偿申请：当发生货物损失或损坏时，投保人应立即向本保险公司提交书面赔偿申请，并提供相关证明材料。
证明材料包括但不限于以下内容：（1）运输工具的航行日志或运输记录；（2）货物的损失或损坏证明；（3）其他相关证明材料。
2. 赔偿审核：本保险公司在收到投保人的赔偿申请后，将尽快对申请材料进行审核。
如果申请材料不齐全或不符合要求，本保险公司将要求投保人补充材料。
友邦年年红二十年期两全保险(分红型)
L1008-02友邦年年红二十年期两全保险(分红型)第一章 基本条款第一条 保险合同的构成本保险条款、保险单、现金价值表、所附的投保单（正本留本公司存档，其复印件或电子影印 件与正本具有同等效 力）、批注及其他约定书均为《友邦年年红二十年期两全保险(分红型) 》合同（以下简称本合同）的构成部分。
本合同英文全称为 20-Year Endowment with Dividend ，简称 20ED 。
第二条 保险合同的类别本合同为分红保险合同。
第三条 年龄的确定与错误的处理被保险人的投保年龄，以法定证件登记的周岁年龄为准。
本合同接受的被保险人的投保年龄为出生满六十天至四十 五周岁。
投保人在申请投保时，应按被保险人的周岁年龄填写。
若申报的被保险人年龄不真实，则按照下列规定处 理：（1）若按被保险人真实的周岁年龄所需收取的保险费较高，则本公司有权更正并要求投保人补交差额的保险费及其 利息（该利息按借款利率计算）；若被保险人已发生保险事故，本公司将根据被保险人真实的周岁年龄，按实际累 计已缴保险费与累计应缴保险费的比例计算实际已缴的保险费所能购买的基本保险金额。
（2）若按被保险人的周岁年龄所需收取的保险费较低，则所有多缴保险费将无息退还，而所购买的基本保险金额维 持不变。
（3）若按被保险人的周岁年龄，根据本公司的核保规则不能承保，则本公司有权解除本合同，所有已缴付的保险费 将无息退还，但自本合同生效日起逾两年的除外。
本合同所赋予的利益，则参照本条第（1）、（2）款处理。
若因申报的被保险人年龄不真实导致红利分配不足，则本公司将不予任何补偿；若实际已分配 的红利超过根据真实 年龄所应分配的红利，则本公司有权索回超额部分的红利。
第四条 基本保险金额的变更投保人在本合同有效期内，可根据本公司的规定，提出变更本合同基本保险金额的书面申请，缴付上述变更所需的 费用，经本公司同意并在本合同上批注后生效。
若申请减少本合同的基本保险金额，则减额后的基本保险金额不得 低于申请减额时本公司规定的最低承保金额，基本保险金额的减少部分视为退保。

这意味着买方必须从该点起承当货物灭失或损坏的一切风险。
FOB交货术语要求卖方办理货物出口清关手续。
该术语仅适用于海运或内河运输。
如当事各方无意越过船舷交货，则应使用FCA 术语。

A3 运输合同和保险合同a）运输合同: 无义务。
b ）保险合同: 无义务。
B3 运输合同和保险合同a ）运输合同: 买方必须自付费用订立从指定的装运港运输货物的合同。
b ）保险合同: 无义务。
A4 交货卖方必须在约定的日期或期限内，在指定的装运港，按照该港习惯方式，将货物交至买方指定的船只上。
B4 受领货物买方必须在卖方按照A4 规定交货时受领货物。
A5 风险转移除B5 规定者外，卖方必须承担货物灭失或损坏的一切风险，直至货物在指定的装运港越过船舷为止。
B5 风险转移买方必须按照下述规定承担货物灭失或损坏的一切风险：自货物在指定的装运港越过船舷时起；及由于买方未按照B7 规定通知卖方，或其指定的船只未按时到达，或未接收货物，或较按照B7 通知的时间提早停止装货，则自约定的交货日期或交货期限届满之日起，但以该项货物已正式划归合同项下，即清楚地划出或以其他方式确定为合同项下之货物为限。

liability or negligence, or otherwise. 4. rent. lessee agrees to pay periodic rent in the amount specified in each equipment schedule (the periodic rent). the initial periodic rent payment for each lease shall be due on the date the equipment is accepted by lessee and subsequent periodic rent payments shall be due as specified on the applicable equipment schedule. all periodic rent and other amounts payable under each lease (collectively referred to herein as rent) shall be paid to lessor at the address specified on the applicable equipment schedule or at such other address as lessor may specify thereafter in writing. if any periodic rent or other rent payment is not paid within 10 days of its due date, lessee agrees to pay as additional rent a late charge equal to 5% of such unpaid rent payment plus 1 1/2% per month of any amount due and unpaid for more than 30 days, or, if less, the maximum amount permitted under applicable law. periodic rent payable during any automatic renewal period described in section 3 hereof shall be equal to the highest periodic rent payable during the initial lease term. lessee hereby agrees that the amount of the periodic rent payments and purchase option price under each lease shall be adjusted to reflect any change in the cost to lessor set forth in the applicable equipment schedule as a result of equipment change orders or returns, invoicing errors or other similar events. in the event of any such adjustment, lessor willfurnish to lessee a written notice stating the final cost to lessor, periodic rent and purchase option price. 6. use, operation and return of equipment.
