美国原料血浆采集的质量管理
美国原料血浆采集的质量管理刘通一刘文芳（四川远大蜀阳药业股份有限公司，四川双流 610214）关键词：血浆、采集、机构、质量、管理从人体采集的血浆（Plasma）是生产制备血浆蛋白制品的起始原料，在其采集过程中实施严格的质量管理是获得高品质原料血浆、进而用之制备出安全有效的血浆蛋白制品的基本保障，同时，这对保护献浆员健康和预防疾病传播也有重要的意义。
美国是世界上原料血浆采集量最多的国家，年采血浆1500万L左右，约占全球总量的2/3[1、2]，而且，美国来源的血浆已被公认为世界上最安全、最优良的原料血浆之一[3]。
1973年起，美国FDA开始对血浆采供机构进行监督管理，至1997年已建立起了一套完整的管理制度和监查系统，有效地保证了血浆采集的安全和原料血浆的质量。
因此，了解美国在原料血浆采集过程中实施的质量管理措施无疑对发展我国的采浆事业有帮助和借鉴作用。
美国FDA根据原料血浆采供机构（Source plasma establishment）的工作内容将其质量管理界定为5个系统，即质量保证系统、献浆员资质系统、血浆检测系统、血浆采集/处理系统和检疫/储存/处置系统，同时，也在献浆员筛选、献浆员拒绝、血浆检测、检疫期隔离及事故监控和调查5个安全层次上保障原料血浆质量和保护献浆员健康[4]。
这“5个系统”和“5个层次”相互交织，共同形成血浆采供机构质量控制网络，其相互关系如下表：1.质量保证系统（Quality assurance system）[4,5,6,7]原料血浆采供机构必须设置质量保证部门和配置专职质保人员。
质量保证（QA）系统由预先拟定好的系列程序组成，也包括有文件证明的过程验证，其最终目标是保证持续稳定地获得预期要求的原料血浆。
QA部门的职能是最大限度地保证所有的关系到原料血浆采集和质量的过程/程序按预期目标正常运行。
QA人员负责协调、监督和促进采浆机构各项工作的正常开展，审核和批准关系到血浆采集和血浆质量的所有程序和操作，防止不合格血浆发放；QA应保证实验设施和生产运行符合现行GMP（CGMP）和其他相关规定，并敦促工作人员遵守；QA还应确保血浆采集全过程时刻受到充分的质量监控。

换位思考的案例
案例一：
1960年，Ben Duffy在纽约有一家小型的广告代理公司。
他听到消息说，美国烟草正在寻找新的代理商，所以他打电话给美国烟草的总裁，约定了面谈的时间。
这可是一笔巨大的生意，它能使Ben Duffy的小公司BBD & O一举成名。
Duffy觉得他必须计划一下这次的会面。
于是他去酒店租了一个房间，保证自己不受任何干扰。
他工作了很久但仍然没有找到突破口。
最后，他自言自语道：“如果我是美国烟草的总裁，我想知道代理商的哪些情况呢？”他马上坐下来，写出了一系列问题，然后他把问题削减成10个，并且都准备了答案。
第二天，Duffy 被领进总裁的办公室，在拘谨的自我介绍后，他说：“我想您一定想通过今天的会面知道我们公司的一些情况，所以我准备了10个问题，也许您希望知道答案。
”“真是太有趣了，”总裁回答说：“我做了同样的事情，您愿意和我交换一下各自所列的问题吗？就现在。
” Duffy 知道这是决定生意成败的一个动作，他同意了。
他在看总裁所写的问题时，非常惊奇地发现他们列出的问题非常相似。
这时候，总裁说道：“我看了一下，10个问题中有7个是一样的”。
Duffy表示同意。
总裁接着说：“我觉得我们有基础可以进行讨论，得出一个双赢计划。
”就这样, BBD & O这家小公司得到了这笔价值百万的生意，如今它已经成为世界上最大的公司之一了。
美国新专利法下的“现有技术”（上）
例外（一）：甲于2019年3月3日向PTO提交发明专利申请，在一年宽限期内，甲公开使用披露了发明内容。
由于甲是本申请的发明人，根据§102(b)(1)(A)规定，甲的披露不构成现有技术，所以甲的专利申请可以获得授权，如图2所示。
倘若在一年宽限期内披露发明内容的人是第三方乙，则乙的披露构成现有技术，甲的申请不能获得专利授权。

例外（二）：甲于2019年3月3日向PTO提交发明专利申请，在一年宽限期内，第三方乙公开使用披露了该发明内容；但在乙披露之前，甲已经提前公开了发明内容。
由于甲的披露早于乙，且甲是本申请的发明人，根§102(b)(1)(B)，甲乙二人的披露均不构成现有技术，所以甲的申请可以获得专利授权，如图3所示。
这里，若乙的公开使用早于甲的公开使用，则乙的披露构成现有技术，甲的申请不能获得专利授权。
§102(a)(1)和§102(b)(1)的规定整合，对第一类现有技术的判定可参照如下流程图。
