Clause 1 This is a one-year contract.本合同于年月日生效,其中试用期至年月日止。
This Contract shall come into effect on __________ (dd/mm/yy), and the probationary period shall not end till _____________ (dd/mm/yy).本合同于年月日终止,如需延长需在合同到期前一个月重新签订合同。
This Contract shall cease to be valid on __________ (dd/mm/yy), and shall be renewed one month prior to the expiration hereof if extension is necessary.二、工作内容 Job Details第二条乙方同意根据甲方工作需要,担任职位的工作。
Clause 2Party B shall agree to take the position as _____ pursuant to Party A’s work need.第三条乙方工作应达到国内相关职业要求管理标准,并能完成公司所安排合理的工作要求。
Clause 3Party B shall perform its work in line with relevant national standards on the occupational requirements management and shall be capable of reasonable works arranged by Party A.三、工作保护和条件Working Protection and Working Conditions第四条原则上执行标准工时制度,乙方每日工作时间8小时,每周工作40小时。
Clause 4 Party B shall be subject to the standard working hour system in principle, namely eight hours per workday and forty hours per week.第五条因设计工作的特殊性,如项目要求需要加班,不计加班费。
Clause 5 Any extra hour worked by Party B for project need as the result of special feature of design work shall not be charged.第六条甲方为乙方提供必要的工作条件,建立健全工作方式,制订工作规范和工作制度。
Clause 6Party A shall provide necessary work conditions for Party B, establish sound work mode, and formulate job specification and system.四、劳动报酬Labor Remuneration第七条甲方每月 18 日前以货币形式支付乙方工资,每月实发工资税后为元。
Clause 7Party A shall on a monthly basis pay Party B’s salary in currency prior to the 18th day, and Party B’s monthly salary af ter tax shall be __________ Y uan.五、福利待遇Welfare and Benefits第八条乙方患病或非因工负伤的医疗待遇按国家、北京市有关规定执行。
甲方按 XXX管理制度支付乙方病假工资。
Clause 8 Party B shall be entitled to the medical benefits as stipulated by the State and Beijing Municipality if he/she falls ill or is injured other than due to work. Party A shall pay Party B the salary during the sick leave in accordance with XXX management system.第九条乙方患职业病或因工负伤的待遇按国家和北京市的有关规定执行。
Clause 9 Party B shall be entitled to the benefits as set forth in the relevant rules and regulations of the State and Beijing Municipality if he/she is ill with occupational disease or injured due to work.第十条甲方为乙方提供以下福利待遇:详则见XXX管理制度。
Clause 10Party A shall enable Party B to be entitled to the following welfare and benefits: refer to XXX management system for details.六、合约的变更、解除Contract Alternation and Cancellation第十一条有下列情形之一的,甲乙双方应变更合同并及时办理变更合同手续:Clause 11Party A and Party B shall alter this Contract and promptly go through contract alternation procedures if any of the following circumstances happens:(一)甲乙双方协商一致的;Party A and Party B reach an agreement on alternation upon negotiation;(二)订立本合同所依据的客观情况发生重大变化,致使本合同无法履行的;The performance of this Contract is rendereddiscontinued by the substantial change of objective circumstances which the conclusion of this Contract is relied upon;(三)订立本合同所依据的法律法规、规章发生变化的。
Laws, rules and regulations upon which the conclusion of this Contract is relied change.第十二条乙方有下列情形之一的,甲方可以解除本合同:Clause 12 Party A shall be entitled to cancel this Contract in any of the following circumstances:(一)在试用期间被证明不符合录用条件的;Party B is proven during the probationary period not to satisfy the requirementsof employment;(二)严重违反劳动纪律或者甲方利益造成重大损害的;PartyB materially violates labor disciplines or causes substantialdamage to Party A’s interest s;(三)严重失职,营私舞弊,对甲方利益造成重大损害的;Party B seriously neglects his duty, engages in malpracticefor selfish ends and brings significant damage to Party A’sinterests;(四)被依法追究刑事责任的。
Part B is being investigated for criminal liability in accordance with the law.第十三条有下列情形之一的,甲方可以解除本合同,但应当提前30日以书面形式通知乙方:Clause 13 Party A may dissolve this Contract by giving a thirty-day prior written notice to Party B if any of the following circumstances happens:(一)乙方患病或者非因工负伤,医疗期满后,不能从事原工作也不能从事由甲方另行安排的工作的;Party B is incapable of performing his original work and any new job as arranged by Party A after the stipulated period of medical leave for an illness or non-work-related injury expires;(二)乙方不能胜任工作,经过培训或者调整工作岗位,仍不能胜任工作的;Party B is incompetent and remains incompetent after training or adjustment of his position;(三)本合同订立时所依据的客观情况发生重大变化,致使本合同无法履行,经甲方双方协商不能就变更工作合同达成协议的。
