法律英语常用词汇辨析：同一个英语动词却有两个截然相反的词义
同一个英语动词，在法律英语中，有时竟有两种几乎完全相反的含义，例如discharge是法律英语中常见常用的一个词，它可作履行解，也可作撤销解，而这两个意思，在中文里几乎是完全相反的。
因此翻译或运用它时必须特别当心。
如discharge a contract指履行合同，不是撤销合同；discharge a bankrupt指免除破产人的责任，不是履行破产人的责任；discharge a burden of proof指履行举证责任，不是撤销或免除举证责任；discharge one\'s liabilities指清偿某人的债务，而不是撤销某人的债务；如说The judge discharged the jury.这是说法官解除了该陪审员的职务，而不是该法官履行了陪审员的职务。

似同实异的几个法律词汇
——法律英语漫谈五十五
这几个形容词，由于在含义上似同而实异，很容易被混淆。
just作形容词时有三层含义。
一是指“公正的、公平的、正直的”行为或状态（fairorright；actingorbeinginaccordancewithwhatisnormallyrightandproper），如：ajust man（一个正直的人）；ajustdecision（公平的判决）；justindignation（义愤）；justcompensation（公平的赔偿）等。
二是指“应得的或应该有的”（welldeserved；fairlyearned），如：ajustreward（应得的奖赏）；ajustpunishment（应得的惩罚）等。
三是指“合理的、有根据的”（reasonableorbasedonreasonablegrounds），因此常译作“正义的”、“合法的”。
在这一层用法上，常与legal同义，如：justwar（正义的战争）；justdebt （合法的债务）；justtitle（合法权利）；justauthority（合法授权）；justcause （正当理由）；justsuspicion（有充分理由的怀疑）等。
judicial是指“有关法官或法律的”（referringtoajudgeorthelaw），“审判上的或在法院所做的”（doneinacourtorbythejudge），因此，常译作“司法的”、“法官的”、“法庭的”、“审判上的”、“法院判决的”、“法官身份的”，如：judicialauthority（司法权；司法当局）；judicialassistance（司法援助）；judicialbody（司法机关）；judicialcommittee（审判委员会）；judicialact（诉讼行为）；judicialapparatus（审判机关）；judicialdiscretion（法官的自由裁量权）；judiciallien（法律上的留置权）；judicialpersonnel（司法人员）；judicialprocedure（司法程序）；judicialworld（司法界）；judiciallimits（司
法管辖范围）；judicialprecedent（司法判例）；judicialsettlement（司法解决）；judicialseparation（经法院裁定的分居）等。
虽然judicial有时亦译作“公正的”（impartial）和“有判断力的”（be able to judge things wisely），如judicialmind（公众的心），但在法律术语中judicialmurder并非“公正的杀人”，恰恰相反，它指“合法但并不公正的死刑判决”，意即“司法上的杀人”，错判死刑。
juridical（=juridic）也是指“有关法官或法律的”（referringtothelaworjudge），与judicial基本同义，如：judicialperson与juridicalperson都指“法人”；judicialbusiness与juridicalbusiness都指“司法业务”或“审判业务”；judicialpractice与juridicalpractice都译作“司法业务”或“审判业务”；judicialpractice与juridicalpractice都译作“司法惯例”或“审判实践”。
但仔细分辨起来，juridical着重指“法律或诉讼程序的”（oflaworproceedings），如“法院开庭日”一般用juridicalday，“诉讼费用”一般用juridicalexpense。
两者之间的实际区别，与其说是字意上的，还不如说是习惯上的。
juristic也作juristical。
它来自jurist（法学家；法官；律师），也指“关于或指法学家或法理学的”（oforpertainingtoajuristorjurisprudence），有时也指“合法的或法律上承认的”（oforpertainingtolaworlegality），如：juristic(al) act（法律行为）；juristic(al)hypothesis（法学上的假设）；juristic(al)theory （法学理论）；juristic(al)work（法学著作）；juristic(al)person（法人）等。
这个字由于与上述的字含义大同小异，用得比较少，有许多英汉词典甚至没有将它收入，但在法学与法律文件中它还是常见的。
justifiable指“情有可原的”（whichcan be excused）和“有理由的；正当的”（thatcan be justified），所以一般译为“正当的”、“有理由的”、“无可非议的”、“合法的”，如：justifiableabortion（合法堕胎）；justifiabledefence （正当防卫）等。
justifiablehomicide是指“正当杀人”，如执行任务或者防止残杀时的杀人，是不负刑事责任的合法杀人，而前面提到的judicialmurder却是指因错判误判而造成的杀人。
两个貌似相同的词语，意义却正相反。
