八、违约责任1、乙方未按约定的时间完成评估的,应承担违约责任,并向甲方支付违约金。

由于甲方未履行其应承担的义务,或在评估过程中不与乙方配合,致使乙方未能按本协议约定的时间完成评估的,乙方不承担违约责任,按约定收费。

2、因乙方的违约、过失舞弊行为导致甲方蒙受经济上损失,乙方应承担责任,依法给予甲方经济赔偿。

如因甲方提供的资料不实不全,导致评估结果不真实、不准确,乙方对由此而造成的后果不承担责任。

3.乙方有义务主动作好与其它中介机构的协调工作,协助甲方完成评估核准或备案;
4.乙方按约定时间提交《资产评估报告书》。

若因甲方不能按规定时间提供材料,乙方有权延长交付报告时间;
5.在评估过程中,若因甲方原因提出重大更改,造成乙方返工,双方应另行协商加收评估费用和延长出具《资产评估报告书》的时间。

八.违约责任:
1.乙方无故终止履行本约定,所收评估费用应退还甲方;如甲方无故终止本约定书乙方有权终止评估并且不退还评估费用;
2.甲乙双方如一方违反本约定书,应根据“合同法”的有关规定,向对方支付违约金,违约金按评估服务费的 %支付;造成经济损失的,还应进行赔偿。

九.争议的解决:
因本约定书或执行本约定书产生的任何争议,应当由甲乙双方协商解决,如协商不成,应将争议提交评估机构所在地的仲裁委员会仲裁,仲裁结果对双方无具有约束力。
