更有进者,上述两种规则之间的区别还导致了行政官员与法官或法律制定者在视域之间的明显区别:行政官员所关注的必定是特定且已知的结果,而法官或法律制定者所关注的则应当是对一种抽象秩序的维护,而不论特定且可预见的结果为何。

集中关注特定的结果,必定会导致短视,因为只有在短期内,特定结果才是可预见的;此外,对特定结果的关注,还会导致特定利益群体之间或特定利益之间的冲突,而这种冲突也惟有通过一个权力机构的裁决(即支持一方或另一方的裁决)才能够得到解决。

因此,倾力关注可见的短期结果,会一步一步地把整个社会变成一个可操纵的组织。

与此同理,如果我们只埋头于即时性的直接结果,那么从长远的角度来看,牺牲的就肯定是自由。

因此,一个由"法律支配"的社会(nomocratic society),必须把强制完全用来实施那些有助益于一种长远秩序的规则。

第一,社会生活中存在着这样一种结构,它所具有的可探知的组成部分并没有被人们理解成有意识的构造之物,甚或它们本身也没有呈现出可辨识的设计方案,而且就是在这种结构之中,我们也不知道有些特定的事情为什么会发生;因此,与那种刻意建构的组织相比较,上述那种结构应当是我们成功追求自己目的的一种更有效的基础。
