作为一个著名的国际组织,FIDIC享誉最广的就是其编制的适用于国际承包市场的工程合同条件。
工程索赔是工程承包施工的正常现象,是弥补承包商经济损失的有效途径,FIDIC施工合同条件的核心是索赔与反索赔,而工期索赔是整个索赔的重点,本文从案例二当中承包商的角度发表我对FIDIC施工合同条件下的工期索赔的看法及理解。
FIDIC的框架关系是业主、咨询工程师与承包商之间的“三位一体”关系,咨询工程师具有双重身份,既有业主的委托代理人身份,也具有独立的第三方中介和仲裁员身份;FIDIC施工合同条件中涉及工期的条款主要有工程的开工、暂停施工和工期延误、竣工时间缺陷责任期及变更、增加和取消、误期赔偿费等。
工程延期的影响因素可以归纳为两大类:(1)合同双方均无过错而引起的工程拖延,主要是指不可抗力事件和恶劣气候条件等;(2)由于业主或工程师的原因而造成的工程延误。
本案例中业主给承包商把一段桥面加阔的指令是一个工程变更。
因而,在承包商向业主提出工期延长时,可以根据FIDIC合同中第44.1条款提出,因为变更势必导致施工程序、方法的的更改及费用的增加,然后承包商引用第52.1条款对变更报新,将新单价报给工程师。
工程师根据第52.2条款对新单价给予批复。
但是在实际工作中,工程师往往不愿意批复承包商的索赔申请,主要原因大致为:(1)认为这是承包商的滋扰行为;(2)认为承包商没有根据或依据不足;(3)为保护业主不会因为支付赔偿金而超出项目的财务预算;(4)对合同条件及法律不太了解;(5)索赔事件是由工程师的错误引起的;(6)担心高估索赔金额而超付承包商;(7)承包商没有提供跢资料;(8)迫于业主的压力或影响。

紧急问题第一时间处理
紧急性问题与突发性事故有许多相似之处,但它们是本质不同的两回事。前者虽然紧急,但从根本上讲是属于存在问题的,但还没有造成事故,而后者已经形成需要紧急处理的事故、如果不及时处理的话后果会比较严重。

PE(或PIE)实施的改进是没有具体的目标的,但是,在一个阶段后如果回头再看的话,有无改进的确不一样。

生产换型如何缩短时间
●结束阶段清理不彻底,导致材料、工具、JIG等在混乱状态下使用;●作业指导书不到位,致使作业缺乏依据;●人员排布方式更新滞后;●作业员对作业要求不太明确;●仪器、设施的设置状态更新滞后;●首件确认未及时进行。
随着生产计划的改变,生产中的产品MODEL(机型)也会改变,而在这个环节上正是生产问题点多发的时候,所以PE应多插手过问才是。更换ODEL时一般可能产生的问题点有以下几方面:

善用修理进行失效分析
修理员就是指那些纠正产品缺陷使其符合要求的人员,他们属于生产部管理。修理员在工作中所面对的全部是不良品,他在实施修理的过程中通过发现、寻找不良处所,采取纠正、修复措施等,对不良形成的全部过程比较熟悉。

If it’s Air Valve:disconnect R89,if the signal Value is about +11V,maybe Q4 Damage;if it’s about -11V, R157 Damage; If it’s 0V, then disconnect R135,if 0V,maybe U34 Damage.
• otherwise Main Board maybe have some problem
