外交学概论名词解释1.主权平等原则:主权平等原则是当代外交的基本原则。
主权这一概念是16世纪末法国政治思想家让.布丹在《论共和国》中提出的。
从国际法的实践看,主权是一国对内最高和对外独立的权力。
主权国家之间应该是平等的,主权平等原则是主权原则的自然延长。
《联合国宪章》对主权平等原则做了较完整的说明:国家在法律上是平等的;各国拥有对内的主权权力;国家的人格和领土完整,政治独立均应受到尊重;国家必须在国际法方面忠实的履行其国际义务。
以上四条是相辅相成的。
一国有权维护自己的主权,同时也必须尊重别国主权,不应将自己的主权意志强加于另一国,否则就是违背了主权平等原则。
2.和平解决国际争端,互不使用武力国际公认的基本准则之一。
这一原则分别列在《联合国宪章》第2条中的第3和第4款。
维持国际和平与安全是联合国的宗旨,这一原则就是为这一宗旨服务的。
其包含着互不侵犯及和平相处的思想。
和平解决国际争端的传统方法有谈判、斡旋、调停和仲裁四种。
前三者是外交方法或政治解决,后者为法律方法即司法解决,但须通过外交途径经当事国同意。
安理会对争端的和平解决负有特殊任务。
3.不干涉任何国家内政国际公认的基本准则之一。
这一原则反映在《联合国宪章》第2条第7款。
是指联合国虽是一个具有普遍权威的世界组织,对会员国具有约束力,但无权干涉会员国内部事务。
当然各会员国之间更不能相互干涉内政。
仍是主权原则的自然延伸。
不干涉原则最早源于18世纪法国大革命时期的宪法,后来为国际社会普遍接受。
4..外交承认:外交承认也叫国际承认。
有两种含义:1.指一个主权国家承认另一个主权国家(一般指新建立的国家,也包括更改政体或国名的国家)2.指承认一个主权国家的新政权(一般是指政权更迭后的新政权)为该国的合法政府。
两国互不承认,或只有单方面承认,是无从建立外交关系的。
所以互相承认是两个主权国家建交的前提。
具体方式:有关双方发表联合公报宣布互相承认,或单方面由一国领导人、外交部或外交代表发电报、发表声明或谈话等宣布承认。
