有人据此认为，中国开放了资本项目中国证监会新闻发言人就中国加入世贸组织后证券业今后的发展问题特别指出：证券业开放与证券市场开放是两个不同的概念。
前者是指允许外国服务提供者参与国内证券业务，属于WTO服务贸易范畴。
具体来说，就是境外服务提供者进入我国市场，为中国居民以中国的本币投资中国证券市场提供的中介服务，不涉及资本的跨境流动以证券监管机构现有的监管职责和监管手段来看，对此类违法活动不具备有效的预防和查处能力，极不利于风险防范。
依照《证券法》第168条规定：证监会依法履行职责，有权“进违法的行为发生场所调查取证”，但是不包括所涉银行：“询问当事人和与被调查事件有关的单位和个人，要求其对与被调查时间有关的实现做出声明”。
其调查范围包括“当事人和被调查事件有关的单位和个人的证券交易记录、登记过户记录、财务会计资料及其他相关文件和资料”，以及“当事人和与被调查事件有关的单位和个人的资金帐户、证券帐户”。
因此，目前中国证监会缺少银行帐户调查权、搜查权、当事人传唤权和起诉权等。
即使是证监会有调查证券帐户的权利，但没有冻结证券帐户的权利，需要证据证明有转移或者隐匿违法资金、证券迹象的，可以申请司法机关予以冻结，但是实际操作程序复杂，且需时较长，证监会查处案件会存在许多困难。
外资主体进入后，这种矛盾更突出，尤其是办案的时滞与证券市场迅捷的交易冲突更大。
中国证监会没有相应的调查权和合理的准司法权，这对于防范风险，有效的监管的施行是一大障碍。
除了外汇风险以外，外资主体进入证券市场较大的风险是内幕交易和操纵价格所带来的风险。
根据《证券法》第183条和第184条，对这类案件“可根据不同情况，处以没收违法所得，并处以违法所得一倍以上五倍以下或非法买卖的证券等值以下罚款”。
这些规定后来在三年多的实践中已经得到证明，缺乏可操作性。
巨大的罚款数额可能超过被处罚人的支付能力而无法实施，造成处罚实际无效率，降低执法机关的权威性。
对于外资机构来说，罚款非同儿戏。
要么不做处罚决定。
做了处罚决定的，就一定要执行。
我国政府在过去3年中“做了不罚，罚了不做”的敷衍了事，不了了之的做法，如果给外资机构“学”去了，它们也跟着“入乡随俗”的，我们的执法的后果将不堪设想。
由此可见，如果目前的立法、司法、执法的问题不解决，开放资本市场的遇到的问题可能是颠覆性的。
外资进来后，它们有着利用程序与制度方面的习惯和传统，与我国政府讨价还价的能力也很强，而且富有经验。
他们甚至可以通过他们本国的政府、公司总部，利用外部市场压力，甚至不惜通过政府外交途径等来影响我们的政府政策的制订和法律的执行。
