公司作为船东时，在SMS筹备、建立、实施、维护、改进和保持的整个过程中，应按要求随时向主管机关报告并保持与主管机关的联络。

The company as the owner, in the preparing, establishing, implementing, protecting, improving and maintaining of SMS, should be required to report to the competent authority and to maintain liaison with them at any time.

公司如是船舶管理机构时，应按要求与船舶所有人之间签署具有法律效力的“船舶委托管理协议”，明确公司已承担船舶所有人的船舶管理责任，并在承担此种责任时同意承担ISM /NSM规则规定的所有责任和义务。管理公司应拥有“船舶委托管理协议”正本、船舶所有人持有副本、船舶持有“船舶委托管理协议”的副本或复印件，并同时备妥报告材料向主管机关进行报告。“船舶委托管理协议”内容，应遵循本手册总则SMM-0164所载明的原则，不容冲突。

If the company is the ship management organization, it should be required to sign a legal “Ship Entrusted Management Agreement” with the owner of the ship, and to clarify that the company has assumed management responsibility for the owner. Meanwhile, the company should agree to take all responsibilities and obligations that the rules of ISM/NSM provide. The management company should own the original “Ship Entrusted Management Agreement”, and the ship owner should hold the copy of it, while the ships should hold the copy or the copies. At the same time, the foresaid company is required to prepare all the materials and report to the competent authority. The content of “Ship Entrusted Management Agreement” should obey the principles of SMM-0164.

公司倘对安全管理体系做出组织机构调整、文件重大修改及代管船舶变更时,应及时向主管机关报告同时报审核发证机构备案。

If the company adjusts the organization of the safety management system, or modify the documents, or change the commissioned ship, it should promptly report to the competent authority and the audit certification establishment for the record.

1.公司的组织机构The Company Organization

公司组织机构以总经理负责制,在总经理领导下设SMS办公室、调度室、安监部、船员部、机务部等职能部室，每个部室设若干岗位，每个岗位由职务人员担当。公司在SMS筹备、建立、实施和保持的过程中，不断健全安全管理机构，并以文件形式明确规定涉及安全和防止污染管理工作的所有部门和人员的责任、权力及相互关系。

The company organization adopts the general--manager responsibility system. There are some functional departments such as SMS Office, Control Center, Safety Supervision Department, Crew Department, Technical Department and so on. Each of the departments sets up several posts and each post is played by the office staff. In the preparing, establishing, implementing and maintaining of SMS, the company continuously improve safety management institutions and clearly define the responsibility, authority and relationship, in the form of documents, between all the departments and the staffs which are related to security and pollution prevention management. 公司的组织机构如本手册附录SMM—D01所示。
