商号（TRADE NAME)，即厂商字号，或企业名称。
商号作为企业特定化的标志，是企业具有法律人格的表现。
商号经核准登记后，可以在牌匾，合同及商品包装等方面使用，其专有使用权不具有时间性的特点，只在所依附的厂商消亡时才随之终止。
在一些生产厂家中，某种文字、图形，既是商号，又用来作为商标。
但对于大多数生产厂家来说，商号与商标是各个不同的。
一般而言，商标必须与其所依附的特定商品相联系而存在，而商号则必须与生产或经营该商品的特定厂商相联系而存在。
商号主要是指从事生产或经营活动的经营者在进行登记注册时用以表示自己营业名称的一部分，是工厂，商店，公司，集团等企业的特定标志和名称，依法享有专有使用权。
商号权属于《保护工业产权巴黎公约》所定义的工业产权范畴，经过依法登记而取得的商号，受到法律的保护。
我国法律对商号权未有明确规定，但《民法通则》中对企业名称权的保护有具体规定。
商号权具有人身权属性，与特定的商业主体的人格与身份密切联系，与主体资格同生同灭。
商号权具有精神财产权属性。
商号在同一个行政区划内的相同营业范围里具有排他性和专用性。
商号权人可依法使用其商号，有权禁止他人重复登记或擅自冒用、盗用其商号，还有权对侵害其商号权行为提起诉讼要求赔偿。
对于商号权可以转让、许可使用或设为抵押。
商号与商标的关系极为密切，经常一起出现在同一商品上，商号有的情况下可以成为商标的一个组成部分或同一内容，但有时又不是。
商号和商标在作用和性质上是有区别的，主要表现为：（１）商标主要是用来区别商品的，代表着商品的信誉，必须与其所依附的某些特定商品相联系而存在，商标权属知识产权；商号主要是用来区别企业的，代表着厂商的信誉，必须与商品的生产者或经营者相联系而存在，商号权属名称权，所以商号权与人身或身份联系更紧密。
（２）商标按照《商标法》的规定进行注册和使用，具有专用权。
其专用权在全国范围内有效，并有法定的时效性；商号按照《公司法》或《企业登记管理条例》登记注册，同样具有专用权。
