I was really looking forward to this unit because Australia seems like such an fascinating and unique place. It's a whole continent that is also a single country, and it's home to some incredible wildlife that can't be found anywhere else on Earth.We started off by learning about the geography and history of Australia. I found it really interesting how Australia used to be inhabited by aboriginal peoples for tens of thousands of years before Europeans arrived. When the British first colonized Australia in the late 1700s, there was a lot of conflict and mistreatment of the native peoples, which was very sad to learn about.Australia is absolutely massive, covering almost 3 million square miles! It's the sixth largest country in the world by landarea. But despite its huge size, Australia is also very dry and arid for the most part. We learned that over a third of the mainland gets less than 10 inches of rainfall per year! That's because much of the interior is made up of desert or semi-arid lands. The majority of Australians live in coastal cities like Sydney, Melbourne, and Brisbane where the climate is more temperate.Of course, we couldn't study Australia without learning about some of the incredible and unique wildlife there. I'll never forget when our teacher showed us pictures of kangaroos, koalas, wombats, and platypuses for the first time. These animals seem almost make-believe because they look so unusual and you can't find them anywhere else! We learned that Australia has more unique and endemic species than any other developed country in the world. Over 80% of the plants, mammals, reptiles, and frogs in Australia can't be found anywhere else on Earth! My favorite has to be the koala - those little guys just look so huggable and cuddly.Another really cool thing we learned about is the Great Barrier Reef off the east coast. It's the largest coral reef system in the world, stretching over 1,400 miles long! The reef is home to an incredible diversity of marine life like fish, sharks, dolphins, turtles, and more. Our teacher showed us amazing footage ofpeople snorkeling and scuba diving among the vibrant colors of the coral. I really hope I can visit the Great Barrier Reef someday and see it with my own eyes.We also spent a lot of time discussing Australia's main major cities like Sydney, Melbourne, Brisbane, Perth, and Adelaide. Sydney definitely seems to be the most famous and iconic, known for sites like the Opera House, Harbour Bridge, Bondi Beach, and more. I was really impressed by the Sydney Opera House and how it has those huge iconic shell-shaped roofs. It's considered one of the greatest architectural works of the 20th century. I'd love to attend a performance there someday.Melbourne also looks like an amazing, vibrant, cosmopolitan city. It's considered the cultural and sporting capital of Australia. We saw pictures of popular attractions like Federation Square, the Royal Botanic Gardens, Queen Victoria Market, and St. Kilda Beach. Melbourne reminds me a bit of cities like San Francisco or Vancouver with its mix of nature, culture, and sports.For our unit project, my group did a skit acting out a hypothetical family vacation to Australia. We mapped out an itinerary that included visiting Sydney for a few days to see the Opera House, Harbour Bridge, Bondi Beach, and go on a tour around the harbour. Then we pretended to fly up to Cairns to seethe Great Barrier Reef and go snorkeling. After that, we "went" to the Australian Outback to see Uluru (the huge iconic red rock formation) and learn about Aboriginal culture. 本文从商标法等角度阐述当前存在的诸多问题,综合现如今的法治现实情况和和对节目名称的保护模式的相关建议,更好的解决与节目名称存在的相关冲突,更好的对节目名称进行保护。
首先在相关理论基础上,阐述了电视节目名称法律保护的必要性,包括有利于创新型社会的构建、降低电视行业的投资风险、激发电视节目制作者的创造热情等方面。
论文分析了电视节目名称法律保护的法律关系,明确了电视节目名称法律保护的内容、主体与客体等。
其次分析了电视节目名称法律保护的现状与问题。
我国现行法律中并没有关于电视节目名称的法律保护的明文规定,对于电视节目名称的法律保护也都是围绕着商标法、著作权法和反不正当竞争法等知识产权领域法律开展的。
在电视节目名称法律保护的问题分析上,论文提出了电视节目名称商标化的问题与弊端,电视节目名称与著作权的权利差异,反不正当竞争法保护电视节目名称的局限等问题。
最后提出完善建议。
