询盘与报价

报盘是卖方按给定条件供货的承诺。它是国际贸易中非 常重要的一个环节。报盘(offer),也叫报价,是卖方 主动向买方提供商品信息,或者是对 询盘的答复,是卖 方根据买方的来信,向买方报盘。
报盘不仅包括价格,而且包括所有的贸易条件,如数量、质量、 付款方式、交货期、装船期、包装、有效期等等。一般说来.报盘 有四个基本要素:(1)向一个或~个以上的特定受盘人发出。(2)表 明订立合同的意思。(3)其内容必须十分确定、完整、明确和终局的。 (4)送达受盘人.并于送到受盘人时生效。
询盘(Inquiry)是指交易的一方 准备购买或销售某项商品,向对方 询问有关交易条件的行为。
询盘的内容可涉及: 价格、规格、品 质、 数量、包装、装运以及索取样品等,而 多数只是询问价格。所以,业务上常把询盘 称作询价。
ቤተ መጻሕፍቲ ባይዱ盘的形式可以是信函、电报、传真、甚至是电 话或当面洽谈。
回复询盘时应该及时,完整,有礼貌。
报盘有两种: 虚盘(non-firm offers), 即无约束力的报盘。一般情况下, 多数报盘均为虚盘,虚盘不规定报盘的有效日期,并且附有保留条 件,如:The offer is subject to our final confirmation/prior sale. 该报盘以我方最后确认/事先售出为准。 实盘(firm offers)则规定有效日期,而且卖盘一旦被接受, 报盘人就不能撤回。
到岸价(CIF)是指进口货物抵达进口国口 岸交货的价格,包括进口货物的离岸价、 国外运费和国外运输保险费 。
离岸价(FOB)是指出口货物运抵出口国 口岸交货的价格 。

询盘报盘

四、询盘Inquiries(一)概说General Information每笔交易的程序不完全相同,但一笔交易的洽商不外乎以下几个环节:询盘→发盘→还盘→接受。
询盘(Inquiry)也叫询价,是指交易的一方打算出售或购买某一商品,向另一方发出洽商邀请。
询盘可由买方发出,也可由卖方发出。
前者习惯上叫“邀请发盘”(Invitation to Make an Offer);后者习惯上叫“邀请递盘”(Invitation to Make a Bid)。
询盘的内容不止限于价格,可以兼询商品的规格、质量、包装和交货期等。
询盘在法律上对双方均无约束力。
即:买方询盘后,无必须购买的义务,卖方也无必须出手的责任。
但在习惯上,对方要尽快答复。
不顾,如果一笔交易从询盘开始,经过双方洽商,最后达成交易,询盘将是全部成交文件的组成部分。
询价信以简单、清楚和切题为原则。

询盘与报盘通常,交易磋商由四个环节构成:询盘、报盘、还盘和接受,其中报盘和接受是导致交易达成的两个关键性的环节。
一、询盘询盘通常是买方为获取所购商品的信息如价格、规格、质量、数量、包装、装运和其它贸易条件而作出的,询盘不具约束力。
当商人拟购买商品时,就会作出询盘。
以下是询盘时应注意的要点:1. 询盘要具体,并清楚地说明你所要的信息:所需的商品、目录、价格单、样品、报价或报盘等,以便使卖方能提供你所需要的信息。
2. 询盘应简洁、抓住要点。

如能同时提供关于业务范围、所需数量、通常的贸易条件以及任何能使卖方提供你所需的服务的信息,都是有利的。
4. 促使卖方提供较优惠条件的策略是给卖方一些诸如你会大量订购或常期订购的希望,可以说"如果价格有竞争力,我们将订购……"或"如果报价优惠,我们将常期向你方订购"。
询盘信函一般由三部分组成:1. 开头段/句,提及如何获悉对方的姓名和地址、感兴趣的商品、本公司的简单介绍(如需要)、初步意向或写信目的。
2. 第二部分/信息部分,具体陈述你的要求。
3.结尾部分,预致谢意并表达对对方早日回复的期望。
询盘的回复信通常由以下三部分组成:1. 开头段/句,确认收到询盘并表示感谢。
2. 第二部分/信息部分,具体陈述所要的信息。
如由需要.也可对商品作些有利的评价。
3. 结尾部分,表达与对方做生意的希望。
二、报盘报盘是卖方对买方所作的询盘的回复。
为了销售自己的商品,在没有询盘的情况下,对于老客户或可能会对自己商品感兴趣的新客户主动作出报盘.这也是一种常见的做法。
在实际国际贸易业务中,有两种报盘:实盘和虚盘。
实盘是在指定时间、按照指定条款、以指定价格供应货物的一种承诺。
实盘一经报出,即构成要约,卖方不能在其有效期内撤回,由买方来决定是否接受还是拒绝。
包含所有询购信息的报价是按照指定条款供应货物的承诺,它可视为是虚盘。
询盘信与报盘信

询盘信与报盘信什么是询盘询盘(inquiry)也叫询价,是指交易的一方准备购买或出售某种商品,向对方询问买卖该商品的有关交易条件。
询盘的内容可涉及:价格、规格、品质、数量、包装、装运以及索取样品等,而多数只是询问价格。
所以,业务上常把询盘称作询价。
询盘不是每笔交易必经的程序,如交易双方彼此都了解情况,不需要向对方探询成交条件或交易的可能性,则不必使用询盘,可直接向对方发盘。
询盘可采用口头或书面形式[询盘的法律效力]在实际业务中,询盘只是探寻买或卖的可能性,所以不具备法律上的约束力,询盘的一方对能否达成协议不负有任何责任.由于询盘不具有法律效力,所以可作为与对方的试探性接触,询盘人可以同时向若干个交易对象发出询盘。
但合同订立后,询盘的内容成为磋商文件中不可分割的部分,若发生争议,也可作为处理争议的依据。
什么是报盘:报盘(offer),也叫报价,是卖方主动向买方提供商品信息,或者是对询盘的答复,是卖方根据买方的来信,向买方报盘,其内容可包括商品名称、规格、数量、包装条件、价格、付款方式和交货期限等。

二、发盘(Offer),又称报盘,报价、发价,要约指买方或卖方向对方提出交易条件并愿意按此条件达成交易的表示。
法律上称为“要约”。
发盘可以由卖方提出,习惯上叫“卖方发盘”,也可以由买方提出,习惯上叫“买方发盘”,或称递盘(bid)或订单(order)。
例如:卖方发盘——CAN SUPPLY TSINGTAO PONGEE 28.5×49 PER KG USD 8.00,450KG FOB QINGTAO 5/6 SHIPMENT IRREVOCABLE SIGHT L/C12可供青岛柞丝绸450千克,28.5×49,每千克8美元,FOB青岛,5/6 月装运,不可撤销即期信用证付款。

第一节 询盘

收到询盘应及时回复;即使你不能满足对方的要求,也应该 及时答复,婉言说明原因,为以后可能的交易留有余地,切 忌置之不理。回复询盘的信函一般遵循以下原则:准确、具 体、清楚。
答复询盘的信函通常包括以下内容:感谢客户来函询价;明 确写信具体意图;正面推销我方产品;通知对方所附附件; 提出报盘交货条件;欢迎对方继续联系。
