中国人寿财产保险股份有限公司国内水路、陆路货物运输保险条款总则第一条 为使保险货物在水路、铁路、公路和联运运输中,因遭受保险责任范围内的自然灾害或意外事故所造成的损失能够得到经济补偿,并加强货物的安全防损工作,以利商品生产和商品流通,特举办保险。
保险责任第二条 本保险分为基本险和综合险两种。
保险货物遭受损失时,保险人按承保险别的责任范围负赔偿责任。
(一)基本险1.因火灾、爆炸、雷电、冰雹、暴风、暴雨、洪水、地震、海啸、地陷、崖崩、滑坡、泥石流所造成的损失;2.由于运输工具发生碰撞、搁浅、触礁、倾覆、沉没、出轨或隧道、码头坍塌所造成的损失;3.在装货、卸货或转载时因遭受不属于包装质量不善或装卸人员违反操作规程所造成的损失;4.按国家规定或一般惯例应分摊的共同海损的费用;5.在发生上述灾害、事故时,因纷乱而造成货物的散失及因施救或保护货物所支付的直接合理的费用。
(二)综合险本保险除包括基本险责任外,保险人还负责赔偿:1.因受震动、碰撞、挤压而造成货物破碎、弯曲、凹瘪、折断、开裂或包装破裂致使货物散失的损失;2.液体货物因受震动、碰撞或挤压致使所用容器(包括封口)损坏而渗漏的损失,或用液体保藏的货物因液体渗漏而造成保藏货物腐烂变质的损失;3.遭受盗窃或整件提货不着的损失;4.符合安全运输规定而遭受雨淋所致的损失。
除外责任第三条 由于下列原因造成保险货物的损失,保险人不负赔偿责任:(一)战争或军事行动;(二)核事件或核爆炸;(三)保险货物本身的缺陷、自然损耗,以及货物包装不善;(四)被保险人的故意行为或过失;(五)全程是公路货物运输的,盗窃和整件提货不着的损失;(六)其他不属于保险责任范围内的损失。
责任起讫第四条 保险责任自签发保险凭证和保险货物离起运地发货人的最后一个仓库或储运处所时起,至该保险凭证上注明的目的地的收货人在当地的第一个仓库或储存处所时终止。
但保险货物运抵目的地后,如果收货人未及时提货,则保险责任的终止期最多延长至以收货人接到《到货通知单》后的十五天为限(以邮戳日期为准)。

第二条下列货物,未经投保人和被保险人特别约定并在保险单(证)中载明的,不属于保险标的范围:金银、珠宝、钻石、玉器、珠宝、古钱币、古玩、古籍、古画、邮票、艺术品、稀有金属及其他贵重财产。
第三条下列货物不属于保险标的的范围:蔬菜、水果、活动物、家禽、鱼类和其他动物。
第四条本保险分为基本保险和综合保险,保险人按照保险单载明的保险险种承担保险责任。
保险责任第五条基本风险因下列保险事故造成被保险货物的损失和费用,保险人应按本条规定负责赔偿:(一)因火灾、爆炸、雷电、冰雹、风暴、暴雨、洪水、海啸、悬崖崩塌、突发性滑坡和泥石流;(二)船舶相撞、搁浅、触礁,桥梁码头坍塌;(三)船舶因上述两段原因沉没、失踪的;(4)装卸或转载过程中因意外事故造成的损失;(五)按照国家规定或者惯例应当承担的共同海损牺牲、分摊和救助费用;(六)发生上述灾害时,因混乱造成的货物损失以及为抢救或避难货物所支付的直接合理费用。
第六条一切风险除基本保险责任外,保险人还负责赔偿:(a)货物因碰撞和挤压而破碎、弯曲、凹陷、断裂和破裂;(二)因包装破裂造成货物损失的;(三)因碰撞或挤压造成容器(包括封条)损坏而造成液体货物泄漏的损失,或者因液体泄漏而造成储存在液体中的货物腐烂变质的损失;(4)盗窃造成的损失;(五)未按规定安全运输而遭受雨淋造成损失的。
免除责任第七条因下列原因造成保险货物损失的,保险人不承担赔偿责任:(1)战争、军事行动、扣押、罢工、抢劫和暴乱;(二)船舶本身的损失;(三)保险责任开始前被保险货物质量低劣或数量不足造成的损失;(四)被保险货物的自然损失、本质缺陷和特性造成的污染、变质和损坏;(五)市场价格下跌和运输延误造成的损失;(六)因委托人责任造成的损失;(七)投保人或被保险人的故意行为或违法犯罪行为。

日本财产保险(中国)有限公司产品责任保险条款总则第一条本保险合同由保险条款、投保单、保险单以及批单组成。
凡涉及本保险合同的约定,均应采用书面形式。
保险责任第二条在本保险有效期内,由于被保险人所生产、出售的产品或商品在承保区域内发生事故,造成使用、消费或操作该产品或商品的人或其他任何人的人身伤害、疾病、死亡或财产损失,依法应由被保险人负责时,保险人按照本保险合同的约定负责赔偿。
第三条保险事故发生后,被保险人因保险事故而被提起仲裁或者诉讼的,对应由被保险人支付的仲裁或诉讼费用以及事先经保险人书面同意支付的其他必要的、合理的费用(以下简称“法律费用”),保险人按照本保险合同约定也负责赔偿。
责任免除第四条保险人对下列各项不负责赔偿:(一)被保险人根据与他人的协议应承担的责任,但即使没有这种协议,被保险人仍应承担的责任不在此限;(二)根据劳动法或工伤条例应由被保险人承担的责任;(三)根据雇佣关系应由被保险人对雇员所承担的责任;(四)被保险产品本身的损失;(五)产品召回发生的替换的费用;(六)被保险人所有、保管或控制的财产的损失;(七)被保险人故意违法生产、出售的产品或商品造成任何人的人身伤害、疾病、死亡或财产损失;(八)被保险产品造成的大气、土地及水污染及其他各种污染所引起的责任;(九)被保险产品造成对飞机或轮船的损害责任;(十)由于战争、类似战争行为、敌对行为、武装冲突、恐怖活动、谋反、政变直接或间接引起的任何后果所致的责任;(十一)由于罢工、暴动、民众骚乱或恶意行为直接或间接引起的任何后果所致的责任;(十二)由于核裂变、核聚变、核武器、核材料、核辐射及放射性污染所引起的直接或间接的责任;(十三)罚款、罚金、惩罚性赔款;(十四)保险单明细表或有关条款中规定的应由被保险人自行负担的免赔额。
责任限额与免赔额(率)第五条责任限额包括每次事故责任限额、累计责任限额,由投保人与保险人协商确定,并在保险合同中载明。

日本财产保险(中国)有限公司GENERAL LIABILTY POLICYStandard ProvisionsSompo Japan Insurance (China) Co.,Ltd.(hereinafter called the Company)In consideration of the payment of the premium, in reliance upon the statements in the declarations made a part hereof and subject to all of the terms of this policy, agrees with the Named Insured as follows:COVERAGECoverage is afforded under this policy in accordance with the specific Coverage Parts identified in the Declarations as being a part of this policy.SUPPLEMENTARY PAYMENTSThe Company will pay, in addition to the applicable limit of liability:(a) all expenses incurred by the Company, all costs taxed against the Insured in any suit defended by the Company and all interest on the entire amount of any judgment therein which accrues after entry of the judgment and before the Company has paid or tendered or deposited in court that partof the judgment which does not exceed the limit of the Company's liability thereon;(b) premiums on appeal bonds required in any such suit, premiums on bonds to release attachments in any such suit for an amount not in excess of the applicable limit of liability of this policy, and the cost of bail bonds required of the Insured because of accident or traffic law violation arising out of the use of any vehicle to which this policy applies, not to exceed $250 perbail bond, but the Company shall have no obligation to apply for or furnish any such bonds;(c) expenses incurred by the Insured for first aid to others at the time of an accident, for bodilyinjury to which this policy applies;(d) reasonable expenses incurred by the Insured at the Company's request in assisting the Company in the investigation or defense of any claim or suit, including actual loss of earnings notto exceed $25 per day.DEFINITIONSWhen used in this policy (including endorsements forming a part hereof):“automobile”means a land motor vehicle, trailer or semitrailer designed for travel on public roads(including any machinery or apparatus attached thereto), but does not include mobile equipment;means bodily injury, sickness or disease sustained by any person which occurs“bodily i njury” during the policy period, including death at any time resulting therefrom;“collapse hazard” includes “structural property damage” as defined herein and property damage to any other property at any time resulting therefrom “structural p roperty damage” m eans thecollapse of or structural injury to any building or structure due to (1) grading of land, excavating,borrowing, filling, backfilling, tunnelling, pile driving, cofferdam work or caisson work or (2)moving, shoring, underpinning, raising or demolition of any building or structure or removal orrebuilding of any structural support thereof. The collapse hazard does not include property damage(1) arising out of operations performed for the Named Insured by independent contractors, or (2)included within the completed operations hazard or the underground property damage hazard, or(3) for which liability is assumed by the Insured under an incidental contract;includes bodily injury and property damage arising out of“completed o perations hazard” operations or reliance upon a representation or warranty made at any time with respect thereto, butonly if the bodily injury or property damage occurs after such operations have been completed orabandoned and occurs away from premises owned by or rented to the Named Insured.Operations”include materials, parts or equipment furnished in connection therewith. Operationsshall be deemed completed at the earliest of the following times:(1) when all operations to be perfomed by or on behalf of the Named Insured under the contracthave been completed,(2) when all operations to be performed by or on behalf of the Named Insured at the site of theoperations have been completed,or(3) when the portion of the work out of which the injury or damage arises has been put to itsintended use by any person or organization other than another contractor or subcontractor engagedin performing operations for a principal as a part of the same project.Operations which may require further service or maintenance work, or correction, repair orreplacement because of any defect or deficiency, but which are otherwise complete, shall bedeemed completed.The completed operations hazard does not include bodily injury or property damage arising out of(a) operations in connection with the transportation of property, unless the bodily injury orproperty damage arises out of a condition in or on a vehicle created by the loading or unloadingthereof,(b) the existence of tools, uninstalled equipment or abandoned or unused materials,or(c) operations for which the classification stated in the policy or in the Company's manual specifies“including completed operations”;“elevator” means any hoisting or lowering device to connect floors or landings, whether or not in service, and all appliances thereof including any car, platform, shaft, hoistway, stairway, runway,power equipment and machinery; but does not include an automobile servicing hoist, or a hoistwithout a platform outside a building if without mechanical power or if not attached to buildingwalls, or a hod or material hoist used in alteration, construction or demolition operations, or aninclined conveyor used exclusively for carrying property or a dumbwaiter used exclusively for carrying property and have a compartment height not exceeding four feet;The explosion “explosion hazard” includes property damage arising out of blasting or explosion.hazard does not include property damage (1) arising out of the explosion of air or steam vessels,piping under pressure, prime movers, machinery or power transmitting equipment, or (2) arisingout of operations performed for the Named Insured by independent contractors, or (3) included within the completed operations hazard or the underground property damage hazard, or (4) for which liability is assumed by the Insured under an incidental contract;of premises, (2) easement agreement, except in “incidental contract” means any written (1) leaseconnection with construction or demolition operations on or adjacent to a railroad, (3) undertakingto indemnify a municipality required by municipal ordinance, except in connection with work forthe municipality, (4) sidetrack agreement, or (5) elevator maintenance agreement;means any person or organization qualifying as an Insured in the “Persons Insured” “Insured” provision of the applicable insurance coverage. The insurance afforded applies separately to each Insured against whom claim is made or suit is brought, except with respect to the limits of the Company's liability;“mobile equipment” means a land vehicle (including any machinery or apparatus attached thereto), whether or not self-propelled, (1) not subject to motor vehicle registration, or (2) maintained foruse exclusively on premises owned by or rented to the Named Insured, including the ways immediately adjoining, or (3) designed for use principally off public roads, or (4) designed or maintained for the sole purpose of affording mobility to equipment of the following types formingan integral part of or permanently attached to such vehicle: power cranes, shovels, loaders, diggersand drills; concrete mixers (other than the mix-in-transit type); graders, scrapers, rollers and otherroad construction or repair equipment; air-compressors, pumps and generators, including spraying, welding and building cleaning equipment; and geophysical exploration and well servicing equipment;。

凡涉及本保险合同的约定,均应采用书面形式。
第二条 本保险为基本险。
投保了本保险后,可选择投保相应的附加险和特约条款。
基本险条款、附加险条款、特约条款的法律效力为:特约条款高于附加险条款,附加险条款高于基本险条款。
附加险条款未尽事宜,以基本险条款为准;特约条款未尽事宜,以基本险条款或附加险条款为准。
第三条 本保险合同中的机动车是指以动力装置驱动或者牵引,上道路行驶的供人员乘用或者用于运送物品以及进行工程专项作业的轮式车辆或履带式车辆,不含摩托车和拖拉机。
第四条 保险机动车灭失或发生全部损失、推定全损、部分损失一次赔款金额与免赔金额之和达到保险金额时,本保险责任终止。
保险责任第五条 保险期间内,保险机动车在被保险人或其允许的合法驾驶人使用过程中,因下列原因造成保险机动车的全部损失或部分损失,保险人依照保险合同约定负责赔偿:1、碰撞、倾覆;2、火灾、爆炸,党政机关、事业团体用车、企业非营业用车的自燃;3、外界物体倒塌、空中物体坠落、保险机动车行驶中坠落;4、受保险机动车所载货物、车上人员意外撞击;5、雷击、暴风、暴雨、洪水、龙卷风、雹灾、台风、海啸、热带风暴、地陷、崖崩、滑坡、泥石流、雪崩、冰陷、雪灾、冰凌、沙尘暴;6、载运保险机动车的渡船遭受自然灾害(只限于有驾驶人随船照料者)。
第六条 发生保险事故时,被保险人或其代表为防止或者减少保险机动车损失而采取施救、保护措施所支出的必要合理的费用,保险人负责赔偿。
本项费用的最高赔偿金额以保险合同载明的保险金额为限。
责任免除第七条 下列情况下,不论任何原因造成保险机动车的任何损失和费用,保险人均不负责赔偿:(一)交通肇事后逃逸;驾驶人、被保险人、投保人故意破坏现场、伪造现场、毁灭证据;被保险人或其允许的驾驶人的故意行为、犯罪行为;(二)驾驶人有下列情形之一者:1、饮酒、服用国家管制的精神药品或者麻醉药品;2、无驾驶证,驾驶证失效或者被依法扣留、暂扣、吊销期间;3、驾驶与驾驶证载明的准驾车型不相符合的机动车;4、实习期内驾驶公共汽车、营运客车或者执行任务的警车、消防车、救护车、工程救险车、载有危险物品的机动车或牵引挂车的机动车;5、使用各种专用机械车、特种车的人员无国家有关部门核发的有效操作证,或驾驶出租机动车或营业性机动车无交通运输管理部门核发的许可证书或其他必备证书;6、法律法规规定的其他属于无有效驾驶资格的情况。

第六条综合险本保险除包括基本险责任外,保险人还负责赔偿:(一)因受碰撞、挤压而造成货物破裂、弯曲、凹瘪、折断、开裂的损失;(二)因包装破碎致使货物散失的损失;(三)液体货物因受碰撞或挤压致使所用容器(包括封口)损坏而渗漏的损失,或用液体收藏的货物因液体渗漏而造成该货物腐烂变质的损失;(四)遭遇盗窃的损失;(五)符合平安运送规定而遭遇雨淋所致的损失。
责任免除第七条因为下列缘由造成保险货物的损失,保险人不负赔偿责任:(一)战斗、军事行动、扣押、罢工、哄抢和暴动;(二)船舶本身的损失;(三)在保险责任开头前,被保险货物已存在的品质不良或数量短差所造成的损失;(四)被保险货物的自然损耗,本质缺陷、特性所引起的污染、变质、损坏;(五)市价跌落、运送延迟所引起的损失;(六)属于发货人责任引起的损失;(七)投保人、被保险人的有意行为或违法犯罪行为。

INSTITUTE CARGO CLAUSES (ALL RISKS)1 This insurance attaches from the time the goods leave the warehouse or place of storage at the place named in thepolicy for the commencement of the transit, continues during the ordinary course of transit and terminates either on delivery(a) to the Consignees’ or other final warehouse or place of storage at the destination named in the policy,(b) to any other warehouse or place of storage, whether prior to or at the destination named in the policy, whichthe Assured elect to use either(i) for storage other than in the ordinary course of transitor(ii) for allocation or distribution,or(c) on the expiry of 60 days after completion of discharge overside of the goods hereby insured from the overseavessel at the final port of discharge,whichever shall first occur.If, after discharge overside from the oversea vessel at the final port of discharge, but prior to termination of this insurance, the goods are to be forwarded to a destination other than that to which they are insured hereunder, this insurance whilst remaining subject to termination as provided for above, shall not extend beyond the commencement of transit to such other destination.This insurance shall remain in force (subject to termination as provided for above and to the provisions of Clause2 below) during delay beyond the control of the Assured, any deviation, forced discharge, reshipment or transhipmentand during any variation of the adventure arising from the exercise of a liberty granted to shipowners or charterers under the contract of affreightment. Transit Clause (incorporating Warehouse to Warehouse Clause).2 If owing to circumstances beyond the control of the Assured either the contract of aftreightment is terminated ata port or place other than the destination named therein or the adventure is otherwise terminated before deliveryof the goods as provided for in Clause 1 above, then, subject to prompt notice being given to Underwriters and to an additional premium if required, this insurance shall remain in force until either(i) the goods are sold and delivered at such port or place, or, unless otherwise specially agreed, until the expiryof 60 days after completion of discharge overside of the goods hereby insured from the oversea vessel at suchport or place, whichever shall first occur,or(ii) if the goods are forwarded within the said period of 60 days (or any agreed extension thereof) to the destination named in the policy or to any other destination until terminated in accordance with the provisions of Clause1 above. Termination of Adventure Clause3 Including transit by craft raft or lighter to or from the vessel. Each craft raft or lighter to be deemed a separateinsurance. The Assured are not to be prejudiced by any agreement exempting lightermen from liability.Craft. & c.Clause4 Held covered at a premium to be arranged in case of change of voyage or of any omission or error in the descriptionof the interest vessel or voyage.Change ofVoyage Clause5 This insurance is against all risks of loss of or damage to the subject-matter insured but shall in no case be deemedto extend to cover loss damage or expense proximatcly caused by delay or inherent vice or nature of the subject-matter insured. Claims recoverable hereunder shall be payable irrespective of percentage. All Risks Clause6 No claim for Constructive Total Loss shall be recoverable hereunder unless the goods are reasonably abandoned eitheron account of their actual total loss appearing to be unavoidable or because the cost of recovering, reconditioning and forwarding the goods to the destination to which they are insured would exceed their value on arrival. Constructive Total Loss Clause7 General Average and Salvage Charges payable according to Foreign Statement or to York-Antwerp Rules if in accordancewith the contract of affreightment.G. A. Clause8 The seaworthiness of the vessel as between the Assured and Underwriters is hereby admitted.In the event of loss the Assured’s right of recovery hereunder shall not be prejudiced by the fact that the loss may have been attributable to the wrongful act or misconduct of the shipowners or their servants, committed without the privity of the Assured. Seaworthiness Admitted Clause9 It is the duty of the Assured and their Agents, in all cases, to take such measures as may be reasonable for thepurpose of averting or miniunising a loss and to ensure that all rights against carriers, bailees or other thirdparties are properly preserved and exercised.Bailee Clause10 This insurance shall not inure to the benefit of the carrier or other bailee.Not to InureClause11 This insurance is extended to indemnify the Assured against such proportion of liability under the contract ofaffreightment “Both to Blame Collision” Clause as is in respect of a loss recoverable hereunder.In the event of any claim by shipowners under the said Clause the Assured agree to notify the Underwriters who shall have the right, at their own cost and expense, to defend the Assured against such calim. “Both to Blame Collision”Clause12 Warranted free of capture, seizure, arrest, restraint or detainment, and the consequences thereof or of any attemptthereat; also from the consequences of hostilities or warlike operations, whether there be a declaration of war ornot; but this warranty shall not exclude collision, contact with any fixed or floating object (other than a mineor torpedo), stranding, heavy weather or fire unless caused directly (and independently of the nature of the voyageservice which the vessel concerned or, in the case of a collision, any other vessel involved wherein, is performing)by a hostile act by or against a belligerent power; and for the purpose of this warranty “power”includes any authoritymaintaining naval, military or air forces in association with a power.F. C. & S. ClauseFurther warranted free from the consequences of civil war, revolution, rebellion, insurrection, or civil strife arising therefrom, or piracy.Should Clause No. 12 be deleted, the relevant current Institute War Clauses shall be deemed to form part of this insurance.13 Warranted free of loss or damage(a) caused by strikers, locked-out workmen, or persons taking part in labour disturbances, riots or civilcommotions;(b) resulting from strikes, lock-outs, labour disturbances, riots or civil commotions.Should Clause No. 13 be deleted, the relevant current Institute Strikes Riots and Civil Commotions Clauses shall be deemed to from part of this insurance. F.S.R. & C.C. Clause14 It is a condition of this insurance that the Assured shall act with reasonable despatch in all circumstances withintheir control.ReasonableDespatchClauseNOTE: -It is necessary for the Assured when they become aware of an event which is "held covered" underthis insurance to give prompt notice to the Underwriters and the right to such cover is dependent upon compliance with this obligation.。

1/1/82INSTITUTE CARGO CLAUSES (AIR)(excluding sendings by Post)RISKS COVERED1 This insurance covers all risks of loss of or damage to the subject-matter insured except as provided in Clauses 2,3 and 4below. Risks ClauseEXCLUSIONS2 In no case shall this insurance cover2.1 loss damage or expense attributable to wilful misconduct of the Assured2.2 ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear of the subject-matterinsured2.3 loss damage or expense caused by insufficiency or unsuitability of packing or preparation of thesubject-matter insured (for the purpose of this Clause 2.3 “packing” shall be deemed to include stowage ina container or liftvan but only when such stowage is carried out prior to attachment of this insurance or bythe Assured or their servants)2.4 loss damage or expense caused by inherent vice or nature of the subject-matter insured2.5 loss damage or expense arising from unfitness of aircraft conveyance container or liftvan for the safecarriage of the subject-matter insured, where the Assured or their servants are privy to such unfitness atthe time the subject-matter insured is loaded therein2.6 loss damage or expense proximately caused by delay, even though the delay be caused by a risk insuredagainst2.7 loss damage or expense arising from insolvency or financial default of the owners managers charterers oroperators of the aircraft2.8 loss damage or expense arising from the use of any weapon of war employing atomic or nuclear fissionand/or fusion or other like reaction or radioactive force or matter. General Exclusions Clause3 In no case shall this insurance cover loss damage or expense caused by3.1 war civil war revolution rebellion insurrection, or civil strife arising therefrom, or any hostile act by oragainst a belligerent power3.2 capture seizure arrest restraint or detainment (piracy excepted), and the consequences thereof or anyattempt thereat3.3 derelict mines torpedoes bombs or other derelict weapons of war. War Exclusion Clause4 In no case shall this insurance cover loss damage or expense4.1 caused by strikers, locked-out workmen, or persons taking part in labour disturbances, riots or civilcommotions4.2 resulting from strikes, lock-outs, labour disturbances, riots or civil commotions4.3 caused by any terrorist or any person acting from a political motive. Strikes Exclusion ClauseDURATION5 5.1 This insurance attaches from the time the subject-matter insured leaves the warehouse, premises or place ofstorage at the place named herein for the commencement of the transit, continues during the ordinary course oftransit and terminates either5.1.1 on delivery to the Consignees’ or other final warehouse or place of storage at the destination named herein,5.1.2 on delivery to any other warehouse, premises or place of storage, whether prior to or at the destination namedherein, which the Assured elect to use either5.1.2.1 for storage other than in the ordinary course of transit or5.1.2.2 for allocation or distributionor5.1.3 on the expiry of 30 days after unloading the subject-matter insured from the aircraft at the final place ofdischarge,whichever shall first occur.5.2 If, after unloading from the aircraft at the final place of discharge, but prior to termination of this insurance, thesubject-matter insured is forwarded to a destination other than that to which it is insured hereunder, thisinsurance, whilst remaining subject to termination as provided for above, shall not extend beyond thecommencement of transit to such other destination.5.3 This insurance shall remain in force (subject to termination as provided for above and to the provisions of Clause6 below) during delay beyond the control of the Assured, any deviation, forced discharge, reshipment ortranshipment and during any variation of the adventure arising from the exercise of a liberty granted to the aircarriers under the contract of carriage. Transit Clause(Continued)6 If owing to circumstances beyond the control of the Assured either the contract of carriage is terminated at a place otherthan the destination named therein or the transit is otherwise terminated before delivery of the subject-matter insured as provided for in Clause 5 above, then this insurance shall also terminate unless prompt notice is given to the Underwriters and continuation of cover is requested when the insurance shall remain in force, subject to an additional premium if required by the Underwriters, either6.1 until the subject-matter is sold and delivered at such place or, unless otherwise specially agreed, until the expiryof 30 days after arrival of the subject-matter hereby insured at such place, whichever shall first occur,or6.2 if the subject-matter is forwarded within the said period of 30 days (or any agreed extension thereof) to thedestination named herein or to any other destination, until terminated in accordance with the provisions of Clause5 above. Termination of Contract of Carriage Clause7 Where, after attachment of this insurance, the destination is changed by the Assured, held covered at a premium and onconditions to be arranged subject to prompt notice being given to the Underwriters.Change of Transit ClauseCLAIMS8 8.1 In order to recover under this insurance the Assured must have an insurable interest in the subject-matter insuredat the time of the loss8.2 Subject to 8.1 above, the Assured shall be entitled to recover for insured loss occurring during the period coveredby this insurance, notwithstanding that the loss occurred before the contract of insurance was concluded, unlessthe Assured were aware of the loss and the Underwriters were not. Insurable Interest Clause9 Where, as a result of the operation of a risk covered by this insurance, the insured transit is terminated at a place otherthan that to which the subject-matter is covered under this insurance, the Underwriters will reimburse the Assured for any extra charges properly and reasonably incurred in unloading storing and forwarding the subject-matter to the destination to which it is insured hereunder.This Clause 9, which does not apply to general average or salvage charges, shall be subject to the exclusions contained in Clauses 2, 3 and 4 above, and shall not include charges arising from the fault negligence insolvency or financial default of the Assured or their servants. Forwarding Charges Clause10 No claim for Constructive Total Loss shall be recoverable hereunder unless the subject-matter insured is reasonablyabandoned either on account of its actual total loss appearing to be unavoidable or because the cost of recovering, reconditioning and forwarding the subject-matter to the destination to which it is insured would exceed its value on arrival. Constructive Total Loss Clause11 11.1 If any Increased Value insurance is effected by the Assured on the cargo insured herein the agreed value of thecargo shall be deemed to be increased to the total amount insured under this insurance and all Increased Valueinsurances covering the loss, and liability under this insurance shall be in such proportion as the sum insuredherein bears to such total amount insured.In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under allother insurances.11.2 Where this insurance is on Increased Value the following clause shall apply:The agreed value of the cargo shall be deemed to be equal to the total amount insured under the primaryinsurance and all Increased Value insurances covering the loss and effected on the cargo by the Assured, andliability under this insurance shall be in such proportion as the sum insured herein bears to such total amountinsured.In the event of claim the Assured shall provide the Underwriters with evidence of the amounts insured under allother insurances. Increased V alue ClauseBENEFIT OF INSURANCE12 This insurance shall not inure to the benefit of the carrier or other bailee. Not toInure Clause MINIMISING LOSSES13 It is the duty of the Assured and their servants and agents in respect of loss recoverable hereunder Duty ofAssured Clause13.1 to take such measures as may be reasonable for the purpose of averting or minimising such loss,and13.2 to ensure that all rights against carriers, bailees or other third parties are properly preserved and exercisedand the Underwriters will, in addition to any loss recoverable hereunder, reimburse the Assured for any charges properlyand reasonably incurred in pursuance of these duties.14 Measures taken by the Assured or the Underwriters with the object of saving, protecting or recovering the subject-matterinsured shall not be considered as a waiver or acceptance of abandonment or otherwise prejudice the rights of either party. Waiver ClauseA VOIDANCE OF DELAY15 It is a condition of this insurance that the Assured shall act with reasonable despatch in all circumstances within theircontrol. Reasonable Despatch ClauseLAW AND PRACTICE16 This insurance is subject to English law and practice.
