This does not include any lamp that meets BOTH of thefollowing criteria:1)The lamp is specifically designed to be used for special purposeapplications; and2)The lamp is unlikely to be used in general purpose applications.Lamps that are used for street lighting; aviation, marine, transportation, orunderwater service; medical service; decorative or showcase service; or thatproduce colored light generally do not fall within the definition of a medium base CFL; however, you must determine that your lamp meets both of the abovecriteria.•Are fluorescent lamp ballasts subject to these requirements?Fluorescent lamp ballasts are not currently subject to the reporting requirements.2) Who is required to submit a certification report and compliance statement?A manufacturer or a private labeler of some covered consumer products is required to submit certification reports and compliance statements.•What is a manufacturer?For purposes of the certification requirements, any person who manufactures,produces, assembles, or imports a consumer product is a “manufacturer.”•What is a private labeler?A “private labeler” is the owner of a brand or trademark on the label of aconsumer product which bears a private label. A product is considered to “bear a private label” if the product or its container is labeled with the brand or trademark of a person other than the manufacturer and the manufacturer’s brand ortrademark is not on the product or container.In other words, a private labeler is a company that sells consumer products under its name, but does not produce them.•If a product is privately labeled, which party is responsible for certification?A basic model must be certified; under the current regulations, either party maysubmit the required certification report and compliance statement. Regardless of which party submits the required documentation, the basic model must becertified before it is distributed in commerce in the U.S.If the manufacturer distributes the basic model in commerce in the U.S., both the manufacturer and the private labeler may be held responsible for the failure tocertify. Once either party has certified the basic model, the other party is covered by that certification.If the manufacturer is overseas and does not distribute the product in commerce in the U.S. and the private labeler does distribute the product in commerce in theU.S., then the private labeler is responsible for certifying the product. (DOE will accept a certification from a manufacturer in this scenario, and that certificationwill fulfill the private labeler’s responsibility to certify.)3) What is the purpose of these reporting requirements?A certification report provides information to DOE to help us verify a manufacturer’s (or private labeler’s) compliance with the applicable energy efficiency or water conservation standard and helps us develop information regarding the products in the marketplace. A manufacturer must provide a certification report for each basic model. A certification report should be filed every time a new basic model is introduced. In addition, a manufacturer is required to report when production of a basic model has ceased and is no longer being distributed.A compliance statement is the actual certification by the manufacturer or private labeler that its basic models comply with the applicable standards; that it performed the required testing in conformance with the specified testing procedures; that the information it reported in its certification report(s) is true, accurate and complete; and that it is aware of the penalties it faces for noncompliance and/or making false statements.4) What information is required to be included in the certification report?In general, the certification report must include, for each basic model:•the product type•the product class (please see 10 CFR 430.32 for more information on the product classes) – be sure product classes are identified exactly as specified in 430.32•the manufacturer’s name•the private labeler’s name(s) (if applicable)•the manufacturer’s model number(s).In addition, each covered product requires specific additional information. Refer to10 CFR 430.62(a)(4)(i)-(xxii) for greater detail, including the form in which measurements should be presented. Please refer to that appendix to see the format for the statement. The compliance statement must certify:•The basic model complies with the applicable energy conservation or water conservation standard.•All required testing has been conducted in accordance with the test requirements in Subpart B of Part 430.•All information in the certification report is true, accurate, and complete.•The manufacturer/private labeler submitting the certification report is aware of the penalties associated with violation of the Act, including the penalties forknowingly filing a false statement to the government.Please note that the compliance statement MUST be signed.6) May I have a third party submit my certification report and compliance statement?You may elect to use a third party to submit the certification report, in accordance with 430.62(e). However, you may not use a third party to submit your compliance statement. If a third party submits a certification report on your behalf, you should submit a compliance statement in accordance with 430.62(a) that states that the information reported in the certification report submitted on [date] (or covering [x] models) by [name of your third party representative] is true, accurate and complete.•I am a third party representative. What do I need to submit?You must submit all the information required on a certification report (see Question4 above). You must also include the name(s) of the manufacturers or private labelers who authorized you to submit their certification report(s) on their behalf.7) How do I submit the required information?Please use certified mail and submit to:Appliance Standards Program (EE-2J)U.S. Department of Energy1000 Independence Ave., SWWashington, DC 20585-01218) What if I have never filed a certification report or compliance statement?You should file a certification report for each basic model that is currently in production and/or in distribution.9) Do international companies need to report?Yes, if your company imports covered products in the United States or if you are manufacturer who sells products in the United States, you must comply with 10 CFR Part 430. Any person who imports a covered product is considered a “manufacturer” under Part 430. Covered products that are not in compliance may be refused admission into thecustoms territory of the United States. DOE will pursue enforcement actions against foreign manufacturers who distribute covered products in the United States and who fail to comply with the applicable regulations.•Who is an “importer”?An importer is a person (company, etc.) who is legally responsible for the entry ofa product into the customs territory of the United States. An importer may bedomestic or foreign and may be a manufacturer, a private labeler, a freightforwarder or any other responsible party.10) I participate in the ENERGY STAR program. Do I still need to submit certification reports and compliance statements?Yes, you still need to submit certification reports and compliance statements to DOE under part 430. ENERGY STAR is a voluntary program managed by the EPA. A product listed in the ENERGY STAR program obviously should meet the minimum federal standards. The requirements to submit certification reports and compliance statements are separate, however, and you must file these documents with DOE to fulfill your obligations under part 430.11) I manufacture/import/label general service fluorescent lamps and/ or incandescent reflector lamps. What information should I provide?The certification report for general service fluorescent lamps and incandescent reflector lamps should include•The testing laboratory’s National Voluntary Laboratory Accreditation Program (NVLAP) identification number or other NVLAP-approved accreditationidentification;•Production date codes (and accompanying decoding scheme);•12-month average lamp efficacy in lumens per watt;•Lamp wattage; and•For general service fluorescent lamps only, 12-month average Color Rendering Index.•Where can I get a list of NVLAP test laboratories?A list of laboratories accredited to perform energy efficiency testing for lighting products is available online at /Standards/scopes/eelit.htm.•How do I certify new models since I do not have 12-month test data?The regulations provide different certification procedures for new models of general service fluorescent lamps and incandescent reflector lamps. See 430.62(b)(2) for detailed instructions.12) I heard manufacturers will be required to submit certification reports and compliance statements for products that had not been subject to the certification requirements before. Is that true?Yes. On January 5, 2010, DOE published a final rule that adopted certification requirements for 6 additional consumer product types.•What additional consumer products will be subject to the certification requirements?(1) Ceiling fans(2) Ceiling fan light kits(3) Medium base compact fluorescent lamps(4) Dehumidifiers(5) External power supplies, Class A(6) Torchieres•When is my certification report and compliance statement due?You must submit your certification report and compliance statement no later than July 6, 2010.•What information must I submit?4Question above.5See Question and13) May I apply for a small manufacturer exemption?Any manufacturer of a covered product with annual gross revenues that do not exceed $8,000,000 from all its operations (including the manufacture and sale of covered products) for the 12-month period preceding the date of application may apply for an exemption. However:1)Only the conservation standards (10 CFR 430.32) are subject to exemption.DOE cannot grant an exemption from any other regulation.2)Exemptions are granted for a limited duration. You cannot get a permanentexemption from a conservation standard.3)DOE will grant an exemption only when the Secretary finds, after obtainingthe written views of the Attorney General, that a failure to allow an exemptionwould likely result in a lessening of competition.4)Exemptions can only be granted for up to two years from the date compliancewith the standard is required. For example, if a standard took effect on March1, 2008, DOE could not grant an exemption from that standard because thestandard has been in effect for 2 years. As another example, if a standard tookeffect on September 1, 2008, DOE could grant an exemption, but only throughSeptember 1, 2010. Before applying for an exemption you should considerthat applications must be published in the Federal Register for a commentperiod of 60 days, unless otherwise specified, before an exemption can be granted. An exemption is not retro-active and does not excuse past non-compliance.。

Foreword FSC received various comments from Certification Bodies and stakeholders requesting a reduction in the number of normative documents to make the documented certification system more comprehensible. FSC therefore combined all previous Advice Notes into single documents which are called “directive”. A directive includes all advices issued in relation to a single standard. The relation to a standard is reflected in the document code. Where new interpretation is approved, these will be added to the directive and the revised document will be reissued. The intention of this document is to standardize understanding and implementation of requirements by FSC accredited certification bodies and certificate holders. This document will be revised as required. The content of the directive will be incorporated into the related standards in each major review as feasible. Changes and amendments to the directive will be announced to the FSC Network immediately. Purpose.This China Civil Aviation Technical Standard Order (CTSO) is for manufacturers applying for Airborne Radar Approach and Beacon Systems for Helicopters CTSO authorization (CTSOA). This CTSO prescribes the minimum performance standards(MPS) that Airborne Radar Approach and Beacon Systems for Helicopters must first meet for approval and identification with the applicable CTSO marking.2. Applicability.This CTSO affects new application submitted after its effective date. Major design changes to article approved under this CTSO will require a new authorization in accordance with section 21.353 of CCAR-21R4.3. RequirementsNew models of airborne radar approach systems for helicopters that are to be so identified and that are manufactured on or after the date ofthis CTSO must meet the standards set forth in Section Two, Radio Technical Commission for Aeronautics (RTCA) Document No. DO-172, “Minimum Operational Performance Standards for Airborne Radar Approach and Beacon Systems for Helicopters,” dated November 1980, and Change 1, dated March 25, 1983.a.Addition.(1) If the equipment design implementation includes a digital computer, the computer software package must be validated and verified in a manner acceptable to the Administrator. An acceptable means of compliance for validation and verification of the computer software package is contained in RTCA/DO-178B, “Software Considerations in Airborne Systems and Equipment Certification ” , dated December 1, 1992.b. Exceptions.The provisions of paragraph 3.0, Beacon Requirements, of Section Three of RTCA Document No.DO-172 pertain to ground-based equipment and, therefore, are excluded from this TSO.c.Environmental Standards.Demonstrate the required performance under the test conditions specified in RTCA/DO-160E, titled Environmental Conditions and Test Procedures for Airborne Equipment, using standard environmental conditions and test procedures appropriate for airborne equipment.Applicant may use a different standard environmental condition and test procedure than RTCA/DO-160E, provided the standard is appropriate for Airborne Radar Approach and Beacon Systems for Helicopters.4. Marking.a. Mark at least one major component permanently and legibly with all the information in 21.423(b) of CCAR-21-R4. The marking must include the serial number.b. The environmental categories in which it has been qualified to operate in accordance with RTCA document DO-160E.c. Each separate component of equipment that is manufactured under this CTSO (antenna, receiver, transmitter, etc.) must be permanently and legibly marked with at least the name of the manufacturer and the CTSO number.d.The part number is to include hardware and software identification or a separate part number may be utilized for hardware and software. Either approach must include a means for showing modification status.5. Application Data Requirements.The applicant must furnish the responsible certification personnel with the related data to support design and production approval. The application data include a statement of conformance as specified insection 21.353(a)(1) in CCAR-21-R4 and one copy each of the following technical data:a. Operating instructions.b. Equipment limitations.c. Installation procedures and limitations.d. Schematic drawings as applicable to the installation procedures.e. Wiring diagrams as applicable to the installation procedures.f. The purpose of on-going assessments is to satisfy the International Ex community that ExCBs maintain their facilities relating to assessing demonstration of craft skills and capabilities that enabled their entry into the Scheme.2.1 Surveillance of ExCBs with National Accreditation acceptable by ExMC2.1.1 ScopeThis section covers ExCBs that maintain national accreditation found to be acceptable by the original IECEx Assessment Team, and by way of ExMC voting on the initial assessment report, the ExMC. The procedures detailed below are general and ALL ExCBs are reminded of their obligations to notify the IECEx Secretariat of any changes within their organisation that may impact on their ability to deliver IECEx Certification Services in accordance with IECEx Rules and Operational Documents and in the spirit of a timely and professional service delivery.2.1.2 ProceduresEach year, prior to the anniversary date of acceptance into the IECEx System, ExCBs shall submit to the ExMC Secretary a report containing the following information:a) Any changes in the organisationDescription of changes in the organisation of the ExCB, its staff, facilities, quality system, operating procedures, or other similar changes, that relate to the ExCB’s operation under IECEx05.ANDb) Annual audit reportCopy of a National Accreditation Body’s audit report issued during the preceding 12 months. This report should show:⎯Site that was audited by the accreditation body⎯Date and duration of the audit⎯ Audit scope⎯ISO/IEC Guides, Standards and IECEx Technical Guidance Documents used during the audit⎯ Observation notes⎯Details of any non-conformances raised⎯Copy of any audit report summaryORc) Report by the ExCB based on its own internal audit(s) carried out during the preceding 12months. A standardised report format should be used for this purpose. Once every two years, the report, prepared by the ExCB shall be endorsed by the National Accreditation Body.Item a) is mandatory and either b) or c) is applicable.2.1.3 ReviewThe ExMC Secretary shall review the information to ensure:⎯Site assessed aligns with the site previously approved by ExMC;⎯All Clauses of ISO/IEC Guide 2, ISO/IEC 17000 and ISO/IEC 17024, as applicable, have been covered;⎯Ensure that Technical Guidance Documents have been used (where available);⎯Any Non-Conformances are identified;Where major Non-Conformances have been identified the ExMC Secretary in consultation with the IECEx Assessor Panel Chairman shall propose appropriate action to be taken, with the IECEx Officers to decide on such action and report at the next ExMC meeting. Where the ExCB does not agree with the course of action, the matter may be referred to the IECEx Board of Appeals, if requested by the ExCB. During the period of referral to the Board of Appeal, the ExMC Chairman in consultation with the other IECEx Officers shall decide on the status of the ExCB in question. In extreme circumstances the status of temporary suspension may be considered. The ExMC is to decide on the final action to be taken.The Secretary will retain a copy of the report, for a minimum of 10 years, for record keeping purposes.2.1.4 Re-assessmentOn the 5th anniversary of the acceptance of the ExCB, or re-assessment of an ExCB, a re-assessment in accordance with the assessment procedure detailed in Section 1 shall be performed by an IECEx Assessment Team appointed by ExMC.2.2 Surveillance of ExCBs without National Accreditation acceptable by ExMC2.2.1 ScopeThis section covers ExCBs that do not have national accreditation but who have been accepted in to the IECEx System by way of a full on-site assessment, by the IECEx Assessment Team.audit2.2.2 On-siteExCBs shall arrange to have one member of the original IECEx assessment team conduct an annual on-site audit. The assessor shall be appointed by the IECEx Assessment Team Leader responsible for the original assessment. The ExCB shall agree to bear the costs associated with this on-site audit.The appointed assessor shall carry out an assessment for compliance with ISO/IEC Guide 2, ISO/IEC 17000 & ISO/IEC 17024 and IECEx System Rules. The Team Leader will then issue a report.Where the original assessment team is no longer available a new assessment team shall be appointed by the ExMC.These reports shall be forwarded to the ExMC Secretary who shall review them for completeness and any non-conformances. Where non-conformances have not been identified the reports shall be retained, for a minimum of 10 years, for record keeping purposes, by the ExMC Secretary.2.2.3 Non-conformancesWhere Non-Conformances have been identified the reports shall be referred to the ExMC Secretary who shall consult with IECEx Officers who shall propose appropriate action to be taken and report at the next ExMC meeting. Where the ExCB does not agree with the course of action, proposed, the matter may be referred to the ExMC or IECEx Board of Appeal. These individuals are identi-fied to public and private agencies, groups, and institutions for their inclusion in educational, scientific, and service activities. Certifications are available within ARCPACS in the areas of agronomy, crop science, soil science, soil clas-sification, horticulture, weed science, and plant pathology. ARCPACS is a membership service of the American Society of Agronomy (ASA).Registrants are certified by a board made up of certified professionals in the certification area. These board members are nominated by the certifying board and appointed by ASA.PurposeProfessional standards are needed for those whose activ-ities affect the well-being of the general public. Professional standards have been recognized in such professions as med-icine, law, engineering, and accounting. Problem solving in land use, crop production, waste management, and the use of agricultural chemicals create a need for the services of professionals. Such professionals must be able to show evi-dence of their qualifications. A certification program that identifies professionals for educational, scientific, and ser-vice activities with public and private agencies is in the pub-lic interest. ARCPACS was established to develop standards and procedures for certification of individuals with creden-tials as professionals in agronomy, crops, soils, weed sci-ence, plant pathology, or horticulture. ARCPACS maintains a registry of certified professionals in each of these areas.CertificationCertification is based on scholarly preparation and work experience supported by references. Individuals certified by ARCPACS have met the educational and practical experi-ence standards, subscribe to the Code of Ethics, and qualify for identification and recognition as professionals. Credentials of applicants are reviewed by a certification board. Currently ARCPACS is composed of certifying boards of six or more members who are nominated by the certifying board and appointed by the president of ASA.Certification is for individuals only. The designation of ARCP ACS Certified may not be used in such a manner as to indicate that a business, firm, or agency is a certified entity. Pedology is the science ofsoils, their origin, character, and utilization.b.This practice shall include proficiency in the applica-tion of the principles of pedology to soil classifica-tion, investigation, education, and consultation, onthe effect of measured, observed, and inferred soilproperties and their use. It shall include the prepara-tion of soil descriptions, maps, reports, and interpre-tations, any of which apply to either private or publicwork.c. A person shall be construed to practice or offer topractice pedology when they advertise their profi-ciency and willingness to practice either verbally, inwriting by job classification, or by some other titlethat represents a professional soil classifier. This doesnot include the work performed by persons who sam-ple and test the soil only for agricultural purposes,engineering activities, or environmental interpreta-tions.C.Minimum Requirements for Eligibilitycation Requirementsa.Possess a bachelor’s degree from a U.S. or Canadianinstitution with a major in the area for which applica-tion is made or a closely allied field of science, meetthe minimum core requirements, and have five yearsof professional experience, subsequent to the bache-lor’s degree, working in the area of certificationrequested. Experience while working toward anadvanced degree does not qualify.b.Possess a master’s or doctoral degree from a U.S. orCanadian institution with a major in the area forwhich application is made or closely allied field ofscience, meet the minimum core requirements, andhave three years of professional experience, subse-quent to the bachelor’s degree, working in the area ofcertification requested. Experience while workingtoward an advanced degree does not qualify.2.Work Experiencea.Applicants are required to demonstrate the percent-age of work experience in the certification area.(1)Activities such as farm management, consulting,research, extension, and teaching require a min-imum of 70% of the applicant’s time workingdirectly with area of certification for any timeperiod to count fully as work experience.(2)Work experience less than 70% will be prorated.(3)Work experience must be in the area of applica-tion. A work experience summary will beattached to any other ARCPACS applicationssubmitted by the applicant.b.Soil classifier applicants shall have not less than fiveyears of cumulative professional experience in thepractice of soil survey and classification and a portionof these five years must be in a position that indicatesto the Board that the applicant is competent to prac-tice soil classification without direct supervision.3.Referencesa.Provide the names and addresses of at least five indi-viduals familiar with your work and professionalexperience. References must be familiar with workexperience being used to meet certification require-ment. The applicant will need to designate the timeperiod during which the reference has personalknowledge of his or her work experience history.(1)At least one individual must be associated withyour employment; an immediate supervisor,client, or coworker.4.Core Requirementsa.Soils applicants must meet the minimum corerequirements as outlined within this document.b. A Soil Classifier must include 5 semester hours insoil genesis, morphology, classification, interpreta-tion, or mapping within the 15 semester hours of soilscience courses.5.Exam Requirementsa.Soils certifications are exam based and all applicantsfor Soil Scientist or Soil Classifier are required topass the Fundamentals and Professional PracticeSoil Science Examinations. After 31 January, certification will be rein-stated with payment of the annual fee plus a late fee.The registrant’s name will be dropped from the activeRegistry if the fee is not paid by 1 April. After 12months, reapplication is required.(1)After recertification has lapsed for 12 months,the individual must reapply following the cur-rent rules of application.(2)For lapsed Certified Professional Soil Scientistand Certified Professional Soil Classifier thisincludes(a)Taking and passing the Council of SoilScience Examiners’ Fundamentals of SoilScience Examination and Council of SoilScience Examiners’ Professional Practice ofSoil Science Examination.(b)Meeting the education requirements.(c)Submitting appropriate references.(d)Meeting experience requirements.c.Continual training and education is required of allCertified Professionals to keep abreast of rapidlychanging conditions, techniques, and requirements intheir field. Therefore, to ensure the validity andintegrity of certification, ARCPACS CertifiedProfessionals must submit evidence of continuingeducation to maintain their Certified Professional(CP) status. During each 2-year period of certifica-tion, a minimum of 40 CEUs must be accumulated.Details of the recertification program are provided atthe time one becomes certified.F.Denial, Revocation, or Suspension of Certification1.Rights and Responsibilitiesa.The right to deny, revoke, or suspend certification isvested in the certifying board.b.Since the certification program is entirely voluntary,ASA assumes no responsibility for any loss or disad-vantage, real or imagined, that may be alleged to haveresulted from denial of certification or revocation orsuspension of an existing certification.2.Reasons for Denial, Revocation, or Suspension ofCertification.a.Certification may be denied, revoked, or suspendedfor any of the following reasons:(1)If the Soils Certifying Board determines that theapplicant does not meet the minimum require-ments as stated.(2)Violation of rules, regulations, or the ARCPACSCode of Ethics established by ARCPACS andASA.(3)Misrepresentation on an application, willful sub-mission of incorrect information, or failure toinclude relevant information in any communica-tion to the Member Services Dept.(4)Substantial proven charges of incompetence inthe area of certification.3.Appeala.Any applicant denied certification has the right ofappeal.b.Any action to revoke or suspend certification shall bepreceded by a copy of the complaint to the individual.(1)Registrants will be given the opportunity toappeal any such disciplinary action.4.If an applicant has been denied certification or certifica-tion has been revoked due to a cause relevant to the Codeof Ethics, the individual must wait three years for reap-plication. (The reapplication procedure described in sec-tion I.D. applies.) Certification may be approved at thediscretion of the board. During the ensuing three yearsthe individual must complete one professional ethicscourse each year. The first year begins at the initial dateof application or at the initial date of revocation and thesecond and third years begin on that anniversary date. Inorder for the courses to satisfy this requirement, theboard must approve the courses. The applicant may sub-mit course information to the board for the board todetermine approval or rejection prior to the individual’senrolling in the courses. During the first year, a course ofat least 24 contact hours must be successfully completed.During the second and third years, the course mustinclude at least 8 contact hours. Adequate documentationof successful completion must be provided to the boardwhich may include a copy of the certificate or transcriptand course outline. At its discretion, the board mayrequest additional course information. At the conclusionof the three years (time starts at the initial date of appli-3cation or at the initial date of revocation), the applicantmay reapply under the rules in effect at the time of thereapplication. Two or more ethics violations, as deter-mined by the board, which occur after the initial applica-tion or date of revocation will result in permanent revo-cation of the certificant.II.Associate Professional StatusA.General1.Registrationa.It is acknowledged that individuals training in one ofthe certification areas may want to become profes-sionally recognized through a professional certifica-tion program. There is a time lapse between comple-tion of the degree and attainment of the minimumwork experience required to be eligible for full certi-fication. For such cases, the classification ofAssociate Professional (AP) is available.2.Certificatea. A certificate is provided to each qualified individualregistered as an Associate Professional.3.Renewala.Registration is valid for the current calendar year,renewable annually, and cannot exceed the number ofyears specified under time limit requirements.b.The Associate Professional does not participate in therecertification program until the Certified Pro-fessional status is acquired.B.Area of Certification1.Associate Professional Soil Scientist (APSSc)2.Associate Professional Soil Classifier (APSC)a.See definition under I.B.3.a,b,cC.Minimum Requirements for Eligibility1.It is expected that those persons applying for theAssociate Professional status will be recent graduateswho have not met the experience requirements for a fullyCertified Professional.
