3.因乙方违反本合同的规定而产生的违约金、损坏赔偿金和其它相关费用，甲方可在押金中抵扣，不足部分乙方必须在接到甲方付款通知后十日内补足。
4.因甲方原因导致乙方无法在租赁期内正常租用该物业，甲方应立即全额无息退还押金予乙方，且乙方有权追究甲方的违约责任。
六、甲方义务/ObligationsofPartyA1.甲方须按时将房屋及附属设施（详见附件）交付乙方使用。
2.房屋设施如因质量原因、自然损耗、不可抗力或意外事件而受到损坏，甲方有修缮并承担相关费用的责任。
如甲方未在两周内修复该损坏物，以致乙方无法正常使用房屋设施，乙方有权终止该合约，并要求退还押金。
3.甲方应确保出租的房屋享有出租的权利，如租赁期内该房屋发生所有权全部或部分转移、设定他项物权或其他影响乙方权益的事件，甲方应保证所有权人、他项权利人或其他影响乙方权益的第三者能继续遵守本合同所有条款，反之如乙方权益因此遭受损害，甲方应负赔偿责任。
4.甲方应为本合同办理登记备案手续，如因未办理相关登记手续致该合同无效或损害乙方租赁权利，应由甲方负责赔偿，且甲方应承担该合同相关的所有税费。
七、乙方义务/ObligationsofPartyB1.乙方应按合同的规定按时支付租金及押金。
2.乙方经甲方同意，可在房屋内添置设备。
租赁期满后，乙方将添置的设备搬走，并保证不影响房屋的完好及正常使用。
未经甲方同意，乙方不得将承租的房屋转租或分租，并爱护使用该房屋如因乙方过失或过错致使房屋及设施受损，乙方应承担赔偿责任。
4.乙方应按本合同规定合法使用该房屋，不得擅自改变使用性质。
乙方不得在该房屋内存放危险物品。
否则，如该房屋及附属设施因此受损，乙方应承担全部责任。
5.乙方应承担租赁期内的水、电、煤气、电话费、收视费、一切因实际使用而产生的费用，并按单如期缴纳。
八、合同终止及解除的规定/Terminationanddissolutionofthecontract1.乙方在租赁期满后如需续租，应提前一个月通知甲方，由双方另行协商续租事宜。
在同等条件下乙方享有优先续租权。
2.租赁期满后，乙方应在日内将房屋交还甲方；任何滞留物，如未取得甲方谅解，均视为放弃，任凭甲方处置，乙方决无异议。
本合同一经双方签字后立即生效；未经双方同意，不得任意终止，如有未尽事宜，甲、乙双方可另行协商。
九、违约及处理/Breachofthecontract1.甲、乙双方任何一方在未征得对方谅解的情况下，不履行本合同规定条款，导致本合同中途终止，则视为该方违约，双方同意违约金为元整，若违约金不足弥补无过错方之损失，则违约方还需就不足部分支付赔偿金。
2.若双方在执行本合同或与本合同有关的事情时发生争议，应首先友好协商；协商不成，可向有管辖权的人民法院提起诉讼。
十、其他/Miscellaneous1.本合同附件是本合同的有效组成部分，与本合同具有同等法律效力。
2.本合同壹式贰份，甲、乙双方各执一份。

第一条租赁汽车乙方租赁甲方的车辆及车辆状况详见合同附件。
（与正本同一编号）第二条租赁期限及有关费用结算乙方租赁期限，押金，租赁费用及结算方式详见合同附件，每天24小时，限行驶200公里计费。
第三条甲方责任，权利及义务1甲方拥有车辆的所有权和处置权。
2向乙方提供技术状况良好的车辆，各种油料（燃油乙方自理），冷却液等充足，各种证，照及税费缴讫证（单）齐全，有效，合法，随车工具及备件安全可靠。
3租赁给乙方的车辆必须是足额办理过保险公司为租赁车辆开办的险种（车险，车上责任险，第三者保险，盗抢险）；代办乙方特别约定的与本合同相关的险种，乙方承担费用。
4负责车辆的二级保养，年检，审验等例行手续。
例检时应向乙方提供不低于同档车型的替租车辆或减免相应租费。
5租赁车辆如在租赁期间发生事故，应协助乙方处理并出具相关索赔证明材料等。
6租赁期间对乙方使用车辆情况有监督权。
7在乙方有违反合同规定的行为时，甲方可随时收回车辆，乙方承担相应的损失。
第四条乙方责任，权利及义务1向甲方租赁的车辆在租赁期间具有合法使用目的的使用权，但没有处置权和汽车租赁经营权。
2对车辆在租赁期前已有的损伤，质量问题及由此造成的损失不承担赔偿，维修义务。
3向甲方提供的身份证，驾驶证，户籍本，营业执照等证件必须真实，合法，有效。
4承担租赁期间的燃油费，过桥过路费，停车费，小修费用等行驶费用。
5租赁期间发生交通肇事逃逸行为，治安事件，违章行为（含电子xxx记录）等违章，违法行为，乙方在任何时候都应负相应责任，承担所受到的处罚和费用，不受合同期限限制，承担因此而造成停驶等非正常费用和租金。
6变更地址，联系方式应及时通知甲方；租赁期满未交回车辆并未办理续租手续；未及时交足租金；担保人有变更而未及时通知甲方时，甲方将向有关部门申报追回车辆，由此而造成的后果和费用乙方承担。
7车辆已出现故障或指示灯已告警后未采取必要措施致车辆损坏，由乙方承担责任和维修费用；车辆例行保养，年检，审验等例行手续，乙方接到通知后，必须及时将车辆交回甲方，否则造成的损失或事故由乙方承担相应责任和费用（包括押金）长租车辆每月前往甲方例检一次。
8出具甲方认为必要的担保人的合法，有效的担保书和证件。
9妥善保管随车证件，牌照及备件，出现丢失，甲方协助补办，乙方应付相关费用。
由此造成停驶和处罚的应承担相关费用和停驶期间的租金。
所丢失的证件、牌照及备件被非法使用后，乙方应承担全部法律责任。
第五条车辆使用1乙方在租期内使用车辆时，应遵守国家有关法律，法规，规章，安全行车，合法使用。
不得用所租车辆进行违法犯罪活动。
2未经运管部门批准，乙方不得用所租车辆从事营业性运输，不得转借，典当，抵押，不得运输易燃，易爆，易腐蚀等物品和污秽物品，不得运输国家规定专用车辆才能运输的特种物品。
3乙方不得典当、抵押所租赁车辆，否则，视为故意骗租行为，甲方将提请有关部门追究其刑事责任。
4乙方不得用所租车辆从事任何形式的竞赛和测试验等；未经许可不得转租。
5乙方变更驾驶人员必须事先征得甲方同意，驾驶人员所持有的驾照必须是合法，有效的，准驾车型能够驾驶所租车辆，不得将车辆交于无合法，有效驾照的人员驾驶。
因所持驾照与所租车辆不符而产生事故责任，由乙方承担所有责任。
6乙方每次出车前必须对机油，刹车油，防冻液，轮胎气压，灯光，燃油等项目作常规检查，如发现隐患问题及异常应及时停车检查并与甲方联系。
填加油，液必须使用车辆生产厂家所允许的油液产品，否则，造成损失的由乙方全部承担。
7乙方不得自行拆卸或拆除所租车辆的零件或设备；不得故意拆除、损坏、反转里程表。
由此造成车辆设备损坏的，应负责赔偿责任，并支付车辆停驶期间的租赁费。
更换零部件应征得甲方同意，并使用正厂备件。
8乙方要遵守《中国人民共和国道路交通安全法》，驾驶中系好安全带，不得酒后驾车，带病驾车，长时间疲劳驾车。
不得进行破坏性驾驶。
第六条事故及保险1租赁期间发生交通事故，车辆被盗抢事件或其他车辆损失，灭失事件（以下统称“事故”）乙方应及时向公安，xxx部门报案，并尽快通知保险公司立案。
8小时内应向甲方通告。
承担公安，xxx部门裁定的责任。
2车辆出现事故后或事故车辆修理后恢复使用但造成贬值的，乙方在承担保险公司赔付后不足部分的费用和其他相关费用后，还要承担加速折旧费，加速折旧费最高不超过总修理费用的20%，承担保险公司赔付期间或车辆修理期间租赁费用的60%。
修理期间为甲方确认事故后送入修理厂之日至将车辆修复到相当于发车时车况后从修理厂取出止，保险赔付期间为向保险公司报案之日至保险公司赔付之日止。
3乙方在出现事故后妥善收集并保管相应证件和材料，并保护事故现场。
否则造成保险免赔的，乙方应承担相应的损失和费用。
4出现事故后，处理时所需费用由乙方先行垫付，保险公司赔付后按相关部门裁定结果结算。
乙方事故造成保险险种赔偿之外的其他损失的，乙方承担全部责任和相关费用。
5事故后修理车辆应到保险公司或甲方指定的修理厂修理。
更换零配件须用原厂或正规厂家的合格产品，否则按规定赔偿。
第七条救援条款1由于机器本质故障造成车辆不能正常行驶，乙方无法修复的，甲方应在接到乙方通知后及时前往车辆所在地免费排除故障，确应客观原因（如道路无法通行，路途遥远等）无法前往救援的，甲方应及时通知乙方解决办法，并由甲方承担故障期间租费的40%和排除故障直接费用。
2下列情况由乙方承担救援费用：（1）驾驶员操作不当引起的故障；（2）行车前准备不足（如燃油不足，水液不足等）（3）车辆警示灯报警后继续行驶造成机器故障的（如机油缺少，水箱少水，气压不足）；（4）驾驶员应知应会，能自行排除而不排除的（如加水，换轮胎等）；（5）交通事故后，乙方需要救援的；（6）被盗抢或其他情况车辆和人员处险时。
3救援收费标准：30公里以内的救援每次（天）收取救援费用50元及相关过路过桥费和其他相关费用，30公里以外的每次（天）收取救援费80元及相关过路过桥费，车辆燃油费和其他相关费用第八条变更条款1租期界满后，乙方需续租时，应提前3小时（租期超过10天的提前3天）想甲方申明并办理续租合同。
