如何做好英文专利翻译Ⅰ.总则1. 专利说明书的中译，应特别注重"信"与"达"两大要求，即译文必须与原文内容完全相符，不得有任何出入或节略。
但中文必须通顺易读，使任何人不必参阅原文，即能了解中文内容。
2. 一件专利申请会包含「说明书摘要」、「摘要附图」、「权利要求书」、「说明书」及「说明书附图」，除摘要附图不需编页码外，其它个部分均需独立编页，亦即每一部份均需从「1」开始编页码（见附件一）。
3. PCT 案件之摘要附图为首页之附图，CN 案件本所则会另有指示，「摘要附图」不需加上页码，同时必须将「图X」之字样去除。
4. 在「说明书附图」中，请勿以「1/4」之页码编排而应在下方加阿拉伯数字自然排序，就如同「说明书」页码一样，但是附图中之「图1」，「图2」...则仍须保留。
5. 专利申请中的说明书应依以下各部分编译并写明各部分的标题（发明名称除外），每一部份之标题均需完全与下列标题完全相同：3.1 发明名称(Title)3.2 技术领域(Technical Field)：要求保护的技术方案所属的技术领域；3.3 背景技术(Background Art)：对要求保护的技术方案的理解、检索、审查有用的背景技术；3.4 发明内容(Contents of the invention)：要求保护的技术方案所要解决的技术问题以及解决该技术问题所用的技术方案，及对照现有技术所得的有益效果；3.5 附图说明(Description of figures)：各幅附图的简略说明；3.6 具体实施方式(Mode of Carrying out the Invention)：要求保护的技术方案的优选方式得详细说明，其中可能包含实施例或对照附图的说明。
6. 书写规则：4.1 规格：用纸规格为297 毫米×210 毫米（A4）；4.2 页边：译文的顶部（有标题的，从标题上沿至页边）应当留有25 毫米空白；左侧应当留有25 毫米空白；右侧应当留有15 毫米空白，底部从页码下沿至页边应当留有15 毫米空白；4.3 字体：应当使用宋体、仿宋体或者楷体，不应当使用草体及其它字体；4.4 字高：应当在3.5 毫米至4.5 毫米之间；行距应当在2.5 毫米至3.5 毫米之间。
4.5 书写方式：自左至右横向书写。
一页纸上不应包含二种以上文件（例如，说明书和权利要求书）；4.6 一种文件在两页以上时，应当各自用阿拉伯数字顺序编号。
编号应当置于每页下部页边的上沿，幷左右居中。
7. 发明名称一般不得超过25 个字，但是在特殊情况下，可以增加到40 个字，例如，某些化学领域的发明。
若字数超过，请填写翻译者意见书（见附件二）告知本所。
发明名称应写在说明书首页正文部分的上方居中位置，其与说明书正文之间应当空一行。
8. 摘要全文一般不超过300 个字。
9. 译文所用各种名称，应当使用所属技术领域的技术术语。
对于技术术语，国家有规定的，应当采用统一的术语，国家没有规定的，可以采用所属技术领域约定俗成的术语，也可以采用鲜为人知或者最新出现的科技术语，或者直接使用中文音译或意译词，必要时可以采用自定义词，或以搜寻引擎协助寻找(见附件三)，在这种情况下，应当在该技术术语第一次出现时于其后加注原文。
注：本所建议的工具书为英日汉电子信息辞典、英日汉机械工程辞典及英日汉化学化工辞典（编辑组：蒋怡、曾铎、张仁杰、唐朝瑛、翟谦、沉崇渊；责任编辑：蒋怡；出版社：新时代出版社）。
10. 说明书中使用的技术术语与符号应当前后一致。
11. 计量单位(如Kg, cm, ml, m/s, rpm)、数学符号、数学公式、各种编程语言、计算机程序、化学元素或分子符号、序列代号及特定意义的表示符号（例如中国国家标准缩写GB）等不需译出。
此外，原文中的外国专利文献、专利申请、非专利文献的出处和名称也不需译出。
12. 若英文原文中的文句，因修饰词组修饰子句过多，直译过于冗长有碍文句的简明时，须对原句意义透澈了解后，将修饰子句另行译述于原句之后，但原句的意义不得因此有欠完整。
13. 英文多被动式，中文多主动式，在不妨碍原文意义下译文可采用主动式或被動式的表达法。
14. 若觉说明书或权利要求有问题，请先依原文翻译再填写翻译者意见书告知本所。
15. 英文摘要下所列的外国申请专利案号及日期不必写。
16. 标点符号不可完全沿用原文，中译应按中文书写规定使用。
17. 虽然某些原文说明书分段系以空一行的方式表现，在每段开头皆未空二格，但中文译文上分段仍应空出二格。
18. 某些发明主题专利法规定不准专利：1. 科学发现。
2. 智力活动的规则和方法。
3. 疾病诊断和治疗方法。
4. 动物和植物品种(但其生产方法可准)。
5. 用原子核变换方法获得的物质。
19. 翻译完成的成品应详细对照原文并再次检查以避免漏译或错字。
20. 回传给本所之文件名称请用英文或数字表示，例如。
21. 若需要，有些翻译案件本所会委请翻译社直接由网站download(见附件四)。
22. 请确实遵守翻译流程及相关规则(见附件五)。
23. 本"专利说明书翻译须知"若有任何变更将以电话或e-mail 之方式通知Ⅱ.权利要求权利要求为专利申请人所欲得国家保护的范围。

专利翻译常见用词与术语一、常用语言点1.accordingtov.baedon美国版：inaccordancewith更开放，accordingto范围更小。
美国律师Paul觉得，baedon似乎有directdependent（直接依附/取决于）的意思，也就说，似乎可理解为直接因素。
欧洲字对字版：字面对应翻译，“根据”accordingto;\基于\2.canv.may关于“能够”，要根据实际情况选词：#表达能力，一般不建议用can，而是capableof#表示可能性，用can或may#如果只是表示具体事实，“能够”多余，可以不翻译（但需IPR确认）补充说明：以前美国律师强调过，can会有主观色彩，不建议用。
