2.1.1 自 [ 2008 ]年[ 1 ]月[ 20 ]日开始直至[2009]年[ 1 ]月[ 19 ]日,承租方无权终止本租赁协议,否则将被视为对本协议的违反,出租方有权根据本协议的约定没收押金并要求承租方赔偿因此而遭受的损失; 2.2 租赁期限届满,若承租方于租赁期内没有任何违反本协议项下的任何条款的行为,则承租方可以选择续租,但应至少于租赁期限届满前2个月将此一意图书面通知出租方,新的租赁条款和条件将由双方按届时的情况协商确定;在同等条件下,承租方具有优先续租权,但此一优先权仅限于该租赁单元。
2.3 若承租方未能如此通知,则视为放弃同等条件下之优先续租权,或者承租方虽然通知但双方未能就续租条件达成一致,此时出租方有权在租赁期之最后两个月内为该租赁单元之出租做必要之准备工作,包括在提前适当通知承租方的情况下带领潜在之承租人参观该租赁单元以及对租赁单元进行合理、必要的检查和维修,或为该单元之出租做广告等。
2.4 若承租方虽未能提前2个月给予出租方续租之书面通知,但仍有意续租该租赁单元或出租方所有之其他单元,则出租方有权视情况决定是否将该租赁单元继续租与承租方。
3、 租金 3.1 月租金总额(以下简称“租金”)为每月[26,900元]人民币,包括: (1) 房屋租金; (2) 装修及配备租金; (3) 每周[ 6 ]次日常清洁服务费用(周日及公共假日除外); (4) 支付的/被征收的所有税款; (5) 免费使用部分俱乐部设施; 3.2 除上述内容之外,出租方或其聘请的管理公司所提供的其他服务,均不包括在租金之内,而无论此类服务是否另行收费。
4、 租金的支付 4.1 租金自起租日开始计算直至租期届满之日,但本协议另有规定的除外。 4.2 租金按月结算并应提前支付,对于首期租金(自起租日至该月最后一日),承租方应在本协议签署之日起5日内但最迟不迟于起租日将该月之租金全额、预先支付至出租方所指定的下列帐户或随后所不时指定的其他帐户,而不得以任何理由抵销、扣减其应付的租金:
开户名称:广州市海溢房地产发展有限公司 开户银行:中国民生银行广州黄埔大道支行 银行帐号:0325014180000102 4.3 除首期租金之外的其他每期租金,承租方应于每月一日之前将该月租金全额支付至出租方,而无须任何通知或要求。
4.4 租金可以等值人民币支付,在此情况下,汇率应按当月1日中国人民银行公布的汇率中间价计算。
4.5 出租方应在收到租金后10个工作日内向承租方出具统一的税务发票。 4.6 若承租方未能按约支付首期租金,则出租方有权但无义务推迟交房日期,直至承租方如数支付租金,在此情况下,租期相应予以顺延,起租日为出租方收到付款之日。若承租方迟延支付首期租金超过10天,则出租方还有权但无义务视情况解除合同。此一权利不影响出租方根据本协议或相关法律所享有的其他权利或义务。
5、 押金 5.1 承租方应向出租方支付总额相当于两个月租金即[53,800]人民币的款项作为押金以确保承租方履行其于本协议项下的所有承诺及义务.
5.2 上述押金应在本协议签署之日起5日内但最迟不迟于起租日由承租方足额交纳,且上述押金之交纳不应被视为或被当作租金的支付,也不影响承租方履行本协议项下支付首期租金之义务。
5.3 押金由出租方持有期间,应不计利息; 5.4 若承租方未遵守前述第2.1.1条的约定,或出租方因承租方违约而解除合同,出租方有权没收其相当于两个月租金的全部押金,承租方无权要求返还;并且若承租方未能恰当履行或遵守其在本协议项下之任何承诺及义务,则出租方有权但无义务把押金或其中任何部分用于支付所欠款项,或补偿因承租方的违约而引起的出租方的任何损失或开销,不足部分,出租方有权予以追偿;且上述权利均不损害或影响出租方根据本协议或相关法律所应享有的的任何其他权利或补偿。
5.5 在出租方按本协议之相关规定扣减或没收押金的全部或任何部分后,应将扣减或没收之金额及相应之收据通知承租方。在收到出租方通知后5日内,承租方应补足押金数额。
5.6 在租赁期限届满或被提前终止时,在承租方按本协议之约定将租赁单元交还出租方并清偿完所有应付款项后20个工作日内,出租方应将押金余额如数退还。
5.7 押金可以等值人民币支付和/或返还。汇率应按到期日当月1日中国人民银行公布的汇率中间价计算。
5.8 若承租方未能按第5条的规定支付押金,则出租方有权但无义务将起租日顺延并迟延交付租赁单元,直至承租方全额缴付押金,但本协议另有规定的除外;在此情况下,租期也将相应顺延。 6、 其他费用 6.1 承租方应负责缴纳该租赁单元每月的水费、电费、煤气费等公用事业费。 6.2 承租方还应支付因使用电话等通讯方式而产生的费用。 6.3 上述费用由出租方代为收取,出租方应向承租方提供有关帐单;除非存在明显之错误,此一帐单应作为承租方支付上述费用之依据;
6.4 承租方应在收到上述帐单后5日内足额支付上述费用;否则出租方有权按照公用事业主管部门所规定的滞纳金标准就承租方迟延付款收取滞纳金。
7、 租赁用途 7.1 租赁单元仅供居住之用,承租方不得将其用于任何其他用途。 7.2 租赁期内,租赁单元仅为承租方所指定的前述人士及其家人占用居住,但承租方有权视情况更换住户。若承租方拟更换该住户人员,应至少提前1个月书面通知出租方,并应向出租方提供新住户的身份证件复印件、工作许可复印件和有关当局所要求的任何其他证件或文件。
8、 租赁单元交接 8.1 出租方应在起租日当日将租赁单元按现状交付给承租方,但本协议另有约定的从其约定。
8.2 承租方应于起租日当日或之后按本协议及其附件的规定接受所租赁之单元,并应签署出租方所提供的相关文件以确认租赁单元之妥善交接。
8.3 就本协议而言,如在承租方接受所租赁单元后之三日内未以书面形式向出租方提出所交付之租赁单元不符合约定并说明理由,则视为交付之租赁单元符合约定。
9、 承租方的义务 9.1 付款 9.1.1 按照本协议规定的时间及方式按时足额支付租金和所有其他应付款项。 9.1.2 若承租方为公司或任何其他形式之实体,且其将租赁单元提供给所指定的住客使用,则对于住客应向出租方所支付的任何款项,承租方承担连带责任。
9.2 禁止转租 未征得出租方之书面同意,承租方不得以任何形式将租赁单元的全部或任何部分转让或转租给任何第三方;也不得以任何形式与非为本协议一方之第三人分享租赁单元及其任何部分的实际占有权,无论该等人士是否为此付出了任何租金或其他酬金。 9.3 维持租赁单元现状 未征得出租方的书面同意,承租方不得改变租赁单元之现状,包括其中的装修、配备及装饰。
9.4 妥善使用租赁单元 9.4.1 承租方应按本协议的规定使用租赁单元,并应遵守相关法律法规的规定以及出租方或管理公司为管理整个公寓而制订的成文或不成文规定;
9.4.2 承租方应以善良居住人的身份合理使用租赁单元以及单元内的设施、装修及配备,并应保持租赁单元内部包括所有地面、门、窗户、玻璃、锁处于完好状态,以及所有设施、装修及配备的清洁和完好(但自然损耗除外);
9.4.3 保持租赁单元内的所有水喉、洗涤盆、橱柜、洗涤槽、水箱、下水道、管道、水管及仪器处于清洁及无阻塞的状态。
9.5 严禁结构性改建 未征得出租方的事先书面同意,不得对租赁单元的任何结构、窗户、墙 壁、天花板、梁或踢脚或任何其他部位作任何结构性改建或表面的改变;若已征得书面同意,则承租方应按经书面同意的条件自费在租赁单元内进行。
9.6铺设管道等 若出于管理或维护建筑物的一般目的或其他原因,出租方需要不时铺设管道,或出租方认为需要进行该等维修或其他工作时,应允许出租方或管理公司或他们所授权的人,在事先通知承租方的情况下,于白天合理的时间进入租赁单元检查房屋的状况、铺设或安装通向房屋或房屋中的所有管线包括水管、 煤气管、下水管、空调管道或电线箱、电缆箱及其他仪器箱、电力线和电话线。
9.7 允许出租方进入租赁单元 9.7.1 (1)若出租方为履行其在本协议项下的承诺或义务需要进入租赁单元或出租方需要对承租方所应负责的事项进行检查;或者
(2)出租方根据适用于租赁单元或建筑物的法律、法规的要求,或根据政府或其他法定权力机关所发布的任何命令或通知的要求,或为对建筑物进行必要的维修、改建或为了行使本协议项下的权力及授权需要进入租赁单元;
则承租方应允许出租方及其妥为授权的人士于合理的时间进入租赁单元,但若情况允许应事先通知承租方;
9.7.2 无论本协议规定如何,若情况紧急,则承租方应有权在任何时候进入该租赁单元,但出租方应于事后向承租方作出必要之说明。
