国际索赔——claim

国际索赔——claim VS complaint 的区别,以及国际claim的应对(下)续上⽂,这⾥以笔者的⼀个实际经历说明国际claim 的有效应对⽅法。
笔者曾经向意⼤利出⼝⽪⾰,每个⽉要运过去⼀到两个集装箱。
第⼀年没有出现任何问题,到隔年的某个⽉,国外⼀⼚商突然提出claim,⽽且⾦额⾼达3万美元。
笔者迅速找到国内⼚商,将此资讯与其理论。
国外⼚商提出了⽪⾰的⾊度不同、甚⾄有多处的割伤,附以照⽚为证。
国内⼯⼚则严正指出其货物绝不会这么差。
于是,笔者要求外商将损坏的⽪⾰寄回国内,在与国内⼯⼚⼏经研讨之后,终于发现了事实的真相,原来是意⼤利的进⼝商把每⼀批集装箱中允许的5%额度的损坏商品予以累计,继⽽进⾏的⼀次动作。
好在⼯⼚做了研究并得出了真实的结论。
于是,笔者直接和国外⼚商联系,告诉他们我们的研究结果,并以寄回来的⽪⾰判断出了其分别得出货时间。
说到这⾥,特别值得提出的事,当时的那个意⼤利商也是个不⼩的合作伙伴了,所以,我们既要据理⼒争点破事实的真相,⼜不能⾔词过于激烈,因为还要考虑到长远的合作关系。
笔者当时写了封既据理⼒争⼜充分顾及其⾯⼦的信过去,然后给他们打电话,嘻嘻哈哈⼀番。
果然,对⽅也以“嘻嘻哈哈”的语⽓回以“搞错了”,说是有员⼯把提出来的次货不⼩⼼混进了新货,才造成了误会云云加以解释,笔者当然会顺⽔推⾈的给他们台阶下,这件事情就算是过去了,后来还继续保持着良好的合作伙伴关系,同样的情况也再也没有发⽣过了。
后来听说类似的情况有发⽣在其他⼚商的⾝上,居然有⼈为了保持和外商的关系,真的进⾏了理赔。
所以当我们⾯对国际claim 时,⼀定以⼼平⽓和的⼼态,科学的⽅法,恰当的说辞,采取正确的实务处理⽅式。
希望观者可以举⼀反三。
关于说辞,笔者想多说⼏句。
有的出⼝商在得到claim 后,会回以“不可能啊,怎么⾦额这么⼤阿”之类的⾔语,这样往往会造成进⼝商的不悦,进⽽造成的恶果是之前建⽴的关系前功尽弃。
在经过研究得出外商在作假的结论时,也不要过于咄咄逼⼈,使别⼈恼羞成怒。
