因此，这往往会给大家带来困惑，就是这些词语之间到底有没有区别？区别是什么？事实上，关于obligation和duty的语义差别的讨论和混用，不仅纯粹发生在英文的领域内，与中文相关词语的混用也有一定关系。
概述Obligation的最初和核心的含义两个人之间的法律关系，一方“不得不”向对方实施某些行为（performance）。
而这种法律关系在多数法系下的主要构成是“债”（Law of Obligation) ，比如合同之债、侵权之债。
Obligation也指前面所述法律关系下一方必须要作的事，在这个意义上，obligation与duty是同义词。
Duty的含义比较广泛，除了legal duty，还moral duty等各种广泛意义上的duty。
从最初来说，obligation主要指legal duty。
但伴随着将obligation当作duty的同义词来使用，两者的边界逐减模糊，也出现了moral obligation等不同的用法。
Liability是由某种前因引起的后果，侧重的是从后果方面对责任的描述。
而这种前因，恰恰是某人具有的duty 或者obligation。
在先的义务到期或者被违反了，行为人需要为由此引起的后果承担责任,即liability。
而且，这种liability主要是以金钱形式的赔付为主，也即欠债或负债。
责任和义务在中文中，本来可以各自表达“被迫”和“自发、自愿”（实施某些行为）两个不同的含义，以互相进行区别，但在语言的发展之中逐减模糊了这种界限，变成了同义词。
义务，按其本义，是根据“义”的要求所要从事的行为。
在早期，“义”更多是一种道德上的要求，倡导人自发地去符合“义”的要求。
