一、合同的内容包括哪些条款(一)当事人的名称或者姓名和住所;(二)标的;(三)数量;(四)质量;(五)价款或者报酬;(六)履行期限、地点和方式;(七)违约责任;(八)解决争议的方法。

二、合同订立的程序是怎样的合同的订立是合同双方动态行为和静态协议的统一,它既包括缔约各方在达成协议之前接触和洽谈的整个动态的过程,也包括双方达成合意、确定合同的主要条款或者合同的条款之后所形成的协议。
前者如要约邀请、要约、反要约等等,包括先合同义务和缔约过失责任;后者如承诺、合同成立和合同条款等。
合同订立,指的是两方以上当事人通过协商而于互相之间建立合同关系的行为。
订立合同,是一个经过充分协商达到双方当事人意思表示一致的过程,在这个过程中的各个步骤构成了合同订立的程序。
根据《合同法》的规定和实践当中形成的习惯作法,订立合同的程序主要有:1、市场调查和可行性研究。
市场调查和可行性研究是当事人在签订合同前必不可少的准备工作。
2、资信审查。
当你选择了准备与对方谈判签订合同时,需要对对方进行资信审查。
资信审查包括资格审查和信用审查。
3、洽谈协商。
当事人之间就合同条款的不同意见经过反复协商,讨价还价,最后达成一致意见的过程就是洽谈协商。
4、拟定合同文书。
拟定合同文书是将双方协商一致的意见,用文字表述出来。
5、履行合同生效手续。
在合同文书拟定后,双方当事人已完全认可的时候,就要办理合同订立的最后一道手续,即双方当事人签字或者盖章。
首先由双方当事人的法定代表人或经办人在合同上签字。
其次,按照我国的习惯,要加盖单位公章或者合同专用章,合同订立的程序才算完成。
有的合同,根据国家规定需经有关部门审查批准的,则必须在有关部门审批后,才能正式生效。
