际货运代理案例案例一：选择承运人有误，货运代理承担责任某货运代理作为进口商的代理人，负责从A 港接受一批艺术作品，在120 海里外的B 港交货。
该批作品用于国际展览，要求货运代理在规定的日期之前于B 港交付全部货物。
货运代理在A 港接收货物后，通过定期货运卡车将大部分货物陆运到B 港。
由于定期货运卡车出现季节性短缺，一小部分货物无法及时运抵。
于是货运代理在卡车市场雇佣了一辆货运车，要求于指定日期之前抵达B 港。
而后，该承载货物的货车连同货物一起下落不明。
案例二：承运人施诈，货运代理受牵连承担责任某香港出口商发运一批半成品礼服到孟买，交易价格为CFR 。
他委托一货运代理代为履行发运事宜。
按照信用证要求，必须在1 月31 日前发货。
该货运代理向一关系较好的班轮公司订舱，该船期为1 月26 日到达香港，28 日启航。
但由于不可避免的原因，该船延误，于2 月2 日到达香港，船舶代理决定接受托运，但不同意货运代理的要求倒签提单以符合信用证的规定。
然而，一个非班轮公司的船舶恰好在泊，同意接受该批运至孟买的货物，运费率很低，且同意倒签提单。
这种承诺使货运代理很快接受，并且出口商也知道此情况，于是货物由该船装运。
然而此船舶并未抵达孟买，且用任何方法也无法查到其去向。
案例三：多式联运经营人对全程运输负责香港某出口商委托一多式联运经营人作为货运代理，将一批半成品的服装经孟买转运至印度的新德里。
货物由多式联运经营人在其货运站装入 2 个集装箱，且签发了清洁提单，表明货物处于良好状态下接收的。
集装箱经海路从香港运至孟买，再由铁路运至新德里。
在孟买卸船时发现其中1个集装箱外表损坏。
多式联运经营人在该地的代理将此情况于铁路运输前通知了铁路承运人。
当集装箱在新德里开启后发现，外表损坏的集装箱所装货物严重受损；另一集装箱虽然外表完好、铅封也无损，但内装货物已受损。
香港出口商要求多式联运经营人赔偿其损失。
问题：多式联运经营人对2 箱货损是否负责，如负责，其赔偿责任如何，可否享受责任限制？案例四：收取全程运费的货运代理须对全程负责印度孟买某电视机进口商与日本东京一厂家签订了货物买卖合同。

国际航运经典案件：FCR单证的法律性质及货运代理人的提单签发义务〖案情〗原告：绍兴县京成贸易有限公司被告：埃彼穆勒环球物流（上海）有限公司2007年11月，原告委托被告将两只集装箱装载的针织女式长裤出运至英国南开普敦港。
原告按被告的要求填写了货物托运单，载明要求正本提单3份。
被告收到托运单后，向原告发出确认单，在确认单右上角记载为FCR，该确认单记载的托运人、收货人、通知方同托运单一致，并载明包括订舱代理费等收费明细。
12月6日，被告签发FCR，上面记载有托运人、收货人、通知方等事项，记载内容与托运单相同。
另在FCR右下角的英文字样译文为“以下日期签署三份FCR，一旦其中一份被使用，其余即行失效”。
FCR背面记载：“除了另有注明，收到表面状况良好的货物将按照承运人的正式提单条款持有和运输；货物将在交货地交付给收货人，收货人在提货时不需要提交正本运输行货物收据。
一旦马士基物流公司收到托运人的货物，收货人可以全权处分该货物”。
被告接收货物后，委托NYK公司实际出运，在NYK公司签发的海运单上记载托运人为被告的宁波分公司，收货人为马士基物流公司，通知方为凤凰公司，起运港、卸货港、货物品名，数量和FCR相同。
原告收到FCR后，附于信用证交付银行结汇。
后因信用证不符点被银行退回，退单理由之一是未按信用证要求交付提单。
原告诉称，被告作为承运人，未向原告签发提单且擅自放货造成原告损失，请求判令被告赔偿货款损失。
被告辩称，其为收货人在起运港的收货代理人，依据与收货人之间的约定向原告签发FCR并无过错，且原告已经收到货款，并无实际损失。
〖裁判〗上海海事法院审理认为，原告向被告发放托运单，托运单上记载的事项可以证明原告对订立海上货物运输合同的要约，被告接受该托运单，向实际承运人订舱，并出运货物。
据此，原、被告之间的海上货物运输关系成立。
同时，涉案FCR记载的内容与提单格式几乎完全一致，可以表明原、被告对涉案运输合同具体事项已作出约定且已实际履行，FCR的内容，可证明原、被告之间海上货物运输合同关系成立。

外贸常用术语之信用证、货代
外贸常用术语之信用证、货代信用证信用证（Letter of Credit，L/C），是指开证银行应申请人（买方）的要求并按其指示向第三方开立的载有一定金额的、在一定的期限内凭符合规定的单据付款的书面保证文件。
信用证是国际贸易中最主要、最常用的支付方式。
付款申请：指申请付款给供货单位的书面单据形式，为了明细的表明付款的各项内容。
（如日期、部门、申请项目、申请金额、用途、审批人、经办人、部门经理、财务负责人、总经理）。
进行内部审批，然后财务照上面的单来付款。
名词解释信用证（Letter of Credit ,L/C)是指由银行（开证行）依照（申请人的）要求和指示或自己主动，在符合信用证条款的条件下，凭规定单据向第三者（受益人）或其指定方进行付款的书面文件。
即信用证是一种银行开立的有条件的承诺付款的书面文件。
以CIF价格为例在国际贸易活动，买卖双方可能互不信任，买方担心预付款后，卖方不按合同要求发货；卖方也担心在发货或提交货运单据后买方不付款。
因此需要两家银行做为买卖双方的保证人，代为收款交单，以银行信用代替商业信用。
银行在这一活动中所使用的工具就是信用证。
内容(1)对信用证本身的说明。
如其种类、性质、有效期及到期地点。
(2)对货物的要求。
根据合同进行描述。
(3)对运输的要求。
(4)对单据的要求，即货物单据、运输单据、保险单据及其它有关单证。
(5)特殊要求。
(6)开证行对受益人及汇票持有人保证付款的责任文句。
(7)国外来证大多数均加注：“除另有规定外，本证根据国际商会《跟单信用证统一惯例》即国际商会600号出版物（《ucp600》）办理。
”(8)银行间电汇索偿条款(t/t reimbursement clause)。
信用证三原则：一、信用证交易的独立抽象原则；二、信用证严格相符原则；三、信用证欺诈例外原则。
特点信用证方式有三个特点：一，信用证是一项自足文件（self-sufficient instrument）。
