被告辩护律师(Defense counsel)--在地方、州或联邦刑事诉讼案中代表被告的律师。
合众国宪法第六修正案规定: "在所有的刑事诉讼中,被告有权获得…律师帮助,为其辩护。
调查取证/证据开示(Discovery)--律师在准备庭审的过程中了解对方诉因的程序,包括要求调阅文件和听取口头证词。
证据(Evidence)--在法律程序中收到的("可采信的" )能够证明案情真相的一切事实。
证据包括实物证据(如武器、衣物) ,也包括非实物证据(如证人的证词)。
抗辩(Plea) --在美国刑事诉讼中,被告在第一次出庭或与治安法官见面时通常会提出“无罪"抗辩。
随后,根据具体情况,被告可将其改成“有罪"抗辩,承认他所受到的指控;他也可以继续坚持得到庭审的权利,由法庭,通常是陪审团,来判定他是否有罪。
在特定情况下,被告可以通过律师提出“因精神错乱而无罪" (not guilty by reason of insanity)的抗辩,辩方可据此证明被告因严重精神缺陷或障碍而不应对其行为负刑事责任。
抗辩交易(Plea bargain)--被告与公诉人达成的协议,被告同意认罪以求得从轻定罪或量刑。
预先听证(Preliminary hearing)--由一名治安法官确定是否有足够证据起诉被拘押人或将案件交由大陪审团判定是否下达起诉书的刑事听证。
量刑前调查(Presentence investigation)--通常由一位在法院任职的缓刑监督官对一名已被定罪的被告的背景进行的详尽调查,呈交给法官以帮助法官量刑。
调查报告应当客观分析被告及其罪行,突出能够决定量刑轻重的事实情况。
人身保护令(Habeas corpus)--将囚徒移送法院的一种古老的法律手段(亦作"writ of habeas corpus" ) ,通常用于判定政府拘押此人是,否有任何法律依据。
它至少可以追溯到1215年的英格兰,美国宪法中也有提及。
听审(Hearing)--法庭就一个具体事项接受证据或就一个法律问题听取辩论的司法程序。
听审可以在庭审或上诉之前、过程中或之后进行。
相当理由(Probable cause)--对一起犯罪行为已经发生、正在发生或将要发生的合理认定足以构成逮捕某人、进行搜查或没收财产的理由。
它往往比单纯的怀疑程度更强。
公诉人(Prosecutor)-在刑事诉讼中代表（地方、州或联邦)政府的律师。
检方主诉(Prosecutor' s case-in-chief)--在美国法庭上,通常先由公诉人陈述政府的立场,证据必须经得起各种推敲,如果未被辩护方驳倒,便可据此定罪。
如果证据不足,被告在检方主诉结束时有权请求作出无罪判决。
参见"请求作出无罪判决的动议" (Motion for judgment of acquittal ) 、"检方反驳" (Prosecutor s rebuttal case)。
请求作出无罪判决的动议(Motion for judgment of acquittal)-辩护律师要求法官在公诉人未能提出排除合理怀疑的证据证明被告有罪的情况下对被告作出无罪判决的请求。
这项动议通常在庭审初期检方主诉之后提出,如果被法庭驳回,可在检方反驳结束时再次提出。
检方反驳(Prosecutor' s rebuttal case--由于政府承担着推翻被告无罪推定的重大义务,政府
有权在被告进行辩护后进一步提出证据。
但如果被告不提出自己的证据,政府便无权反驳,因为没有需要反驳的新证据。
获得律师帮助的权利(Right to counsel)—合众国宪法第六修正案规定,每一位受到刑事指控的人都享有由一名律师协助辩护的权利。
能够负担律师费的被告可以雇用自己选择的律师,无力负担律师费的被告则由法庭从公共辩护人办公室或私人律师事务所指定一名律师为其辩护。
判刑(Sentence)-被告在被定罪后受到的刑罚,如罚款或监禁。
美国有35个州的法院和联邦法院有权将十恶不赦的谋杀犯或犯有叛国罪的人判处死刑。
第六修正案(Sixth Amendment)-阐明了被控犯罪的人在法庭上享有的多种权利,以使他们受到保护,并确保他们受到公平审判。
该修正案规定
“在一切刑事诉讼中,被告有权由犯罪行为发生地的州和地区的公正陪审团予以迅速和公开的审判；…得知控告的性质和理由；同原告证人对质；以强制程序要求对其有利的证人作证;并取得律师帮助为其辩护。
"
传票(Subpoena) –命令某人到法庭或大陪审团作证或呈交文件的令状。
证言(Testimony)--证人在法庭上宣誓后所提供的证词。
