Unit 4 Law and orderReadingThe rules of lawHave you ever wondered when and where the law originated? Around 12,000 years ago in the Middle East, small permanent farming communities were established, changing traditional nomadic hunter-gatherer lifestyles. Different groups were closely living together and dealing with unfamiliar behaviours, beliefs and attitudes. To prevent chaos and resolve conflicts, the rules of conduct and consequences for unacceptable behaviours were created. Hence, the concept of law was born. Many ancient civilizations arose in the Middle East, so it is not surprising that law codes first appeared there. The oldest discovered, the Code of Ur-Nammu, dates back to about 4,000 years ago. The code presented laws in the cause-and-effect format, a style used in nearly all later codes. Another one discovered, the Code of Hammurabi, was composed around 300 years later, which is one of the longest, best-organized and best-preserved legal texts. This code was among the first to implement the concept “innocent until proven guilty”. Both codes have features in common. For instance, they treated a variety of matters, but often ignored some important rules, because such rules were deeply grounded in custom.Over time, laws evolve to become more sophisticated and wide-ranging. Societies constantly transform, so legal systems respond accordingly and ensure laws remain relevant. This response happens in various ways. Outdated laws are abolished when they no longer correspond with the values or moral beliefs of the current society. The most famous example is the abolition of slavery laws in certain countries during the 19th century. Current laws are amended when aspects of a crime change, such as becoming more serious or producing additional crime-related behaviour. In Australia, a law amendment makes workplace bullying amount to a criminal offence. Besides, new laws are made as new situations develop such as those created by advances in technology or changes in societal attitudes. For instance, the advent of the Internet and social media has led to easier exchanges of information, and in turn has provided unauthorized access to personal data, so it is necessary to adopt a new law to strengthen the protection of online users’ private inform ation.Evolving laws may represent a progressive society, but legal systems tend to remain relatively stable. Notably, global legal systems fall into categories that share similarities, and two main categories are civil law and common law. In the civil law system, laws are created by the country’s legislature. Many European countries adopt this legal system. In the common law system, some laws are created by the legislature, but most are based on published court decisions from previous court cases, which are then implemented in future similar situations. The Unites States, the United Kingdomand Australia are examples of the common law system. The law plays an essential part in resolving conflicts, settling disputes and making rules that everyone must follow, yet it has limitations. As the law is not applicable to all situations, it is just one instrument to regulate society. Governments usually employ other methods of social control to help society operate in a smooth and integrated fashion. Moreover, the law is not always ready or able to adapt to the constant changes in the society it serves. Because of its relative stability, it is unreasonable for the law to solve every newly emerging problem. The law is more than just a set of rules as you have probably realized. It helps maintain security and stability in society, and its stable structure assists our societies to reach their full potential. The law is the compass that has guided humans from the first law-abiding communities to where we are today. As it continues to lead us into the future, the law will hopefully help us develop societies that are not just more harmonious but also more civilized.Extended readingThe Red-Headed League(Excerpt)Sir Arthur Conan Doyle (1859–1930) was a Scottish writer, whose best-known fictional character is the private detective Sherlock Holmes. The detective has the habit of paying attention to the smallest and seemingly insignificant details, which inevitably leads to him solving many mysterious crimes. “The R ed-Headed League”, narrated by Holmes’s friend, Dr Watson, tells the tale of a man with red hair who joins a club for red-headed men and thus unknowingly helps a crime take place.“You see, Watson,” he explained in the early hours of the morning as we sat over a glass of whisky and soda in Baker Street, “it was perfectly obvious from the first that the only possible object of this rather fantastic business of the advertisement of the Red-Headed League, and the copying of the Encyclopaedia, must be to get Wilson, this not over-bright pawnbroker, out of the way for a number of hours every day. It was a curious way of managing it, but, really, it would be difficult to suggest a better way. The criminal Clay’s clever plan was most certainly inspired by the colo ur of his accomplice’s hair. The four pounds a week was used to attract him, and what was it to them, who were playing for thousands? They put in the advertisement; one criminal has the temporary office and the other one convinces the man to apply for it. Together they manage to secure his absence every morning in the week. From the time that I heard of the assistant having come for half wages, it was obvious to me that he had some strong motive for securing the situation.”“But how could you guess what the motive was?”“The man’s business was a small one, and there was nothing in his house which could account for such careful preparations and such expenses. It must, then, be something out of the house. What could it be? I thought of the assistant’s fondne ss for photography, and his trick of vanishing into the cellar. Then I made inquiries as to this mysterious assistant and found that I had to deal with one of the coolest and most daring criminals in London. He was doing something in the cellar— something which took many hours a day for months on end. What could it be, once more? I could think of nothing except that he was digging a tunnel to some other building.“So far I had got when we went to visit the scene of action. I surprised you by beating upon the pavement with my stick. I was establishing whether the cellar stretched out in front or behind. It was not in front. Then I rang the bell, and, as I hoped, the assistant answered it. I hardly looked at his face. His knees were what I wished to see.You must yourself have noticed how worn, wrinkled and stained they were. They were evidence of those hours of digging. The only remaining point was what they were digging for. I walked round the corner, saw a bank connected to our friend’s property, and felt that I had solved my problem. When you drove home after the concert, I called upon Scotland Yard and the chairman of the bank directors, with the result that you have seen.”“And how could you tell that they would make their attempt tonight?” I asked.“Well, when they closed their League offices, that was a sign that they cared no longer about Mr Wilson’s presence—in other words, that they had completed their tunnel. But it was essential that they should use it soon, as it might be discovered, or the gold might be removed. Saturday would suit them better than any other day, as it would give them two days for their escape. For all these reasons I expected them to come tonight.”“You reasoned it out beautifully,” I exclaimed in genuine admiration. “It is so lon g a chain, and yet every link rings true.”“It saved me from boredom,” he answered, yawning. “I already feel it closing in upon me. My life is spent in one long effort to escape from the routines of daily life. These little problems help me to do so.”“And you are a benefactor of society,” said I.He shrugged his shoulders. “Well, perhaps, after all, it is of some little use,” he remarked.。

西方社会与法律英语Chapter 4

Chapter 4America Population and RaceⅠ. IntroductionThe United States of America is the third most populous country in the world after China and India, with a population of 300.5 million in January 2009. In the 1980s, population rose at an annual rate of 0.9%, against 1.7% in the 1950s, 1.3% in the 1960s and 1.1% in the 1970s.Do you know why America Population grew faster since 1950s?1, the World War Ⅱwas ended, people begun enjoy a peaceful life. the low birth rate in the two decades ending in 1945, the higher birth rate during the “baby boom” (1946-1964) 2, economic developments reached to a new level.3,mainly as a result of higher immigration. Immigration accounts for a major source of population growth. Almost 20 million people or 7.8% of the total population were immigrants in 1992. Of these, 8.7 million came to the United States during the 1980s. Net immigration (the number who came in minus the number who went out) since 1980 has made up about 30% of the total growth in population. The biggest populous cities in the United States:About 77% of the population in the United States lived in more than 283 city areas in 1988. There were 21 big cities with a population over 2 million. The biggest city was New York, with a population of over 18 million in 1990, which was followed by Los Angeles (14.5 million), Chicago (8.1 million), San Francisco (6.3 million) and Philadelphia (5.9 million). The biggest populous cities in China?1, Shanghai 1270 , 2, Beijing 1067 , 3,Chongqing 999, 4,wuhan 768, 5 ,Tianjin 752,6,Guangzhou 583, 7,Xian 497, 8,Shenyang 488, 9,Nanjing 480, 10 ,Chengdu 439, 11,Hangzhou 387Ⅱ. ImmigrationThe United States has long been known as a nation of immigrants. The first immigrants in American history came from England and the Netherlands, some running away from religious and political persecution, some coming as adventurers to seek a better life, some as indentured servants who had to work for a fixed term for their masters to repay the cross-Atlantic fare and debts.Though immigration had been a familiar aspect of American development throughout the colonial period, the largest immigration movement did not take place until 1815. In the hundred years between 1815 and 1917, no fewer than 30 million people, drawn from every corner of Europe, made their way across the Atlantic. They came in a series of waves, each more powerful than the last. The first of these waves began in the mid 1810s, grew steadily during the 1830s and 40s and reached the highest point in 1845.The second wave covered the period between 1860 and 1890.The third wave, the largest of the three waves, bringing to the United States a total of 15 million immigrants between 1890 and 1914, was drawn very largely from Austria, Hungary, Italy, Russia, Greece, Rumania and Turkey.Ⅲ. Multi-dimensional Population MovementMobility is one of the characteristics of the American people. It is said that the American people are always on the move from one part of the country to another, from one city to another, from farm to city, from the city to the suburbs. One in five Americans moves to a new home every year. Between 1980 and 1989, the South and West of the United States added 8.9 million people through net migration, that is, through more people moving in from other regions, while the North lost 2.7 million population as a result of more people moving out of the region.According to American historians and specialists in demography, there are four great population movements in the history of the United States. The first was between the end of the civil war and 1880 when the westward movement came to a halt. The second was between 1890 and 1920, a period when the United States realized its industrialization and urbanization. The main feature was the movement of population from the rural areas to cities. The third was from 1920 to 1960 , the war years, as the peak. In this period a large number of black people moved out of the south to other areas. The fourth and the last one so far is from the end of the 1960s till now. in this period, the population flow is from the Northeast and Central North to the West and the South, that is, to the sunbelt areas. Population in the South increased by 55.47% between 1960 and 1990, and population in the west increased by 88.17% in the same period.Another trend is the outflow of city residents from the core cities to the suburbs. The trend brings a number of serious consequences to big cities, namely, the rising unemployment rate, the increase of population beneath the poverty line, the worsening of living conditions and the fall of city government income.Ⅳ. Racial and Ethnic Minorities1. BlacksThe largest of the racial and ethnic minorities is the blacks, there are about 30.9 million, or 12.1 per cent of the population in the U.S. The first blacks were brought to North America as slaves in 1619. Within a few decades the demand for their cheap labor led to a large and profitable slave trade, some 400,000 Africans in all were brought to North America. For a long period of time they were concentrated in the agricultural South, working on plantations growing cotton and tobacco. Their life was no better than that of cattle. In order to keep the black slaves under control, the slave-owners resorted to brutal methods. Uncle Tom's Cabin and Roots are two novels giving a vivid description of the miserable life of the black slaves. The slave system was formally ended by Lincoln's Emancipation Proclamation in 1863. But even after the abolition of slavery, open or covert, organized or individual discrimination was practiced against black Americans. White and black people were separated in schools, housing, restaurants, sports facilities and other public places. A variety of methods were used to keep the black people from exercising their voting rights.Throughout most of their history in America, the black people put up a lot of resistance. Run-away was one form of resistance in the earlier period. In the 20th century, especially after the Second World War, the struggle of the black Americans began to draw greater attention and changes began to take place. The current situation of black Americans presents a mixed picture. On the one hand, theblack people enjoy more rights than ever before and legal, official discrimination has been abolished. But inequality and subtle discrimination still exist. In 1988, the average unemployment rate was 5.5% while the unemployment rate for blacks was as high as 11.7%. The poverty rate of the blacks is the highest among all racial and ethnic groups. In 1988, the poverty rate for the blacks was 32.4% while that for the whites was 10.1%.2. HispanicsThe Spanish-speaking population of the United States is a large, diverse and rapidly growing one. There were over 24 million people of Hispanic background, comprising 9% of the total population in 1992, but they were particularly important in New Mexico (38.2%), California (25.8%) and Texas (25.5%).3. White ethnicsTraditionally, the mainstream Americans were called WASPs, that is, White Anglo-Saxon Protestants. But actually there is a much greater variety of ethnic groups. Analysis of 1990 census data by ancestry groups shows that 13.1% of the U.S. population had English roots, 23.2% had German roots and 15.5% had Irish roots.4.Chinese-AmericansThe Asian-Americans are the fastest-growing racial and ethnic group in the United States. A government report said that between 1970 and 1980, the total population increased by 11% while the Asian-Americans grew by 141%.Most Asian-Americans are doing well in the United States. Experts say three Asian traditions best explain the success of Asian-Americans; education, hard work, and family. The Largest group of Asian-Americans are the Chinese-Americans. Most Chinese immigration to the United States took place between 1850 and 1880, when over 300,000 Chinese settled in America-chiefly in California. Many early Chinese immigrants in this period worked in the mining industry, especially in the gold mines. In the construction of cross-country railroads in the 1860s, Chinese labourers played an important role. In an interview in 1876, an interviewer said that four fifths of the work in the construction of the railroad from California to Ogden was done by Chinese labourers. Chinese labourers were underpaid but they did the hardest part of the work. In a letter to President Johnson on Oct. 10, 1865, Californian governor Stanford wrote, “without the Chinese labourers, it will be impossible to complete the western section of the national project within the time limit.”Many Chinese-Americans are doing fine today. According to statistics, in the 1980s, there were over 120,000 first-rate scientists and engineers in the United States, of whom 30,000 were Chinese descendants. Architect I.M. Pei, computer pioneer An Wang, Nobel Prize Winner Tsung-Dao Lee and Frank Yang are some of the best representatives.Key words1. ethnic 民族的,种族的2. populous 人口稠密的,人口众多的3. Do computer games increase tendencies to violence in children? There is a growing body of opinion that the high level of violence depicted in many computer games does have a deleterious ( 毒害身心的) effect on children, contributing to the observed increase in violent behaviour exhibited by juveniles.
ESRB three parts: rating symbols suggest age appropriateness for the game (on the front of the game box) content descriptors to indicate elements in a game that may have triggered a particular rating and/or may be of interest or concern (on the back of the game box); more detailed rating summaries that are available through the ESRB Web site.
8. About ESRB (Entertainment software Rating Board) a brief account: it’s a rating system to inform parents of games featuring violent and sexually oriented content. And this system divides games into 5 categories: EC, E, T, M, : AO Purpose: the system is not designed to keep mature games away from children, but to give parents the tools to determine what they do or don’t want for their children. Achievements: most people think the rating system is accurate.
3. reason: There are many violent cases like these existing in our life, children are just copying the very bad examples.
4. “the real-life consequences” in reality, if you commit a crime, you always pay for it. That is to say, you will be punished to some degree. You will even get a death penalty, sometimes, if it’s a very serious case. while in a game, you may just feel thrilled after killing a person (your component), and won’t be punished at all, sometimes, you can even get a reward for your killing.

11. Just like the soldiers and police officers trained to kill in combat, the kids are taught how to kill in the same way. It’s hard to refuse the effect of such violence due to the conditional reflex.
6. The rapid evolution of game technology will make it possible.
7. No. he only speaks for the games and his own benefits, maybe, never for the innocent children. So, in my mind, he is a selfish guy, or a person with little social responsibilities.
10. Contradictory attitudes: They trumpet educational games in helping develop kids’ learning skills. (the games have great influence on children.) They discount the baser influence on behavior and attitudes. (games have no influence on children) for example: there has no evidence to show that video games increase violence in children.
Questions for Comprehension 1. “when the killing occurred” means when he saw that the two boys were playing a bloody video game, in which, Mike, the friend of his 10-yearold son, killed an unarmed opponent. The scene of killing was very vivid, just like what is happening in the reality.
9. No. Children are still too young to make a good distinction between right and wrong, and they always have a strong desire to imitate what they think cool, so some unkind games should be kept away from the innocent children.
