(hereinafter IAE) demands from its suppliers to follow all the procedures laid down in the Suppliers Manual and these General Terms of Delivery (GTD). 1.2 By signing the Purchasing Agreement, making out a quotation on demand or confirming a price list, the supplier: a) confirms his agreement with all provisions and requirements of the Suppliers Manual (available at ) and these GTD, b) undertakes to organize his/her production process in compliance with all provisions and requirements referred to in the Suppliers Manual of IAE and to implement all the procedures laid down in it, c) agrees that the delivery note of delivery issued to IAE for an individual delivery guarantees that the supplied standard products fully comply with the provisions of the agreed national and international standards and that the supplied non-standard products and the shipment as a whole fully comply with the agreed requirements defined by the technical, control, commercial and environmental documentation of IAE.通过签署采购协议,根据需求做出报价或确认价格、供应商。

1/1/82INSTITUTE CARGO CLAUSES (A)RISKS COVERED1.This insurance covers all risks of loss of or damage to the subject-matter insuredexcept as provided in Clauses 4, 5, 6 and 7 below.2.This insurance covers general average and salvage charges, adjusted or determinedaccording to the contract of affreightment and/or the governing law and practice, incurred to avoid or in connection with the avoidance of loss from any cause except those excluded in Clauses 4, 5, 6 and 7 or elsewhere in this insurance.3.This insurance is extended to indemnify the Assured against such proportion ofliability under the contract of affreightment "Both to Blame Collision" Clause as is in respect of a loss recoverable hereunder. In the event of any claim by shipowners under the said Clause the Assured agree to notify the Underwriters who shall have the right, at their own cost and expense, to defend the Assured against such claim.EXCLUSIONS4.In no case shall this insurance cover4.1 loss damage or expense attributable to wilful misconduct of the Assured4.2 ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tearof the subject-matter insured4.3 loss damage or expense caused by insufficiency or unsuitability of packing orpreparation of the subject-matter insured (for the purpose of this Clause to termination of this insurance, the goods are to beforwarded to a destination other than that to which they are insured hereunder, this insurance, whilst remaining subject to termination as provided for above,shall not extend beyond the commencement of transit to such other destination.8.3 This insurance shall remain in force (subject to termination as provided forabove and to the provisions of Clause 9 below) during delay beyond the controlof the Assured, any deviation, forced discharge, reshipment or transshipmentand during any variation of the adventure arising from the exercise of aliberty granted to shipowners or charterers under the contract of affreightment.9.If owing to circumstances beyond the control of the Assured either the contract ofcarriage is terminated at a port or place other than the destination named therein or the transit is otherwise terminated before delivery of the goods as provided for in Clause 8 above, then this insurance shall also terminate unless prompt notice is given to the Underwriters and continuation of cover is requested when the insurance shall remain in force, subject to an additional premium if required by theUnderwriters, either9.1 until the goods are sold and delivered at such port or place, or, unlessotherwise specially agreed, until the expiry of 60 days after arrival of thegoods hereby insured at such port or place, 伦敦保险协会制定的海洋运输货物保险条款(Institute Cargo Clauses,简称 ICC)是全球范围内广泛应用的保险条款之一。
伦敦保险协会海洋运输货物保险条款主要包括以下三种基本险别:一、ICC(A)条款ICC(A)条款是三种险别中承保范围最广泛的一种。
它采用“一切险减除外责任”的方式来确定其承保范围。
这意味着,除了条款中明确列出的除外责任,ICC(A)条款对货物在运输途中可能遭受的任何风险和损失都予以承保。
ICC(A)条款承保的风险包括自然灾害,如地震、海啸、雷电等,以及意外事故,如船舶触礁、碰撞、沉没等。

二、ICC(B)条款ICC(B)条款的承保范围小于 ICC(A)条款。
它采用“列明风险”的方式来确定承保范围,即只对条款中明确列出的风险所造成的货物损失予以承保。

三、ICC(C)条款ICC(C)条款的承保范围是三种险别中最狭窄的。
它同样采用“列明风险”的方式确定承保范围,但所承保的风险种类相对较少。
ICC(C)条款承保的风险包括火灾、爆炸、船舶或驳船触礁、搁浅、沉没或倾覆、陆上运输工具倾覆或出轨、船舶、驳船或运输工具同水以外的任何外界物体碰撞、在避难港卸货等。
协会货物条款B
被保险货物到达该港或该地届满60天,二者以孰先发生者为准。
9.2 如货物在上述60天内(或在任何协议延长之期间内)运往本保险
所定其他目的地时,本保险之效力依上述第8条之变更目的地,应立即通知保险人,使本保险 航程变更条款 继续有效,但须另行确定保险费及条件。

理赔
11. 11.1 被保险人在损害发生时,须对保险标的物具有保险利益,始能要求 本保险之赔偿。
11.2. 依上述 11.1 之约定,被保险人对保险期间内所发生之保险标的物 之损失,有权利要求赔偿,即使损失发生于保险契约签订之前亦 同,但被保险人知道损失已经发生而保险人不知者,则不在此限。

4. 本保险在任何情况下均不承保下列事项: 4.1 归因于被保险人之故意不当行为所致之毁损灭失或费用。 4.2 保险标的物之正常漏损、重量或容量之正常减少,或自然耗损。 4.3 由于保险标的物之包装或配制不固或不当所致之毁损灭失或费用(本 条款 4.3 所指之「包装」包括集装箱或底盘内之堆放,但此项堆放以 完成于本保险生效前或由被保险人或其受雇人所为者为限)。 4.4 由于保险标的物之固有瑕疵或性质所致之毁损灭失或费用。 4.5 直接由于迟延所致之毁损灭失或费用,即使此项迟延系因承保危险所 致者。(但上述第2条可支付之费用不在此限)。 4.6 因船舶所有人、经理人、承租人或营运人之无力偿债或财务失信所引 起之毁损灭失或费用。 4.7 由于任何人之恶意行为对保险标的物全部或部分的故意毁损或破坏。 4.8 由于使用核子分裂或融合或其他类似反应或放射能,放射性物质之武 器所 引起毁损灭失或费用。

第4节 伦敦保险协会海运货物保险条款在国际货物运输保险业务中,伦敦保险协会制定的“协会货物条款”(1nstitute Cargo Clause简称I.C.C.),对世界各国保险业有着广泛的影响。
一、I.C.C.(A)险的责任范围及除外责任(一)I.C.C.(A)险的责任范围根据伦敦保险协会对新条款的规定,I.C.C.(A)采用“一切风险减除外责任”的办法,即除了“除外责任”项下所列风险保险人不予负责外,其他风险均予负责。
(二)I.C.C(A)险的除外责任I.C.C.(A)的除外责任分列为四类:1.一般除外责任如归因于被保险人故意的不法行为造成的损失或费用;自然渗漏、自然损耗、自然磨损、包装不足或不当所造成的损失或费用;直接由于延迟所引起的损失或费用;由于船舶所有人、租船人经营破产或不履行债务所造成的损失或费用;由于使用任何原子或核武器所造成的损失或费用。
2.不适航、不适货除外责任指保险标的在装船时,如被保险人或其受雇人已经知道船舶不适航,以及船舶、装运工具、集装箱等不适货,保险人不负赔偿责任。
3.战争除外责任如由于战争、内战、敌对行为等造成的损失或费用;由于捕获、拘留、扣留等(海盗除外)所造成的损失或费用;由于漂流水雷、鱼雷等造成的损失或费用。
4.罢工除外责任罢工者、被迫停工工人造成的损失或费用以及由于罢工、被迫停工所造成的损失或费用等。
二、I.C.C.(B)险的责任范围和除外责任(一)I.C。
C.(B)险的责任范围(B)和(C)险规采用“列明风险”的方法,即在条款的首部开宗明义地把保险人所承保的风险一一列出。
I.C.C.(B)险承保的风险是:(1)火灾或爆炸;(3)船舶或驳船搁浅、触礁、沉没或倾覆;(3)陆上运输工具的倾覆或出轨;(4)船舶、驳船或运输工具同除水以外的任何外界物体碰撞;(5)在避难港卸货;(6)地震、火山爆发、雷电;(7)共同海损牺牲;(8)抛货或浪击落海;(9)海水、湖水或河水进入船舶、驳船、运输工具、集装箱、大型海运箱或贮存处所;(10)货物在装卸时落海或摔落造成整件的全损。

船舶或驳船不适航;船舶、运输工具、集装箱或大型海运箱不适宜安全运载保险标的。
假如保险标的在装载时,被保险人或其受雇人明白这种不适航和不适当的情形。
5.2保险人舍弃船舶必须适航和适宜将保险标的运往目的地的默示担保,除非被保险人或其受雇人明白这种不适航或不适宜的情形。
