欧盟农产品进出口政策解读文章来源:中国县域经济报编者按:近年来我国农产品出口持续增长,2005年农产品出口达到272亿美元,居世界第五位。

但是国际农产品市场瞬息万变,多边农业贸易规则和各国农产品贸易政策不断调整,进口检验检疫要求和技术性贸易壁垒持续增加。

目前我国农产品出口企业近1.8万家,其中年出口金额1000万美元以上的不足500家,而年出口低于100万美元的中小企业超过1万家,占全部出口企业总数的70%以上。

这些企业特别是县域中小企业进入农产品出口市场时间短、经营规模小、抗风险能力弱、信息渠道不畅,特别需要政府部门提供农产品出口政策、市场方面的信息。

为帮助我国农产品出口企业及时迅速准确掌握国际农产品市场信息,帮助企业开拓农产品出口市场,从本期起我们陆续刊登国外农产品进出口政策和信息。

农业生产情况欧盟土地资源丰富,食品的生产可以自给自足。

2005年,欧盟农业和渔业的产值只占其GDP的2.5%,但欧盟仍然是一个主要的食品出口地区,也是世界最大的食品进口地区。

25国食品及农产品进口占所有商品进口的比例为6.4%,食品及农产品出口占所有商品出口的比例为6.5%,进出口大致相当。

但欧盟25国进口额总体上大于出口额,2003年的贸易逆差为21.59亿欧元。

欧盟农业生产具有多样性的特点,生产的主要农产品包括家畜、谷物和奶制品,这三类产品的产值占到欧盟农业产出的近一半。

另外,其他重要的农产品有葡萄酒(是世界上最大的葡萄酒生产地区)、新鲜蔬菜和水果、蛋和禽等。

大田作物的种植在欧盟占有重要的地位,其包含的范围很广阔,主要指一些重要的一年生作物,包括小麦、大麦、玉米、黑麦、菜籽、向日葵、豌豆等。

大田作物的种植占了欧盟耕种面积的40%。

1992年以来,大田作物被列入欧盟基于面积的支持体系,也适用于对退耕土地的“休耕”措施,对大田作物的支持是欧盟预算中最多的一项,因此,也是欧盟共同农业政策改革中影响最大的。

欧盟谷物产品的内部价格高于世界价格,导致了欧盟对谷物产品提供大量的出口补贴。

近年来,欧盟有机农业发展非常迅速。

上世纪80年代初,由于消费者对健康和营养的日益关注及其环保意识的不断增强,欧盟的有机食品市场开始发展起来。

当前,欧盟已经成为世界上最大的有机食品消费市场。

农村发展政策农村发展问题是欧盟共同农业政策的一个大的部分。

欧盟预算增加的部分也主要用于农村的发展。

欧盟扩大后,超过一半的人口居住在农村地区,而农村地区覆盖了欧盟90%的区域,这使得农村发展成为欧盟基础性的重要政策。

当前欧盟的农业政策已经从支持农业生产转向对生产者的直接支付,面向农业的可持续发展。

致力于食品安全、食品品质、产品多样性、动物福利、良好的环境、保持自然和乡村景观。

欧盟的农业国内支持政策欧盟的共同农业政策是通过共同市场组织、产品共同价格制度、欧洲农业指导和保证基金EAGGF得以实施的。

具体来说,就是对内统一农产品市场和价格、建立共同农业基金、对农产品出口予以补贴;对外则设置随市场供求变化而调整的差价税、配额等贸易壁垒,使欧盟农业免遭外部廉价农产品的竞争。

这些机制一方面为欧盟共同农业政策的实施提供了强有力的保证,同时也使其具有高度保护性。

农产品贸易情况欧盟使用出口补贴来支持其农产品的出口。

补贴的数量从1992年占农业出口值的55%下降到2001年的5.2%。

从绝对数额来说,从100亿欧元下降到了28亿欧元。

在多哈回合农业谈判中,欧盟和大多数的WTO成员国承诺取消任何形式的出口补贴。

然而,欧盟仍然使用的出口补贴对贸易产生了影响。

为帮助欧盟出口企业占领“第三国”市场,提供政策、信息服务及资金上更加充分的保障,以巩固、扩大欧盟农产品在国际市场中的份额。

1999年1月,欧盟委员会正式向欧盟理事会提出农产品贸易促进项目建议,建议制定欧盟范围内协调一致的贸易促进政策,推动农产品出口,为出口企业提供信息服务以及开展各类商业活动提供每年约为1500万欧元的经费支持。

2004年9月24日,欧盟批准了本年度第一批海外促进项目8个。

2004年项目涉及的“第三国”目标市场分别为美国、加拿大、日本、俄罗斯、中国、澳大利亚等6个国家或地区;所涉及的产品有葡萄酒、水果及蔬菜、橄榄油、马铃薯和地中海特色产品;项目总预算1009万欧元,欧盟投入项目资金503万欧元。

进口管理政策进口程序尽管欧盟25个成员国适用统一的《海关法典》及其实施条例,但是欧盟有关海关和关税方面的法律授予各欧盟成员国海关主管机关许多自由裁量权。

这导致各成员国的海关管理不统一。

首先,各欧盟成员国海关对产品的分类和估价,以及分类和估价的程序不一致,包括提供给进口商的相关信息不一致。

其次,进出口货物的程序不一致。

例如,有些欧盟成员国使用自动进出口货物程序,有些不使用,对原产地证明的要求不同,对实施检查的标准不同;进口食品时的许可要求不励处理速递装船的程序也不同。

违反海关规则后的罚金和缴纳罚金的程序不同。

关税管理措施欧盟实行共同关税制度,执行统一关税税率和管理制度。

欧盟理事会第Council Regulaton2913/92号规章规定,进口关税由货物的税则归类及价值决定。

成员国在欧盟内实行关税同盟,也就是从第三方进口的货物,在欧盟内实行统一的关税。

一旦某种进口货物在某成员国清关后,即可在欧盟内部自由流动。

欧盟对大部分产品适用从价税税率,对部分农产品等适用复合税、混合税或其他技术性关税的非从价税税率。

对部分农产品设置了包括季节性关税在内的多种技术性关税。

2005年,欧盟税率低于10%的产品占总数的79%,其中,零关税产品占总数的27%,欧盟扩大后,除了匈牙利和马耳他遵循过渡性安排外,其他新成员国自加入之日起执行统一对外关税,总体上,10个新成员国按贸易量加权的平均关税水平从9%降至4%。

1.关税高峰。

2005年,欧盟对肉类、蔬菜、水果、植物油、食品、饮料、烟草、纺织品等的进口仍维持关税高峰。

除烟丝和卷烟的从价税税率分别高达74.9%和57.6%外,上述产品中还存在许多以非从价税方式征收的高关税。

中国向欧盟大量出口的蔬菜、水果、鱼肉、食品、烟草等农产品属于欧盟关税高峰涉及的产品范围。

2.季节性关税。

2005年,欧盟对番茄、橙子、柑橘、葡萄、苹果、梨、杏、樱桃、桃和梅等产品征收季节性关税。

除对番茄、橙子在不同季节以复合税方式征收季节性关税外,欧盟对上述其他产品以从价税、复合税和混合税等不同方式征收季节性进口关税。

另外,欧盟对上述大部分产品公布了标准进口价值,并对其频繁修改。

这一做法导致计税方式复杂,税率多变。

由于中国向欧盟大量出口上述产品,欧盟复杂多变的季节性关税导致中国企业在对欧出口时面临更多的不确定性。

3.其他技术性关税。

欧盟在对部分糖产品、可可食品、饼干、面包、马铃薯征收进口税时,不仅以从价税征收部分进口关税,还根据其农业成分的不同含量(如无水乳脂肪、乳白、蔗糖、淀粉)附加征收部分关税。

欧盟每年公布一次具体征税办法。

以农业成分作为计算关税参数的征税方式具有较大的不可预见性,增加了企业的出口风险。

2004年欧盟的简单平均关税税率(MFN)为6.5%,关税的范围从0到209.9%。

农产品的关税税率是最高的。

2004年从价税占到90%,其余10%为非从价关税。

非从价税一般用于农产品,关税配额平均为67%。

农产品(WTO定义的)是受关税保护程度最高的,平均关税率为16.5%,而非农产品的平均关税率只有4.1%。

关税水平最高的产品包括:乳清及含原乳成分的产品(209.9%);牛、猪、绵羊、山羊、马、驴、骡的可食用杂碎(192.2%);绵羊及山羊肉(鲜的、冷藏及冷冻的)(172.9%);大蒜(150.1%);冷冻牛肉(149.9%);蘑菇(134.5%);猪肉(鲜的、冷冻及冷藏的)(120.8%);香蕉(包含大焦)(118.1%);木薯(117.9%);甜菜糖(114.4%);活牛(107.8%);牛奶及乳酪(103.3%);稻米的粗粉及细粉(101.1%)。

欧盟在农产品上的关税配额共有89项,配额管理办法分别为:由欧盟委员会来用“先来先用”方法管理的为20项;根据“以往进口”管理的22项;采用混合方法管理的47项。

每年的配额使用率平均为67%。

在2002/03年,以下产品的进口充分使用了关税配额:活绵羊和山羊、绵羊及山羊肉、分割禽肉、黄油、干酪、个别水果(苹果、梨、葡萄、樱桃和杏)、蔬菜(马铃薯、胡萝卜、甜椒)。

没有充分使用配额的为小麦、猪肉、麸皮、红薯。

世界银行最近的一项研究表明,欧盟受关税配额保护的农产品占到38%。

对于受配额管理的产品的进口需要进口许可。

欧盟健康和消费者保护委员会委员负责人表示,出台新条例的主要目的是为了“减少动物在海陆运输过程中所面临的压力和危害”。

新条例规定,运载动物超过8小时以上的交通工具必须进行升级,并且必须具备能够保证车船内气温利于动物保持健康的技术。

新规还禁止运输将在一周内生产的雌性动物。

欧盟修订饲料用奶及奶制品加工标准欧盟于2006年11月29日发出通报,告知欧盟修订了饲料用奶和奶制品加工标准。

修订案要求进口饲料用牛奶和奶制品必须经下列方式之一进行处理:(1)最低F03级杀菌处理;(2)高温短时(HTST)处理两次;(3)高温短时处理与下列两种方式相结合使用,a.物理方式,包括:产品在干燥处理中额外加热到72℃或以上;或PH值降至6以下持续一日。

b.奶制品是在装运前21天生产的,在此期间,来源国没有发生口蹄疫;符合上述条件的饲料用牛奶和奶制品可批准进口。

该修订标准将于2007年3月底生效。

欧盟制定新的干预玉米质量标准近日,欧盟委员会制定了新的干预玉米的质量标准。

新标准规定,干预玉米的最高水分含量为13.5%,相比之下,早先为14.5%;最低容重为71公斤/百升。

碎粒率定为5%,相比之下,早先为10%。

过热粒率为0.5%,相比之下,早先为3%。

该质量标准已于2006年11月1日起开始实施。

■贸易术语关税 (Customs Duty)关税是进出口商品经过一国关境时,由政府所设置的海关向进出口商所征缴的税收。

因此,它是一种国境关税。
