• 因客户对花生的内包装不太满意,决定使用自己 的包装袋,于是在合同的包装条款中附带了一句 “内包装由港方提供。”3月20日签约后的14天, 港方开来信用证,审核无误后即组织加工,同时 催促对方抓紧发送包装袋。

• 4月15日加工完毕,包装袋仍未到,在多次催促以后,包 装袋于4月24日到货。出口方立即组织装袋打包,但仍未 赶上4月28的船期,而下一班船是5月8日,超过信用证规 定的交货期。
• 在我国出口危险货物的包装上,要标打我国和 国际海运所规定的两套危险品标志。
4、附加标志(supplementary marks)
• 附加标志(supplementary or additional marks) :有 关当局要求的正式标志,一些国家要求商品包装上标明原 产地、重量和尺寸。
• 如:
生产国别,也无商标牌号。 (2)定牌中性包装:不注明生产国别,但有
买方指定的商标或牌号。
中性包装
• 出口业务中接受中性包装,应注意以下几点:
(1)应审查外商提供的图案、文字内容有无不 妥之处,如若与我社会主义的精神文明标准 相悖,则不应接受。
(2)应向外商指出,如若我们采用买方指定的 商标、牌号后,在国外市场上发生工业产权 的争议或侵权行为,则一切责任应由买方负 责。
问:该索赔是否合理?
• 该索赔合理。
• 在国际贸易中,卖方交付货物的包装必须与合同 规定的包装条件完全相符,若合同规定出口货物 为散装货(bulk cargo),则货物就不应采用麻 袋包装,即使卖方不另外加收麻袋包装费,也属 于违约行为,买方可以卖方交货的包装条件不符 合合同的规定而提出索赔。

某出口公司与外商签订合同:出口大米1000公吨, 麻袋包装,每袋100公斤,以装运数量条件计价,信用 证支付。在如下价格条款的情况下,若实际装运数量 为970公吨(9700袋),是否允许? 1. 每公吨USD300 F.O.B 中国口岸。 2. 每袋USD30 F.O.B. 中国口岸。
所谓F.A.Q,是指一定时期内某地出口货物的平均品质水平, 即指中等货。

The packing clause should clearly stipulate the packing material, manner of packing, packing specification, packing expenses to be borne, shipping marks and so on. The stipulations about packing should be definite. The part who is to bear the packing expenses should be specified.

Indicative mark refer to the symbols or words that indicate the nature of the contents of the package and give instructions to facilitate the smooth handling of the cargo that needs special care. For products which are fragile, prone to be damaged, prone to deteriorate. Indicative marks are usually comprised of simple graphs and words.
