DefinitionsShipper : A person or company that in his (their) own name or a third party one, contracts transportation services for hazardous materials or wastes.Carrier: A person or company duly authorized to provide public or private cargo transportation specialized in hazardous substances, materials and wastes.Container: An element of the transportation equipment of mobile characteristic and sufficiently strong to be used repeatedly and designed to facilitate transportation of goods by one or various modes of transportation.Shipping Document: Is the document that contains information for the correct official designation for transportation, identity of the hazardous substances, materials and wastes, their risks and the declarations expressed by the shipper for its transportation.Shipping Agent: A person or company that on his own or for a third party, generates a shipment of hazardous substances, materials and wastes.Multimodal Transportation: A designation for at least two different means of transportation of goods. Through a contract for Multimodal Transportation, the operator takes the goods from a place of origin under custody all the way to other location for its delivery.Unit: A vehicle consistent of a motor unit and a trailer, for the transportation of hazardous materials, and wastes.Vehicle: A mean for the land, air and sea transportation.Railroad Company: A company or organism authorized by the Federal Government to operate the transportation by train and provide auxiliary services.Hazardous Substance: Every element, composite, material or their mixture that independently of its physical state, represents a potential risk to the health, the environment, the safety of the users and the property of third parties. Biological agents that may cause diseases are also considered under this definition. Hazardous Waste:All those wastes, in any physical state, that due to its corrosive, toxic, poisonous, reactive, explosive, flammable, biologically infectious or irritant characteristics, represent a danger for the ecological balance or the environment.Emergency Help Package: It is a special case or package destined to contain hazardous substances, materials and wastes that have been damaged, that evidence leakage, defects or spills, in order to transport them for its recovery or elimination.Remittance: The action of remit, send a set of things, specially goods that are remitted only once.Consignee: A person or company that receives hazardous materials and wastes.Waste Generator: A person or company that through an extraction, benefit, transformation, production, use, utilization, control or treatment activity, produces a hazardous waste.Non-043-SCT/2003 Page 65. Specifications A shipper offering hazardous substances, materials and wastes for itstransportation, must describe them in a Shipping Document and provide all the information and documents that specifies the characteristics of them.The Shipping Document utilized in the transport of hazardous materials transported by railroad, may be of red color by each railroad car or have a mark that is different by contrast or form to the Shipping Document, from the rest of the non hazardous goods that may be transported in the train.In the case of hazardous materials of a single class in unitary trains it must be indicated by the number of the initials and number of units being trailed.The Shipping Document must contain the correct information, indispensable and necessary to identify the hazardous substances, materials and wastes. In it, they will be described, being permissible to utilize complementary sheets containing all the required information and all of them shall be numbered consecutively, in order to make its identification easy, visible and lasting. The Document must have the names and addresses of the manufacturer, shipper or generator, carrier and consignee, as well as the date of issuance and all other information required in this Standard and should contain the following data:The Shipping Document for Hazardous materials and wastes may adopt diverse formats as long it contains all the information required in this Mexican Official Standard.Description of the Hazardous substances, materials and wastes.In the Shipping Document it must be detailed the following information about the hazardous substances, materials and wastes, offered for its transportation:The Shipping Document must bear the identification number of the United Nations, preceded by the letters “UN”Official transportation designationT5.1.2.1The official transportation designation is considered as the part of the denomination thatdescribes more exactly the hazardous substances, materials and wastes, and that appear inupper case lettering on Standard NOM-002-SCT, List of hazardous substances, materials andwastes more usually transported, in some cases with numbers, Greek letters, or the prefixes“se c”, “terc”, m, n, o, p, that are integral part of the designation. Sometimes, between brackets,another official transportation designation is given, following the principal designation. Forexample: ETHANOL (ETHILIC ALCOHOL). Parts of a denomination that appear in lower caselettering cannot be considered elements of the official transportation designation, except on theindications “sec-“, “terc-“, “m-“, “n-“, “o-“ and “p-“, but it may be utilized.5.1.2.1.2 It must be proceeded with great care at choosing the part of the denomination thatappears on the list or on the index that will constitute the “official transportation designation” ofa hazardous substance and that it will be in conformity with to what is established on NOM-002-SCT. The parts of that denomination appearing in lower case lettering, must not be consideredas elements of the official transportation designation. When there are conjunctions as “y” or “o”in lower case lettering, or if some elements of the official transportation designation areseparated by comas, it is not necessary to show that official designation as a whole in theShipping Document or in the markings of the packages and packagings. This is the case,particularly, when a combination of several different denominations are shown with a single UNnumber.NOM-043-SCT/2003 Page 7The following examples, show how the official transportation designation must be chosen in such cases:a) UN 1057 LIGHTERS or LIGHTER REFILLS.- The most appropriate of the two followingones should be chosen as the official transportation designation:LIGHTERSLIGHTER REFILLSb) UN 3207 ORGANOMETALLIC COMPOUND or COMPOUND SOLUTION orCOMPOUND DISPERSION, WATER-REACTIVE, FLAMMABLE, N.O.S. As official transportation designation it may be utilized the best of the following possible combinations:ORGANOMETALLIC COMPOUND WATER REACTIVE, FLAMMABLE, N.O.S.ORGANOMETALLIC SOLUTION WATER REACTIVE, FLAMMABLE, N.O.S.ORGANOMETALLIC DISPERSION WATER REACTIVE, FLAMMABLE, N.O.S.The previous, complemented by the technical name.5.1.2.3 The official transportation designation may be utilized either in singular or plural, according to the case. On the other hand, if it forms part of it in terms that delimitate its sense, the order of these in the documents or in the marking of the packages and/ or packagings is facultative. For example: “DIMETHYLAMINE AQUEOUS SOLUTION” May be annotated also as “DIMETHYLAMINE AQUEOUS DISOLUTION”. For substances of class 1 explosives, commercial or military names can be utilized, containing the official transportation designation complemented with a descriptive text.5.1.2.4 When the name indicated on NOM-002-SCT is shown in upper case lettering, to the official transportation designation will be added with the adjectives “LIQUID” OR “SOLID”, according to the case. For example: DINITROTOLUENES, LIQUID; DINITROTOLUENES, SOLID.5.1.2.5 When the name indicated on NOM-002-SCT is shown in upper case lettering, it will be added the word “MOLTEN” to the official transportation designation when a substance is solid and is offered for its transportation in liquid state as a consequence of a fusion. For example: ALKYLPHENOLS SOLID, N.O.S., MOLTEN.5.1.2.6 Save for substances of spontaneous reaction and organic peroxides and unless it is already shown in upper case lettering in the name indicated in NOM-002-SCT, the word “STABILIZED” will be added as part of the official transportation des ignation of a substance that without stabilization, would be forbidden for its transportation, such as the ones that may explode, react dangerously, produce a flame or dangerous heat projection, or a toxic, corrosive or flammable gas or vapor emission, in normal transportation conditions. For example: “TOXIC ORGANIC LIQUID, N.O.S., STABILIZED”.When the stabilization of these substances is done through regulation of temperature with the purpose of stopping the appearance of an excess of pressure that may result dangerous, then: a) If it’s about liquids with a auto accelerated decomposing temperature (AADT) of less than 50°C, provisions contemplated on NOM-027-SCT2, General provisions for the package, packaging and transport of the hazardous substances, materials and wastes of division 5.2 organic peroxides, will be applied.NOM-043-SCT/2003 Page 8c) When it’s about gases the conditions for transportation must be approved by thecompetent authority.5.1.2.7 Hydrates may be transported under the official transport designation that corresponds to the anhydrous substance.5.1.2.8Generic official transport designations and “not otherwise specified”, to which have been assigned special provision 274 on column 6 of NOM-002-SCT, must be completed with the technical or chemical name of the substance. The technical name and of the chemical group will be shown in brackets immediately after the official transportation designation; also, adequate expressions, such as “contains” or “containing” or other qualifications like “mixture”, “solution”, etc., along with the percentage of the technical component may be used. For example: “UN 1993 FLAMMABLE LIQUID, N.O.S. (contains xylenes and benzene), 3, GE II”:5.1.2.9 The technical name will be a recognized chemical name or any other name that is of common use in manuals, periodical publications and scientific or technical text books.. No commercial names will be used. In the case of pesticides, only common names from ISO maybe used, as well as the other names mentioned on the Recommended Classification of the WHO, or the names of the active substances or the ones used in Mexico by CICLOPAFEST.5.1.2.10 I n the case of mixtures of hazardous substances described with one of the “gener ic denominations”or “N.O.S.” to which it has been assigned special provision 274 in column 6 of NOM-002-SCT, it will only be necessary to indicate the two components that are mayor contributors to the creation of the risk or risks of the mixture, a provision that is not applicable to controlled substances as far as its divulging is prohibited. If a package or packaging containinga mixture carries a subsidiary risk label, one of the two technical names shown in brackets willbe the component that forces the use of subsidiary risk label.5.1.2.11 The following examples describe how the official transportation designation should be chosen, together with the technical name, in the case of substances that carry the N.O.S. indication:a) UN 2003 METAL ALKYLS, N.O.S. WATER REACTING, N.O.S. (TRIMETHYLGALIUS)b) UN 2902 LIQUID PESTICIDE, TOXIC, N.O.S. (DRAZOXOLON)5.1.2.12 Mixtures and solutions containing a hazardous substance.Every mixture or solution containing a hazardous substance expressly mentioned byits name on NOM-002-SCT, and one or several substances not subject to Regulations, will be classified with arrangement to the provisions formulated with respect to the hazardous substance in question, conditioned to that the package or packaging be appropriate to the physical mixture or solution, save for the following cases:a) The mixture or solution appears expressly by its name in the Regulation.b) On the pertinent epigraph of the Regulation it is signaled on a explicit manner thet thedenomination refers to the substance in its pure state.c) The class of risk, the physical group or the packaging group of the mixture solution aredifferent to those of the hazardous substanced) The measures to be adopted in case of emergency are considerably different.5.1.2.13 for the solutions and mixtures that are classified according to the provisions relative tothe hazardous substance, the word “SOLUTION” or “MIXTURE” will be added forexample, to the official transportation designation, according to the case, for example: “ACETONE, SOLUTION”NOM-043-SCT/2003 Page 9The concentration of the solution or mixture can also be indicated, for example:“ACETONE, SOLUTION AT 75%”5.1.2.14 The mixture or solution containing one or several substances expressly mentioned inthe Regulations or classified on a N.O.S. and one or various substances not subject to theRegulations, will be exempt from the application of the latter, if the risk characteristics of themixture or solution are such that they do not satisfy any class’s criteria. (including the criteria ofhuman experience).5.1.3 The Class or when applies, the substance Division.The Class on when so applies, Division of the substances. If it’s about hazardous substances,materials or wastes of class 1, explosives, it will be indicated immediately after the division, thecompatibility group letter. The number(s) of class or division of subsidiary risk, will be shown inbrackets after the numbe r of risk class or division. The words “Class” or “Division” may beincluded before the primary or subsidiary risk class or division.5.1.4 Once the packing group corresponding to the substance has been assigned .Once the packing group corresponding to the substance has been assigned, that it may go preceded by the letters “PG” (for example: “PG II”)5.25.2 The order in which the elements of the description of the substances, materials and wastes,must appear.The order in which the elements of the description of the substances, materials and wastes,may follow the order 5.1.1, 5.1.2, 5.1.3, 5.1.4 or 5.1.2, 5.1.3,.5.1.1, 5.1.4 without any interposedinformation. For example:“ UN 1098 ALLYL ALCOHOL 6.1 (3) I”“ALLYL ALCOHOL 6.1 (3), UN 1098, I”Besides the described requisites, other information elements may be required by the competentauthority, or by certain modes of transportation (for example, flash points for the transportationby sea). Unless permitted or required by the Regulation, complementary information will beplaced after the description of the hazardous substances, materials or wastes.5.3 Any additional information to the official transportation designation in the description off thehazardous substances, materials and wastes.5.3.1 The additional information to the official transportation designation in the description ofthe hazardous substances, materials and wastes, must be complemented by the following data:a) Technical names for epigraphs N.O.S. and other generic descriptions.Official transportation designations to which special provision 274 has been assigned in theNOM-002-SCT, must be complemented with their technical names or their chemical group.NOM-043-SCT/2003 Page 10b) Package and/or packages and empty tanks not cleaned.All the empty means of contention, (particularly packages and packagings, I BC’s, portable tanks, tank trucks and tank cars) containing residues of hazardous substances or wastes other than those of class 7, radioactive, will be described as such, for instance by placing the words “EMPTY, NOT CLEANED” or “IT HAS CONTAINED RESIDUES LATELY”, before de official transportation designation or right after it.c) Hazardous waste.With regards to the wastes of hazardous substances (apart from the radioactive residues) that are transported for its storage, reuse, recycling, treatment, incineration or final disposition, the official transportation designation must go preceded of t he word “WASTE”.d) Substances at elevated temperature.If in the official transportation designation of a substance to be transported or that is offered for its transportation in liquid state at a temperature equal or higher to 240°C, and it is not indicat ed that it’s about a substance to be transported at elevated temperature, (for example, using the terms “MOLTEN” or “E LEVATED TEMPERATURE as part of the official transportation designation), the term “HOT” will be shown immediately before the official transportation designation.5.4 Necessary information besides the description of the hazardous substances, materials and wastes.Besides the description of the hazardous substances, materials and wastes, on the Shipping Document the following information shall be included:5.4.1 Total quantities of Hazardous substances, materials and wastes.Save for the cases of empty packages and packagings, not cleaned, the total quantity of hazardous substances must be pointed out to those of which indications are applied (weight or net explosive content, as it is deemed necessary), of each hazardous substance, material or waste that carries the UN number, a packing group, and/or a different official transportation number.For materials of class 1, explosives, the quantity will make reference to the net mass of the explosive matter.In the case of hazardous substances and wastes that are transported in emergency packages or packagings, an approximate quantity of the hazardous substance must be shown. It will also be indicated the number and type (for example: jerrican, box, case, etc.), of each one of the packages and packagings. Abbreviations may be used to signal the measuring unit of the total quantity.5.4.2 Limited Quantities.Besides the prescriptions about documentation, when transported under the exceptions appearing on NOM-011-SCT2, Conditions for the transport of hazardous substances, materials and wastes in limited quantities on the shipment description, the words “limited quantity” will be included, o r the abbreviation ”LTD. QTY.”.5.4.3 Emergency packages and packagings.When hazardous substances, materials and wastes are transported in emergency packages or packagings, the words “EMERGENCY PACKAGES AND PACKAGINGS” will be added and they must comply with the actual regulations.NOM-043-SCT/2003 Page 11。
