Part-time teachers are only paid for the classes they teach.5.3. After probation period, if Party B can reach between 90%-100% of the required teachinghours as specified in Clauses 3.3, 3.4, or 3.5, he/she will be paid with full salary. If Party B reaches between 80% and 89% of the required teaching hours during the month, he/she will be paid 90% of the full salary. If Party B reaches between 70% and 79% of the required teaching hours, he/she will be paid 80% of the full salary. If Party B fails to reach 70% of the required teaching hours, he/she will be paid at the part-time rate. If Party B fails to reach 70% of the required teaching hours for 3 months, Party A reserve the right to terminate the contract.5.4 Party B shall be paid for the previous month on the xxxth day of each month. FlightsUpon completion of the contract, a full-time teacher is entitled to receive a maximum of 6000 RMB as a reimbursement for travel expenses. The money will be included in Party B’s salary of the last month of the contract and therefore subject to income tax. If the teacher asks for a leave for longer than 15 days during the contract period, he/she cannot claim the travel reimbursement.11.1 Party A is responsible for obtaining a valid work (Z) visa for Party B who engages into a long-term Employment Agreement of twelve (12) months or more. The expenses relevant to acquiring the residence permit and work (Z) visa for Party B that shall be paid directly by Party A are:•Government fee for application of the Resident Permit.•Fees of completing the Temporary Residence Permit in the city in which the visa is processed.•Health check fee.11.2 If Party B engages in an agreement of three (3) months or less with Party B, Party B is responsible to obtain the necessary visa and license himself / herself. Party B refuses to accept schedule adjustments due to operational needs, includingbut not limited to working six days per week.H. Party B has failed to keep confidential or, without the prior written consent of Party A,has disclosed to any other person not authorized to receive it, information concerning the business or affairs of Party A or its clients or matters Party A is engaged in.13.4 Under the following circumstances, Party A should notify Party B no less than 10 days inadvance of terminating this contract:A. Party B has suffered from illness/disease, or has been injured due to reasons notpertaining to work duty and, after medical treatment, Party B is no longer able toeffectively perform the work assigned by Party A.B. Party B is unqualified in his/her work, even after receiving training or being transferredto another position.13.5 Under the following circumstances, Party B has the right to inform Party A in writing 15 days in advance to terminating the contract and be entitled to full remuneration according to this contract:A. Party A fails to provide Party B with the necessary working conditions as stipulated inthis contract.B. Party A has failed to pay Party B salary on time.C. CompensationThe Employer shall pay the Employee a monthly salary of ___ (currency), payable on the ___ day of each month. Working Hours and LeaveThe Employee shall work a total of ___ hours per week, withdays and times to be determined by the Employer. ConfidentialityThe Employee shall maintain the confidentiality of all proprietary information, teaching materials, and student records, and shall not disclose such information to any third party without the prior written consent of the Employer.6. Intellectual PropertyAll intellectual property rights in any teaching materials, lesson plans, or other works created by the Employee during the term of this Contract shall be the exclusive property of the Employer.7. Compliance with Laws and RegulationsThe Employee shall comply with all applicable laws and regulations of the country of employment, including but not limited to immigration, tax, and labor laws.8. TerminationEither party may terminate this Contract by giving ___ days' written notice to the other party. The Employer may also terminate this Contract immediately if the Employee breaches any material term of this Contract.9. IndemnificationThe Employee shall indemnify and hold harmless the Employer against any and all claims, damages, and expenses arising out of the Employee's breach of this Contract or negligence inthe performance of duties.10. Duty
1, party A shall introduce to party B the laws, decrees and relevant regulations enacted by the Chinese government and regulations concerning the administration of foreign experts.
2, party A shall pay party B the monthly salary on the 10th of every month for party B works in the previous month.
3, party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China‘s internal affairs.
4,party A shall pay for the fee of the check-up,and the fee of the visa.
Salary
1,The salary is 10,000yuan in the first month.
2,Each month, ten percent of the salary will be deposited for the school. And you will get the money at the end of the year.
3,If you done well in the first month, you will get the salary 12,000yuan per month from the second month.
4,If the class hours were more than 30one week , the extra hours per hour is 150 yuan. The class hours in 21th school are 20 one week.
5,Each month party A pays extra 300yuan for traffic fee to party B. This fee won’t be paid by party A during the summer and winter holiday.
Sick leave Personal leave Vacation
1, For sick leave, a diagnosis suggestion on illness by the hospital should be presented to Party A within 24 hours. In this case, and less than 2 days, Party B won’t be paid for the hours he misses. Between 2-7 days, party A can pay for party B half salary of these days. If more than 7 days, the salary for the extra days will not be paid.
2, party B, asking for the personal leave because of his own reasons, should be allowed by party A, and the salary of the day will be deducted. And inside the year, the personal leave totally wo n’t be more than ten days. Consecutive leaving won’t be more than three days. If the leaving weren’t be allowed, so one day leaving will be deducted 3 days salaries.
3, Not be late for the class. Foreign teachers must arrive at school 10 minute
s early before class. Being late once will be deducted 30%salary of the day. Being consecutively late twice will be deducted one day salary. In one month, if party B were late totally five times, the half month salary will be deducted.
4,each Friday whole day and Saturday morning free for party B
Regulations
1, Dress well.
2, Keeping good reputation as foreign teachers.
3,Teachers are expected to interact with the students, but to still act professionally. Remember, our students come from various fields, organizations, and social groups. They will be watching everything the teacher does very carefully. Upholding the principles of a good teacher are important, what you portray reflects upon the other teachers and the schools’ reputation. Students will look to the teacher as an example; let’s not give the wrong image of a professional foreign teacher.
The contract change, dissolution and termination
Each part of the contract should abide it. If not be agree by both side, any part can’t change, dissolute and terminate.
If any part broke the contract, he should pay for the other part 2000 dollars as penalty.
If happed the below things,party A has right to stop the contract:
1,if party B not abide the contract or do not enough as what he should do,and party A told him ,but he not change.
2,According to the doctor,party B could not work totally 30 days or more than.
If party A not give party B salary in time,the party B has right to stop the contract. This contract will take effect right on the date signed by both Party A and Party B and will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should forward its request to another party 30 days prior to the expiration of the contract, and sign the new contract with mutual consent. Further, if party B breaks the contract, one-month salary will be deducted as the penalty.
