节能产品认证管理措施(征求意见稿)第一章总则第一条【立法目旳】为提高用能产品旳能源运用效率,规范和管理节能产品认证活动,根据《中华人民共和国节省能源法》、《中华人民共和国认证承认条例》等法律、行政法规旳规定,制定本措施。

第二条【节能产品认证定义】本措施所称旳节能产品认证,是指认证机构证明用能产品在能源运用以及提高能源运用效率方面符合相应旳节能产品国标、行业原则或者认证技术规范规定旳合格评估活动。

第三条【合用范畴】在中华人民共和国境内从事节能产品认证活动,应当遵守本措施。

第四条【工作机制】国家质量监督检查检疫总局(如下简称国家质检总局)统一管理节能产品认证工作。

国家认证承认监督管理委员会(如下简称国家认监委)负责组织节能产品认证旳具体实行、监督和综合协调工作。

地方各级质量技术监督部门和各地出入境检查检疫机构(如下统称地方质检两局)按照各自职责,负责所辖区域内节能产品认证活动旳监督管理工作。

第五条【履行旳节能产品认证制度】国家对节能产品认证统一管理,实行统一旳产品目录,统一旳原则、技术规范,统一旳认证规则,统一旳标志。

节能产品认证目录由国家质检总局、国家认监委会同国务院有关部门制定、调节,由国家质检总局、国家认监委联合发布,并会同有关方面共同实行。

第六条【鼓励政策】国家质检总局、国家认监委和国务院有关部门,根据《中华人民共和国节省能源法》以及国家有关产业政策规定,在工业节能、建筑节能、交通运送节能、公共机构节能等领域,推动有关机构开展节能产品认证等服务活动,并采信节能产品认证成果。

获得节能产品认证证书旳产品、设备,应当依法优先列入节能产品、设备政府采购名录。

第七条【互认规定】国家鼓励按照平等互利原则开展节能产品认证国际互认工作。

认证机构应当按照国家质检总局、国家认监委对外签订旳节能产品认证互认合同开展有关互认活动。

第八条【保密规定】从事节能产品认证活动旳机构及其人员,对其从业活动中所知悉旳商业秘密和技术秘密负有保密义务。

第三条节能产品认证(以下简称认证)是依据相关的标准和技术要求,经节能产品认证机构确认并通过颁布节能产品认证证书和节能标志,证明某一产品为节能产品的活动。

节能产品认证采用自愿的原则。

第四条中华人民共和国境内企业和境外企业及其代理商(以下简称企业)均可向中国节能产品认证管理委员会(以下简称“管理委员会”)及中国节能产品认证中心(以下简称“中心”)自愿申请节能产品认证。

第五条节能产品认证工作受国家经贸委的领导,接受国家质量技术监督局的管理以及全社会的监督。

第二章认证条件第六条申请认证的条件:(一)中华人民共和国境内企业应持有工商行政主管部门颁发的《企业法人营业执照》,境外企业应持有有关机构的登记注册证明;(二)生产企业的质量体系符合国家质量管理和质量保证标准及补充要求,或者外国申请人所在国等同采用ISO9000系列标准及补充要求;(三)产品属国家颁布的可开展节能产品认证的产品目录;(四)产品符合国家颁布的节能产品认证用标准或技术要求;(五)产品应注册,质量稳定,能正常批量生产,有足够的供货能力,具备售前、售后的优良服务和备品备件的保证供应,并能提供相应的证明材料。

第三章认证程序第七条申请认证的国内企业,应按管理委员会确定的认证范围和产品目录提出书面申请,按规定格式填写认证申请书,并按程序将申请书和需要的有关资料提交给中心;境外企业或代理商均可向管理委员会或中心申请,其申请书及材料应有中英文对照。

最新的节能低碳产品认证管理办法最新的节能低碳产品认证管理办法第一章总则第一条为了提高用能产品以及其它产品的能源利用效率,改进材料利用,控制温室气体排放,应对气候变化,规范和管理节能低碳产品认证活动,根据《中华人民共和国节约能源法》《中华人民共和国认证认可条例》等法律、行政法规的规定,制定本办法。

第二条本办法所称节能低碳产品认证,包括节能产品认证和低碳产品认证。

节能产品认证是指由认证机构证明用能产品在能源利用效率方面符合相应国家标准、行业标准或者认证技术规范要求的合格评定活动;低碳产品认证是指由认证机构证明产品温室气体排放量符合相应低碳产品评价标准或者技术规范要求的合格评定活动。

第三条在中华人民共和国境内从事节能低碳产品认证活动,应当遵守本办法。

第四条国家质量监督检验检疫总局(以下简称国家质检总局)主管全国节能低碳产品认证工作;国家发展和改革委员会(以下简称国家发展改革委)负责指导开展节能低碳产品认证工作。

国家认证认可监督管理委员会(以下简称国家认监委)负责节能低碳产品认证的组织实施、监督管理和综合协调工作。

地方各级质量技术监督部门和各地出入境检验检疫机构(以下统称地方质检两局)按照各自职责,负责所辖区域内节能低碳产品认证活动的监督管理工作。

第五条国家发展改革委、国家质检总局和国家认监委会同国务院有关部门建立节能低碳产品认证部际协调工作机制,共同确定产品认证目录、认证依据、认证结果采信等有关事项。

节能、低碳产品认证目录由国家发展改革委、国家质检总局和国家认监委联合发布。

第六条国家发展改革委、国家质检总局、国家认监委以及国务院有关部门,依据《中华人民共和国节约能源法》以及国家相关产业政策规定,在工业、建筑、交通运输、公共机构等领域,推动相关机构开展节能低碳产品认证等服务活动,并采信认证结果。

国家发展改革委、国务院其他有关部门以及地方政府主管部门依据相关产业政策,推动节能低碳产品认证活动,鼓励使用获得节能低碳认证的产品。

节能产品认证程序
申请节能产品认证的企业填写《节能产品认证申请书》,连同下列材料一并报中国节能产品认证中心办公室(以下简称办公室)。

一、资料准备
申请节能产品认证的企业填写《节能产品认证申请书》,连同下列材料一并报中国节能产品认证中心办公室(以下简称办公室):
1) 营业执照副本或登记注册证明文件的复印件(如申请方与受审核方不同,亦应提供申请方的证明材料);
2) 产品注册商标证明;
3) 产品生产许可证复印件(有要求时);
4) 产品质量稳定并具备批量生产能力的证明材料(如批量转产鉴定材料);
5) 产品标准(指产品明示标准,如执行国家标准则不必提供);
6) 产品电工安全认证证书复印件或安全检验报告;(列入国家安全认证强制监督管理的产品目录)
7) 产品性能检验报告以及受控关键零部件性能检验报告;
8) 制造厂质量手册;
9) 需要时,CECP所要求提供的其它有关资料。

同时可提交下列资料以供参考:
1)质量体系认证证书复印件(若已获得认证);
2)产品质量认证证书复印件(若已获得认证);
3)实验室认可情况资料。

二、受理申请
申请方提交的申请书和相关材料齐备后,CECP于10个工作日内完成对申请书及相关材料的审查工作,对符合要求的发出《受理节能产品认证申请通知书》,给定认证项目编号。

对申请书和相关材料尚不充分的,CECP将与申请方联系(电话、传真等通讯手段),通知其在规定的30天内补充有关材料或进行相应整改,必要时发出《申请材料补充通知书》,直至申请书和相关材料符合要求为止。

若申请方未能按要求在30天内补充/完善所需的材料并未作任何解释和说明,则认为申请方撤销本次申请。

与申请方签订《节能产品认证合同书》
随同《受理节能产品认证申请通知书》,CECP还将发出《节能产品认证合同书》(一式两份)确定认证范围(产品名称、受审核方/制造厂、产品商标)、工厂审核及产品抽样完成日期、认证付费要求和时机、双方责任和义务等内容。

同时通知企业认证费用预算。

如申请方对合同内容及认证费用预算无异议,应在CECP 实施工厂审核前完成认证合同书的签订工作。

合同书有效期为四年,如果认证范围(包括认证产品类型、制造厂等)没有变更,每次扩大认证时不再另签合同书。

三、质量体系审核
依据GB/T19002-1994《质量体系生产、安装和服务的质量保证模式》
CCEC/T03-2000《节能产品认证质量体系要求》
受审核方质量手册、程序及相关支持性文件。

四、产品检验
检查部和检验机构在收到办公室下发的《节能产品认证任务书》后,按照CECP/P09-1999《企业质量体系审核程序》和CECP/P10-1999《节能产品认证检验控制程序》的有关规定实施相应的审核和检验工作。

检验合格,由中国节能产品认证中心颁发证书。
