我国古代治国理政最为重要的“治国之具”是礼与法。
古人对礼法关系及其在治国理政中的作用进行了概括。
如《唐律疏议》中载“德礼为政教之本，刑罚为政教之用”。
德礼，即道德，更多的是人心由内而外发挥的“善”，而刑罚乃是为了“为善去恶”而生的必要的“恶”。
《唐律疏议》认为道德的缺陷在于难以形成统一的秩序，法律则弥补了这一不足，保证了外在秩序的稳定。
以道德礼义为本，以法律政刑为用，凸显了传统法律文化对“治国之具”的准确定位。
春秋战国时期出现的“礼崩乐坏”局面，使得思想家普遍意识到“法治”的重要性。
《艺文类聚》中载“治国无其法则乱”。
“法治”最为突出的要件就是“立法为公，一断于法”。
而实现公正、平等，要立有良法，且良法能得到妥当施行。
晋朝尚书刘颂曾建言：“律法断罪，皆当以法律令正文，若无正文，依附名例断之，其正文名例所不及，皆勿论。
”其建议后成为晋律的内容。
在晋律影响下，后世确立了依法断罪的制度。
至唐朝，《唐律疏议》规定，“诸断罪皆须具引律、令、格、式正文，违者笞三十”，这对于限制司法专横具有重要意义。
在具引法典条文前提下，还强调罚当其罪，而非一味机械地征引。
