违约责任按7.1条。
6.1.2 发包人有权在任何阶段提出更换项目设计团队设计人员。
6.1.3发包人按本合同第三条规定的内容，在规定的时间内向设计人提交资料及文件，并对其完整性、正确性及时限负责，发包人不得要求设计人违反国家有关标准进行设计。
发包人提交上述资料及文件超过规定期限15天以内，设计人按合同第四条规定交付设计文件时间顺延；超过规定期限15天以上时，设计人员有权重新确定提交设计文件的时间。
若发包人要求顺延时间超过1个月，需提前一周通知，否则双方需要协商等待期间的成本补偿费用。
6.1.4 发包人变更委托设计项目、规模、条件或因提交的资料错误，或所提交资料作较大修改，以致造成设计人设计需返工时，发包人应按设计人所耗工作量向设计人增付设计费。
但双方需另行协商签订补充协议（或另订合同），重新明确有关条款，6.1.5发包人应为派赴现场处理有关设计问题的工作人员，提供必要的工作生活及交通等方便条件。
Article 6 Binding responsibilities for both parties 6.1 Responsibilities for assigner6.1.1 Assigner retains the right to terminate the contract at any stage with this right subject to the responsibility to inform the Party B on a timely basis. Article7.1 applies if assigner defaults.6.1.26.1.3 Under Article 3 the assigner should supply the materials and documents to the designer within the specified timeframe and assure the accuracy and completeness of the materials and documents supplied. The assigner should not require the designer engage in any design that may violate the relevant State regulations and standards.In the situation where there is delay for materials and documents submission by assigner and the delay is less than 15 days over the specified date, the designer will delay the design works delivery accordingly by applying Article 4; if the materials and documents submission is delayed more than 15days over the specified date, the designer retains the right to re-set the design works delivery date. As prolong by the assigner more than 1 month, both side should negotiate the waiting cost for LAB and should be noticed 1 week earlier by assigner.6.1.4 When the errors in the submitted materials or the changes affecting the design process, scope and conditions by the assigner necessitates the re-work of the designer, the assigner should pay extra design fee to the designer basing on the extra work volume incurred. Separate negotiation and agreement/contract are required and relevant terms and conditions are to be identified.6.1.5 The assigner should provide necessary working/living facilities and transportation to the staff travelling to working onsite for design purpose.6.1.6发包人应保护设计人的设计方案、文件、资料图纸、数据、计算软件和专利技术。
未经设计人同意，发包人对设计人交付的设计资料及文件不得擅自修改、复制或向第三人转让或用于本合同外的项目，如发生以上情况，发包人应负法律责任，设计人有权向发包人提出索赔。
6.1.7发包人项目负责人为发包人项目审批人为6.2设计人责任：6.2.1设计人应按中国技术规范、标准、规程及发包人提出的设计要求，进行设计工作，按合同规定的进度要求提交质量合格的设计资料，并对其负责。
6.2.2设计人采用的主要技术标准是：中国现行的设计标准、设计规范及设计规程，中国和地区标准图集。
6.2.3设计合理使用年限50 年。
6.2.4设计人按本合同第二条和第四条规定的内容、进度及份数向发包人交付资料及文件。
6.2.5设计人应保护发包人的知识产权，不得向第三人泄露、转让发包人提交的产品图纸等技术经济资料。
如发生以上情况并给发包人造成经济损失，发包人有权向设计人索赔。
6.1.6 The assigner should take measures to protect the integrity of the designer’s works, documents, materials, drawings, data, computer softwares and technologies. The assigner should not change, copy or transfer to any third party any design materials and documents by the designer. Such design materials and documents should not be used in any project outside of the scope of the contract. The assigner assumes the legal responsibilities should the breach of these conditions occur and the designer retains the right to claim for compensations from the assigner should such instances occur.6.1.76.2 Responsibilities for designer6.2.1 The designer should undertake the design according to the China-based technology standards, procedures and the design requirements raised by the assigner and provide the qualified design materials as per the progress chart in the contract. 2. 如因乙方设计错误导致工程质量问题或安全事故，乙方应承担相应的法律责任和经济赔偿。
第六条争议解决合同执行过程中发生的任何争议，双方应首先通过友好协商解决；协商不成时，可提交至甲方所在地人民法院诉讼解决。
第七条其他事项1. 本合同的修改和补充应以书面形式进行，经双方授权代表签字盖章后生效。
2. 本合同一式两份，甲乙双方各执一份，具有同等法律效力。
