中华人民共和国政府和澳大利亚政府贸易协定文章属性•【缔约国】澳大利亚•【条约领域】贸易•【公布日期】1973.07.24•【条约类别】协定•【签订地点】堪培拉正文中华人民共和国政府和澳大利亚政府贸易协定(签订日期1973年7月24日生效日期1973年7月24日)中华人民共和国政府和澳大利亚政府,为在平等互利的基础上促进两国经济贸易关系的进一步发展,增进两国人民间的相互了解和友谊,达成协议如下:第一条缔约各方应遵照各该国现行有效的法律和规章,对自另一方领土输入或向另一方领土输出的商品,特别是对本协定甲、乙两附表所列的商品尽可能给予便利。

本条不应被视为两国间商品的交换仅限于本协定甲、乙两附表所列的商品。

本协定的附表经双方同意可通过缔约双方换函随时加以修改。

第二条缔约双方同意由两国有关贸易机构和企业就签订商品长期协议问题进行探讨,并根据双方需要和可能签订此类协议。

第三条两国之间根据各该国现行有效的法律、规章签订的合同及协议项下的商品和技术服务的交换,应按国际市场合理价格,并由中华人民共和国国营进出口公司和澳大利亚法人及自然人进行。

第四条缔约双方在颁发进、出口许可证,批给外汇额度,征收进口货物或与进口货物有关的关税、国内税或其他费用,以及在海关及其他有关的手续、规章、程序方面相互给予最惠国待遇。

第五条本协定第四条的规定不适用于:(一)缔约任何一方由于该国参加某一关税联盟或自由贸易区或其他关于特惠贸易的安排所给予的优惠和便利;以及缔约任何一方为履行国际间商品协定所规定的义务而可能采取的措施;(二)缔约任何一方在边境贸易方面已经给予或将给予毗邻国家的优惠和便利;(三)缔约任何一方为保护国家安全,人、畜和植物的生命或健康所采取的措施。

第六条中华人民共和国和澳大利亚之间的一切支付,应按照两国现行有效的外汇条例和一般习惯做法,通过两国授权买卖外汇的银行,以中国人民币、澳大利亚元或双方同意的可自由兑换的其他货币办理。

Correction required: – correction to 3 email addresses; – editorial - removal of agenda time from “Crush damage testing”; – correction in “Mining cable design” – 1998-99 tyre type 280 research; – correction in “DC cables” – replace “initial” with “initiative” Otherwise previous minutes confirmed by JB and seconded by PO.3.Publication of meeting minutes on Industry and Investment, New South Wales (I&I, NSW) web site. SB explained that the Dept’s aim to be “goal focused” and “transparent” with all industry participants. Therefore “strategic activities” and the “progress of key mining industry facilitation and developments” should be readily available for perusal by the whole industry. The meeting participants were asked of concerns or objections to publishing the meeting minutes on the I&I, NSW web. It was confirmed that minutes should contain the purpose, goal and key items of the debate, rather than attributing issues or comments to individuals, companies or mines. The motion supported, therefore the minutes when drafted will be distributed to the participant for comment. All comments and corrections received within 4 weeks of the distribution date will be integrated into the minutes, and the minutes will then be published onto the I&I NSW web site. Topics of non-consensus will be detailed as clearly as possible in the minutes and held over for further review at future meetings.4.Review and acceptance of draft “Scope, purpose and objective of meeting”. As per the action item from last meeting, 30 September 2009, JW drafted a “Scope, purpose and objective of the Cable Manufacturers, Repairs, Mine Operators and Regulator’s Meeting” and this was distributed with the agenda. The proposal was briefly reviewed and some concern raised that key issues, such as: • • • the “training of cable repairers”, should be introduced into “2) Scope” introduce “cable selection for particular mining applications”, should be introduced into “3) Activities”; and a question, whether “machine manufacturers” should be introduced into “4) Participants”.On review, the training requirement appears to be adequately covered in “3) Activities”, “cable selection …” to be integrated into “3) Activities”, but in respect to “machine manufacturers participating in the group” was meet with opposition that we are already a large group, increasing participation may become unwieldy and the central focus mtgs may start to drift. Action: Introduce “cable selection for particular mining applications” in section 3 – JW (due: 8 December 2010).PAGE 2 OF 9SB proposed that this committee could take ownership of this activity and facilitate future meeting, perhaps starting with an agreed committee name and a core steering group. OB explained how Hunter Industry Electrical Safety Network (HIESN) and MEMMES – Hunter Valley chapter of Engineers Australia, were established and the need for the core steering group. Action: Propose a title for this group and / or make nomination to participate in a key steering group – All (due: 8 December 2010). 5. Legislative update - National Mine Safety Framework – SB. SB presented an overview of the National OHS Harmonization project and the integral National Mine Safety Framework, including current negotiation with other mining states and territories, of particular interest to this group being coal safety legislation harmonization with Qld. Work has commenced to harmonize mine safety legislation with the major mining states. NSW and Qld are approaching a common set of legislative arrangements. The harmonized legislation will include common mandatory requirement only. Otherwise Code of practice for minimum standards must be achieved. Qld have a much different stance to cable selection, cable repairer surveillance and cable repairer competencies. Therefore common legislated requirements for cable selection, cable repairer surveillance and cable repairer competencies are unlikely and so NSW will have to implement a Code of Practice. The development of a Code of Practice must occur with stakeholder consultation. This committee should have a voice in any future Code of Practice development. It would be advantageous if a small steering group, including one or two representatives from manufacturers, repairers and mine operators was available to join an Inspector, to advance the code of practice for cable selection, cable repairer surveillance and cable repairer competencies. Action: Propose preferred arrangements for the initiation of Code of Practice and / or make nomination to participate in a Code of Practice steering group – All (due: 8 December 2010). 6. Submission of cable damage statistics to I & I, NSW Submission of cable damage statistics was reviewed and ratified at previous meetings. Such submission allows informed reporting, investigation and hopefully an opportunity for improved cable management and/or design. On the whole, submission of cable damage statistics has been consistent and timely. However some repairers have allowed this reporting to slip from the activity list. The options of how and when submission of monthly cable damage data should occur was considered, with a resolution of monthly and submit to Dept on the first working week of the month. Also, whether it would be possible for workshops to log into a Dept operated database or spreadsheet, however the appropriate security clearance is unlikely to be issued, and in reality the amount of data to be rekeyed or transferred is quite small. Therefore it would practical to continue submissions by email or fax. Action: Verify the process of cable damage reporting is appropriately embedded in company procedures and it occurs on the first working week of the month. Any outstanding reports are reported ASAP – Cable Repair Workshops (due: 8 December 2010).PAGE 3 OF 97.Cable damage and cable arcing statistics SB presented the latest trends of cable damage and cable arcing, noting that some workshops have outstanding submissions and therefore it is difficult to make determinations of the most recent events. In respect to Cable damage statistics, SB questioned if workshops provided individual mines with an annual log of their cable repair activities? Some workshops do report cable repair activities annually or on request from mine operators, but generally this information goes to accountants, with only a few Engineers taking an interest.8.Review and comment of Draft EES-100 – Technical Report – Underground Coal Mine – Electrical Cables used in Hazardous Zones damage reporting The draft report was circulated with the agenda, with a goal to discuss the content at this meeting. However, it appeared there was insufficient time to review and comment prior to the meeting. It was possible to allocate a small amount of time within the meeting to briefly run through the structure of the report and some key comments e.g.: • “shuttle car cables and continuous miner cables … … are probably the hardest work cables in a mine and the ones at the highest risk of damage and therefore they need a great deal of management attention”; and “cables are the most common source of electrical arcing incidents in hazardous zones”;•also discussion and reasoning for the innovative semi conductive earth screens design of type 280 that was introduced into Stds but never used in mines. Action: Please review the report and comment on structure, clarity, correctness, omissions and presentation of the report, prior to publication – All (due: 8 December 2010). 9. Cable design, manufacture and supply Raised at last meeting, BS suggested that we should review the original cable design strategies prior to undertaking radial changes to cable design. HB has volunteered to speak on this topic. HM presented to the cttee a background summary of his knowledge and experience with the development of existing cable designs and standards and the associated safety features of coal mining cables. HM’s experience with coal mining cables dates back some 30yrs, where significant testing occurred of various cable designs and from that the cable standards were put in place. Considerable knowledge was developed from tests and trials that lead to specific cable design, and as a consequent commonality of cable design, size, construction has been a result. HM believes that the prescriptive cable designs detailed in AS/NZS 1802, 1972 and 2802 have done us well over many years and eliminated/minimized many serious concerns from earlier designs, such as cork screwing, broken earth, etc. If changes are introduced, then field trials would be required as it is difficult to simulate field applications in laboratory facilities. SB suggested the present cable standards do not cater for some existing application, e.g. machine cables may be subject to very high temperaturesPAGE 4 OF 9within flameproof headlight enclosures and although a suitable (R-S-200) insulation is clearly defined in AS/NZS 3808, it is not included in AS/NZS 1972. Others in the group highlighted positive and negative concerns about the structure and content of the existing mining cable standards, such as: • Discrimination between permitted and non-permitted insulations (RS-150/R-S-200) and sheath materials (general purpose/heavy duty) where the later options are excluded from AS/NZS 1802 but it is suggested that they will provide a better overall performance without other shortcomings; Current “type tests” and “routine tests” procedures for insulation and sheath materials are very abstract to whole cable performance and a question was raised “should whole cable torturous reeling type tests, for insulation, semi-con and sheath durability, semi-con adhesion be included?”; Should a crush test be included in future standards that verifies the first fault is an low energy earth fault (as raised at last mtg)?; Third party verification of “Type Tests” are conducted for all other types of electrical equipment used within a hazardous zone apart from cable manufacture; Action: Nominate what “Type Tests” should/should not be considered for third-party test authority reporting and available test authorities that can undertake the “Type Tests” detailed in AS/NZS 1802 and 1972 – All (due: 8 December 2010). • third party surveillance of “Routine Test” facilities and results are typically conducted for all other types of electrical equipment used within a hazardous zone apart from cable manufacture;; Action: Nominate what “Routine Tests” should/should not be considered for third-party surveillance and available third-party authorities that can undertake surveillance programs of “Routine Tests” detailed in AS/NZS 1802 and 1972 – All (due: 31 November 2010). • the standards are seen as recipes of suitable ingredients for cable construction, rather than specifications for cable performance, one proposal was to consider the most recent revised of AS 1299 / 1300 stds where type “a” and “b” were introduced. Where the type “b” is for not standard designs that meets the basic test requirements;•• •however there is concern that changes may be see largely as cost driven, and as such some alternate cables may be introduced that perform better but others will not perform as well. It is noted that in Australia, reeling cables are considered an asset with appropriate asset management processes, inspections regimes and repairs facilities in place. Whereas in other parts of the world, cable are treated more as a consumable and readily replaced rather than repaired. Therefore there are different world views for cable designs and what a mining cable standard should include. It should be noted that the draft EES-100 states “Cable design has not been an identified factor in damage scenarios … … There is a need to revise thePAGE 5 OF 9Australian Standard, AS/NZS 1802, to cater for the increased performance requirements for mining cables.” It is clear that the legislation is changing; coal operators and cable manufacturers need to keep pace with industry goals of ALARP principles. Chapter 5 of the Occupational Health and Safety Regs 2001, requires manuf to embrace the equipment life-cycle and the suitable of material and procedures for cable repairers would need to be addressed. The selection of insulation and sheath materials to conform with ALARP principles and there ability to be repaired must be considered. Cable manuf.r’s supported this view, suggesting that selection and suitability of cable repair materials is provided, but procedures for cable repairs are better developed within the expert cable repair workshops. Action: Should a review of standard(s) be required, early suggestions and nomination of volunteers to develop business case would be required. Forward letters/comments of supporting to enhance a business case proposal. Nominations for business case steering cttee should be submitted – All (due: 8 December 2010). Irrespective of changes to standards, a Code of Practice is expected to be required for minimum specifications for cable used in a hazardous area. The Code of Practice development is likely to start next year. Cable performance indicators of existing quality performers will need to be clear, to limit the influx of alternative designs without performance history. Clear performance indicators detailed in Australian Standards is the preferred approach. The future introduction of new cable types would be required to show performance achievements before trials at a mine site. Action: Early nominations to Code of Practice Working group would be welcome – All (due: 31 November 2010). 10. Licensing of cable repair facilities Correspondence from I&I Licensing Unit has been issued to all NSW cable repair workshops and their assigned Inspector, notifying of the forthcoming annual audits. Workshops should respond the Licensing Unit correspondence, and also work cooperatively the Inspector to complete the audit and close out any non-conformances and achieve the Inspector’s confirmation prior to the licence expiry date. The Licensing Unit has distributed audit files to Inspectors and the Inspectors have been requested to return the file with the audit report and notification of intent for licence continuation. Appeals, if warranted, should be forward to the Senior Inspector of Electrical Engineering. 11. Cable repair signatory assessment The method of competency assessments for cable repair signatories has been previously thrashed-out in this forum and concluded with unanimous support for the propose described in I&I NSW Technical Reference EES-012 Assessment and Registration of Cable Repair Signatory for Reeling, Trailing and Flexible Feeder Cables used in NSW Underground Coal Mine Hazardous Zones. EES-012 contains 4 assessment modules, 3 of which are assessed on the job in the workshop and these particular assessments are the precursor for the third party Module 4 oral assessment. This strategy was developed on the basis of the high manual content of the work being performed, but with anPAGE 6 OF 9assurance that the repairer has a thorough understanding of the theory and safety criteria without having to complete lengthy written examinations. Some recent requests for Module 4 cable repair signatory assessments, have submitted with incomplete Modules 1 to 3 assessment records and/or reports that identify a significant amount of the assessments being completed in an unrealistic timeframe. The ratified position is that all module elements must be achieved and as Modules 1 to 3 competency elements are to be assessed by a Certificate IV assessor and competent Cable Repairer, oral questioning and the review of work history such as job card, cannot be seen as being a suitable competency assessment. The intent of EES-012 is that individual elements within Modules 1 to 3 are assessed, by observing the candidate’s practical activities and questions of the associated theory and safety criteria to confirm both the skill and knowledge for the individual competency element. Until a whole competency module has been finalized, an individual should be closely supervised and the competent supervisor is to counter sign job sheets. In this instance, Managers of Electrical Engineering, have also reported their concern in utilizing the skill of individuals onsite, who has been assessed for the whole module. A final word on module 4 competency applications; to date have been rather irregular, so the Dept’s Competency Unit have set two fixed application cut-off dates, refer Dept’s web site. 12. Additional industry issues for committee attention a. Question received from an underground operator: Is it suitable to complete in-situ temporary sheath repairs of monorail cables in a longwall panel? Although custom and practice dictates to keep removing cable from underground when repairs are required, more lengthy cables present an ergonomic challenge and in particular, monorail cables as they are suspended off the floor and generally not frequency handled similar to other cables. The committee responded with the following key concerns: – Who will determine the extent of repairs required? Level 1 sheath repair would be achievable, however level 3 sheath repairs, are unlikely to be supported for in-situ repairs. – Selection and application of appropriate repair materials would need to be confirmed and when completed, any repair would need to be tested / verified. This would generally mean introducing test equipment underground. – General experience from the group, is that minor sheath damage when investigated, often reveals significant internal damage has occurred within the cable that was not evident prior to investigation. – The extent of such activities needs to be addressed in the forthcoming Code of Practice, however there are concern that the status quo (remove cable to service facility) should prevail. b. Incident – integrity of connection and requirement for earth lead connection to phase barrier of a 150 A restrained plug.PAGE 7 OF 9Recent incident at a south coast mine caused the investigation of integrity of connection and requirement for earth lead connection to phase barrier of a Macey 150 A restrained plug. The workshop that fitted the plug was notified and has investigated the issue, improving the method of connecting the phase barrier earth lead and enhanced supervision of shopfloor activities. The OEM’s installation instructions (IS1054), appears to list the phase barrier earth lead as an option, which contra the requirements of Australian Standard (refer clause 2.8.2, AS1299:2009). Action: Bring issue to the attention of plug supplier, with a goal to clarify installation instructions – PD (due: 8 December 2010). c. New receptacles and adaptors supplied, to cable repairer, without compliance/test report and not conforming to compliance certificate. A Qld workshop has raised a concern of new CMI receptacles and adaptors supplied, to cable repairer, without compliance/test report and not conforming to compliance certificate. The minimum expectation for the supply of electrical explosionprotected equipment is detailed in gazette notice “Type of electrical plant used in hazardous zones” and available at .au/__data/assets/pdf_file/0005/203198/Typesof-electrical-plant-used-in-hazardous-zones---CMHS-Act-2002.pdf Those expectations include compliance and/or test report(s) that confirm the suitability of the equipment to be used in a hazardous zone. Cable workshops that receive products that do not conform to the certificate and/or approval should in the first instance raise a “nonconformance” with their supplier and may also consider raising the matter with certificate/approval issuing body. d. Liability for licensed facilities when others “dismantle or tamper with repaired or fitted explosion-protected equipment”. Liability is not determined by I&I, however the schemes and procedures implemented by standards and the Dept. provide suitable defence is such circumstances, such as work procedures, competency standards and in particular maintenance of records. Job sheet and customer reports must identify the work undertaken in the workshops, test and/or inspection results and the state the equipment left the licensed facility. For example a cable, plugged at only one end and subsequently hard wired to a machine at another workshop, the test tag fitted by the licensed cable repair facility should reference a test report that describes the status of the equipment as it left their facility. e. Consistency of quality of repairs. A mine reported a couple of experiences where one licensed cable repairer has reported poor workmanship that existing repairs, completed by another licensed repairer. Is the repair standard rigorous enough to provide the mine electrical engineer confidence in the repair or subject to too much interpretation by the repairer? Action: Please provide comment – All (due: 8 December 2010).PAGE 8 OF 9Action: Consider standards of practice during workshop assessments and submit for review at next meeting – IEEs (due: 1 February 2010). f. Online tracking of repaired cables. A mine request that a centralised data base for cable repairs be considered, so that the status of cables could be accessed by the mine electrical engineer and all licensed cable repair facilities. Stating that paper reports are a very old and an onerous method for management of cable lifecycle and these reports only provide a snapshot in time of cables condition. The mine reported that our mechanical counterparts can track historical information through a web based application for oil sampling and condition monitoring – why can’t we? The cable shops may also benefit by providing this information in this manner as it provides the mine electrical engineer valuable information on cable replacement intervals and for budgeting. It would also allow data sharing between repair shops on specific cables – whilst this outcome may be seen as undesirable by the repairers, they need to remember that sometimes selection of repairer is done off site by accountants based on price. A present there appears insufficient support for the initiative to formally progress, as reasonable server, database and security would be required. Refer sections 6 and 7 above for further discussion, however the most available option at present is periodic reporting from the licensed facility at their customer’s request. 13. Minutes and future meetings As mentioned above, the minutes when drafted, will be distributed to participants for comment and corrections. Comment and corrections received (by the Chair) within four weeks of distribution will be addressed. The minutes will then be published on the Dept internet site. Frequency of future meetings; in general participants considered one to two meetings per year would be adequate. However with the particular concerns of approaching legislative change, this may need to increase. Proposal for next meeting - Wed 13 April 2011 at TestSafe, Australia, Londonderry, to be confirmed early February 2011. Action: Arrange venue and notify participants – PD (due: 11 February 2011). Learning development opportunities for an assistant or trainee engineer/chemist are encouraged at future meetings, from each of key participating organizations. Please consider for notify additional participation when confirming meeting attendance. In addition, due to the issues raised today, representatives from Australian Standards Technical Cttee EL-003 proposed a meeting for February 2011. Action: Forward comment on structure, clarity, correctness, omissions and presentation of existing cable standards to Chair, to raise at Stds Cttee Mtg – All (due: 8 December 2010).PAGE 9 OF 9。
