Regulation of Foreign Professionals Employed The regulatory rule is enacted to maintain the dignity and legal rights of the People’s Republic of China, the seriousness of its foreign affairs, and safeguard the legal interests of the foreign professionals employed by Zhejiang Ribon Machine Co.,ltd. (the Company, for short).Part One General Principles1.The foreign professionals should observe Chinese laws, rules and regulations; bewilling to cooperate with the colleagues under the friendly atmosphere.2.Foreign professionals shall strictly comply with the law of the People's Republicof China for the relevant regulations and procedures of the foreign personnel and professionals, apply for the residence and entry and exit formalities.3.Foreign professionals should consciously abide by the foreign affairs discipline,not to use the identity of the job or foreign professionals to collect and steal the materials related to national security, political, economic, scientific, technological, cultural and other aspects.4.Foreign professionals employed in our company, first of all, should be friendly toChina, and would like to cooperate with us. They should have a bachelor degree or above, be with relevant professional management work experience more than 5 years and be in good health.5.Foreign professionals must comply with the Company's work management system,the daily work arrangement, and work hard to complete the work tasks, andconsciously abide by the work discipline, work on time.6.The Company should respect the personal religious beliefs of foreignprofessionals, but it does not allow that the foreign professionals in our country carry out the missionary, propaganda and religious work.7.Without permission, foreign professionals shall not do part-time job and acceptany work from other companies and engage in any activity for the purpose ofprofit.Part Two Work Management1.The employment of foreign professionals should be based on the policy of foreignaffairs, combined with the scientific research and the management of theCompany production, and the working hours of them should be arrangedaccording to the regulations.2. A complete evaluation system should be established according to the real situation,the regular inspection and assessment are required. The outstanding achievements in business management, scientific and technical work of foreign professionals should be rewarded, and to the foreign professional who doesn't fit the Company's management, scientific research and other similar work, the Company has theright to dismiss the contract.3.The Company shall arrange a work exchange meeting with the foreignprofessionals every month, summarize the work situation in this month, in order to find the problem in time, thus to adjust the work plan next month.4.The Company should carry out the performance assessment of the foreignprofessionals every month and every six months, in order to test the workingperformance of the foreign professionals.5.The Company should prepare the relevant documents, airport shuttle, training andcontract signing with the foreign professionals. In the contract, the parties must be clear about the responsibilities, obligations, and also clear of any party to bear the liability for breach of contract.6.The intellectual property rights generated by the foreign professionals shall belongto the Company during the employing period.Part Three Ask-for-leave System1.Foreign professionals can enjoy our country's statutory holidays and the normalrest days during the employment of the Company.2.Other things that foreign professionals need to do during the working days; anotice one week in advance to the Company's foreign trade department (or the relevant management personnel) is required. They can go only after the approval is issued.3.If foreign professionals can’t work because of physical reasons, a notice to theCompany's foreign trade department (or relevant management personnel) isrequired, to apply for sick leave. If they have friends and family to visit China and need their accompany, a notice to the Company's foreign trade (or relatedmanagement personnel) one week in advance is required. They can go only after the approval is issued.4.If foreign professionals meet any contingencies at home and they must go back totheir country, a notice to the Company’s foreign trade department is required.They need to come back within agreed time, and they need to cover the air tickets and other costs themselves.5.Foreign professionals need to report an ask-for-a-leave with a reason; they can goonly after the approval is issued. And they should report to the Company about the personal safety when they are out. They need to report back from the leave. If they go out without approval, then the salary will be deducted and if serious, they may be fired.Part Four Contract Management1. A contract agreement shall be signed between the Company and the foreignprofessionals, and shall be in the light of the foreign professionals' standardcontract which is made by the State Foreign Expert Bureau, and shall signcontracts according to the actual situation and the specific terms and conditions should be negotiated.2.Foreign professionals unilaterally want to terminate the contract; then it must beinformed in advance to the Company. It shall be solved according to the relevant provisions of the contract.3.The contract agreement between the Company and the foreign professionals onceis signed, it is legally binding. The two parties shall perform all the terms andconditions stipulated in the contract, and no party may change or terminate the contract.4.Any party that fails to perform the contract or is not in conformity with the termsof the contract, then it is the breach of the contract.The other party shall have the right to claim for damage to or take remedial measures. If other remedial measures are taken, it is not able to fully compensate for the loss; the injured party still has the right to request the other party to compensate for the economic losses.5.The parties of the contract shall pay a certain amount of liquidated damages to theother party in violation of the contract. If the liquidated damages are not sufficient to make up for the loss caused by the breach of contract, the party concerned shall have the right to claim compensation.Part Five Management of Life and Safety1.The Company shall be responsible for the life and safety of foreign professionals.And a special (or concurrent) management from the foreign trade departmentpersonnel is required.2.Once foreign professionals hired, the apartment they live should be included in theCompany's security area, and the Company should be responsible for theirsecurity during the employment. The accommodation of foreign professionals is arranged and managed by the Company. The Company should know the safety of the accommodation of foreign professionals in time. If they have guests to stay, then it must be agreed by the leadership of the Company, and to be with the valid ID to check-in.3.Foreign trade department (or other special, part-time management personnel)should help foreign professionals to be familiar with the work and livingenvironment.4.The Company should ensure the security of foreign professionals when theyparticipate in major activities of the Company.5.The foreign professionals should keep the apartment clean, adding electric wireand domestic appliance should be with approval of the Company. The Company should teach foreign professionals how to use electrical appliances in theapartment, should inform them of how to use the emergency phone and also of the safe matters that should be paid attention.panies should regularly send electrical technician to the foreign professionals’apartments for electrical appliances, electrical wiring, fire and other safetyinspection, to ensure that the apartment is with safe electricity and fire using.7.Foreign professionals should have regular rest, and should not affect the rest ofother people in the apartment. Dangerous goods and pornography are forbidden in the apartment. Foreign professionals should always pay attention to the safety and the fire alarm.8.Foreign professionals should have dinner in the specified place during workingtime. The Company should ensure the dining safety of foreign professionals.9.If foreign professionals meet personal injury in all kinds of accidents, theCompany should start with the emergency treatment procedures, and immediately report to the relevant department and public security department. 学校外国专家(外教)管理制度一、基本制度(一)管理总则第一条随着学校的外事工作不断发展,学校与国际间的交流合作的增多,为使外事人员的工作规范化,加强外事工作管理,特制定本工作制度。
第二条外事工作坚持统一领导原则,必须在授权范围内开展,贯彻党中央制定的统一的对外政策,服从湖南省对外工作的总体部署。
第三条外事工作总原则(一)坚持“四项基本原则”。
(二)外事无小事:在外事工作中不允许出现任何问题,保证万无一失。
若出现问题,必须实事求是逐级请示,并书面上报。
(三)内外有别:外事工作尺度坚持内外有别。
(四)外事授权有限:办事要遵守国家有关的政策和制度,没有自由发挥的空间。
(五)及时请示汇报:问题出现的第一时间先电话汇报,然后递交文字材料,报告处理结果。
(二)外事工作的主要事项第四条聘请:本着“积极而有计划” 的聘请原则,广开渠道,择优选聘,实事求是,量力而行。
把好质量关,认真研究人选材料,加强与对方联系,严格审查,确定外教有良好的职业道德,能遵守中国的教育制度、法律、法规,做到教书育人,为人师表后方可正式聘请。
第五条合同:为使学校与外教双方有序的合作,明确责任,保护双方的利益,在外教来华或到职前必须签定正式合同,合同内容依外专局有关规定及学校实际情况而定。
第六条宿舍设备:学校按外专局有关要求及学校实际情况,提供住房及室内生活设备,在外教进住居室前,校方须将室内打扫干净,设施、设备摆放得当,床上用品每年更新一次。
电器及家具保证处于良好状态,上、下水、电话、宽带通畅、无故障。
住户可免费使用,使用中力求合理,可视自己的爱好与习惯增添设备。
第七条迎接:根据合同规定,新聘教师到职前,学校派人去长沙迎接。
由相关部门领导及人员安排好迎接方式并安排好其生活。
第八条教学安排:原则上由英语部安排,教务、年级组协助监督,必须按合同要求,最大限度地发挥外教的作用,每学期由学校组织进行一次教学质量评估。
第九条解决生活困难:外教在校工作期间,如生活上有困难或不便,可直接找外事负责人员,有关人员应尽快帮助解决,学校应及时帮助办理各种证件、邮件等。
外国文教专家生活管理制度

外国文教专家生活管理制度第一条学校全体人员都要尊重外国专家的风俗习惯和宗教信仰,照顾好外国专家的生活特点,外国专家除按我国法定节日可以休假外,在其本国的民间传统节日期间也可休假,如圣诞节等。
外国专家要求过本国国庆、外籍专家的生日可以视当时具体情况为其举行联欢活动,其它外国节日均不给假。
新天地语言培训学校的中方工作人员除通知外国专家外,应做好教学工作,不致影响教学工作。
第二条学校主动关心并安排专人负责外国专家的业余生活,对外教上下班过程中做好安全教育工作,安排好周末和节假日的休息或参观游览等活动。
外教外出有领导小组安排好住宿、交通、安全等各方面事务。
第三条学校为来华的外国文教专家提供良好的食宿和工作条件,学校设专人为外教专家服务,专人负责,及时反馈外籍专家的意见,尽量满足外籍专家的要求。
第四条学校管理层和中方员工应加强与外国专家的交往,从生活和工作上多关心外国专家,并及时与外国专家沟通,了解其思想动态和工作与生活方面的情况和问题,及时处理和解决外国专家在生活和工作中遇到的困难,学校领导应经常研究并做好切实的工作。
第五条学校将按合同规定,组织和安排外国专家的带薪休假旅行活动等。
第六条外国专家结束在新天地语言培训学校的工作,应按有关规定办理交回《外国专家证》及申办回国离境手续。
第七条外籍文教专家住宿管理制度。
学校为外籍文教专家在学校附近租住住宅公寓,住宿条件优越,宿舍设施齐全,独立卫浴设施,房间内还配置了空调、冰箱、电视、电话、宽带及取暖等设施,且聘请专业物业公司负责日常管理,确保外籍文教专家到任后,由学校外籍文教专家工作小组介绍学校概况、工作任务、生活安排等,帮助外籍文教专家熟悉学校工作及住宿环境等。
第八条外籍文教专家课酬发放制度。
每月底由学校外国专家领导小组按照与外籍文教专家所签订的协议,将本月课酬发放给外籍文教专家本人。
同时在不违反国家政策的前提下根据学校的具体情况及时提高外籍专家的待遇。
第九条外籍文教专家保险制度。

1. For employing foreign experts (teachers) for over 6 months, the school will report to international cooperation and exchange division;2、国际合作与交流处根据幼儿园需求情况编制上报聘请计划,并协助用人单位与有关组织和部门联系选拔和确定人选。
2. International cooperation and exchange division will not only submit employment plan according to the kindergarten’s needs, but also assist the demanders in contacting the relevant organizations and departments so as to choose and decide the most suitable experts or teachers;3、国际合作与交流处与应聘者商定工作和待遇条款,双方草签工作合同。
3. The international cooperation and exchange division shall negotiate with the applicants about the work conditions and salary terms so that both parties can sign a preliminary work contract;4、国际合作与交流处负责上报应聘外教的基本情况,经批准后及时办理来华邀请及入境手续。
外教到职后,协助其办理《居留证》。
4. After the international cooperation and exchange division has reported the basic information of the foreign applicants, it should timely send out employment invitation and transact immigration procedures once the approval is issued. After the foreign teachers settle down, the division shall help them apply for and obtain Certificate of Residence.5、长期外国专家(外教)工作试用期为3个月。
在3个月以内能够胜任工作的,国际处与其签订标准合同。

合作教师应帮助外教适应幼儿园的教学和生活,帮助其解决教学和生活上的问题,并积极向外教学习专业知识和教学方法,注意收集和积累外教的讲课方式。
